HomeMy WebLinkAboutAgenda Report - September 2, 1981 (41).1 d4d yex, fv RESOLUTION NO. 81-123 RESOLUTION AWARDING THE BID FOR OIL AND GAS LEASE (WHITE SLOUGH WATER POLLUTION CONTROL PLANT PROPERTY) WHEREAS, on July 1, 1981 the City Council of the City of Lodi adopted Resolution No. 81-80, "A Resolution of the City Council of the City of Lodi Declaring Its Intention to Call for Bids for a Certain Oil and Gas Lease and Making Findings in Connection Therewith"; WHEREAS, pursuant to Resolution No. 81-80, the City Clerk published the subject resolution in both the "Lodi News Sentinel" an_"Lodi Life and Times", newspapers of general circulation published and printed in the city and county where the.property is situated; WHEREAS, pursuant to Resolution No. 81-80, the City Clerk did receive and open the following bids at the August 19, 1981 Council Meeting: City of Santa Clara Texas Oil and Gas Corp. $1.0,005.00 - cash bonus, including first year's rent $15,000.00 - cash bonus, including first year's rent WHEREAS, the City Manager recommends that the award be made to the highest bidder, Texas Oil and Gas Corporation, in the amount of $15,000.00 - cash bonus, including first year's rent. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi, that award for Gas and Oil Lease for White Slough Water Pollution Control Plant Property be and the same is hereby made to Texas Oil and Gas Corporation, the high bidder, in the amount of $15,000.00 - cash bonus, including first year's rent. Section 2. - Pursuant to Section 7058.5 of the Public resources Code of the State of California, the City Council declares that it intends to call for bids for an oil and gas lease in the form of the lease referred to in Section 1 of this. Resolution. The property to be leased is situated in the County of San Joaquin, State of California, and is described as follows: Portions of Sections 23, 24, 25 and 26, Township 3 North, Range 5 East, Mount Diablo Base and Meridian, also being described as Assessor's Parcels 055-120-1, ' 055-120-7, 055-130-4, 055-130-13, 055-130-14, 055-130-15, 055-150-11, 055-150-12, 055-150-14, 055-150-15, and 055-150-17. The property is also commonly known as the. . c • White Slough Control Plant Property._ .For more detailed description, reference is hereby made to Exhibit "A" appended to proposed form of Subsurface Oil and Gas Lease, hereinabove referred to in Section 1 which is on file in the office of the City Clerk of the City of Lodi. Diagrams of the subject areas are also on file in the office of the Lodi City Clerk. Section 3. - The royalty share payable for o31, gzz.-, and other hydrocarbons produced from wells on the leased land shall.be one-sixth (1/6), to be computed as provided in said form of lease. The one 'variable bidding factor upon which bids shall be received shall be the cash bonus consideration, including the first year's ).ental. The minimum rental per year during the primary term shall be as specified in paragraph 4 of Cle lease. The term of the lease shall be for a period of five (5) years and for such longer period (not to exceed 35 years) during which oil, gas and other hydrocarbon substances shall be produced from the leased land, or lands with which .the leased land may be pooled. Lessor will permit drill sites only at such locations as may be mutually agreed upon by Lessor and Lessee. Section 4. - None of the land described in the form -of lease hereto has been used, owned, dedicated or acquired as parks, highways, streets, walks or public playgrounds for park purposes. • -2- t. .. Section 5. - The bidder shall submit his bid in letter form accompanied by a Certified or Cashier's check in the ful 1 amount of the cash bonus consideration, including rental, bid for the first year. The bid shall set forth the said cash bonus consideration, and shall indicate bidder's willingness to enter into a lease in all respects identical to the lease referred to in Section 1, except for the identity of the Lessee. Section 6. - Bids for said Agreement of Lease are hereby invited and shall be received in the office of the City Clerk located in the City Hall, Lodi, California, until 5:00.p.m. on Wednesday, the 19th day of August, 1981, and shall be opened and publicly declared by the Council at 8:00 p.m. on said date. Section 7. - The City Clerk shall publish this resolution once a week for four successive weeks in the Lodi News Sentinel and Lodi Life and Times, newspapers of general circulation published and printed in the City and County where the property is situated.
