General Services Units 1982
MEMORANDUM OF UNDERSTANDING
This ;•Memorandum of Understanding is entered into
between representatives of the City of Lodi (hereinafter
referred to as "City") and representatives of the General
Services Unit.
The parties to this Memorandum of Understanding
acknowledge and agree that this Memorandum of Understanding
constitutes the result of Meeting and Conferring in good
faith as contemplated by Sections 3500, et seq. of the
Government Code of the State of California, and further
acknowledge and agree that all matters upon which the
parties reached agreement are set forth in this Memorandum.
Except as specifically modified by this Memorandum, all
existing benefits currently being furnished to employees and
all existing terms and conditions of employment are to
continue in effect unless and until the parties meet and
confer regarding a change in such existino benefits, terms
or conditions of employment.

Gen Lial Services: 1982
The terms and conditions of this Memorandum of
Understanding are applicable to those employees in positions
allocated to the General Services Unit of the City of Lodi.
It is mutually agreed that wages, hours and other terms and
conditions of employment of such employees shall be changed
as hereinafter set forth and applicable ordinances and
resolutions shall be presented to the City Council for
action, and administrative rules and policies shall be
modified accordingly.
The terms and conditions of this Memorandum shall
continue in effect during the term of this Memorandum. The
parties agree as follows:
1. Term:
Covering the period from August 30, 1982 through
July 3, 1983.
2. Salary:
A. Effective August 30, 1982, the present salary
rates will be increased by 5.0% for all classes.
B. Effective January 3, 1983, in lieu of any other
salary adjustments which otherwise may have been
agreed upon in this Unit, the City will pay into
each employee's PERS account 7% of the
employee's base salary.

3. PERS:
The City agrees to maintain the same PERS retirement
program and to pay the employer's cost.
4. Medical Insurance:
Effective September 1, 1982, the City agrees to
modify the present hospital and major medical plan
as follows:
Deductible: $100.00 per individual
$200.00 per family unit
Basic Room Rate: $180.00
CCU and ICU 3008 of basic room rate
The City will pay the following amounts for the
medical insurance plan:
Employee:
Dependent:
$53.03 per month
$52.77 per month
5. Dental:
Effective September 1, 1982, the City agrees to pay
$10.00 per month per employee for this program.
6. Holidays:
The Holiday Schedule will be modified as to observe

the day after Thanksgiving as a fixed holiday and
the number of floating holidays be reduced from 4 to
3.
Holidays which fall on a Saturday will be observed
on the preceding Friday.
7. Sick Leave Conversion:
1. The City will pay up to $106.00 per month for
medical insurance premiums for retiree and
dependent.
2. The City agrees to allow a surviving spouse to
purchase medical insurance at the employee only
premium for the same period as if the employee had
not died.
8. Vacation:
The following vacation schedule will be effective
August 30, 1982:
During the first continuous 12 months of employment,
no vacation days shall be earned. For example, an
employee who terminates employment for any reason
during the first twelve months of employment shall
not be ontit led to any po of E for vacation days.

At completion of 12 continuous months of employment,
10 days' vacation leave will be credited to the
employee's account.
1-5 years - vacation earned at rate of 10/days year.
6-15 years - vacation earned at rate of 15
days/year.
16-20 years - vacation earned at rate of
20-days/year.
Each year over 20 years - vacation earned at rate of
1 additional day per year, to a maximum of 25
days/year.
Persons presently working the first 12 months of
employment will continue to accrue vacation at the
rate of 10 days per year.
9. probation:
For all promotions after August 30, 1982, the
probationary period will be one year. For those
promotions which are made as a result of a formal
test or examination, will be eligible for a merit
increa:;e in six months. For those promotions which
are made as a result of on-the-job experience, i.e.,
Civil Engineering Tech I to Civil Engineering Tech

II, will be eligible for a merit increase in 12
months following promotion.
10. Grievance Procedure:
The grievance procedure will be modified to include
provisions for the Department Head to spell out his
actions in writing and to include the fact that the
employee has S working days in which to appeal that
action and to whom the appeal must be made.
11. Communication:
The City agrees to provide written notification to
all employees of changes in the wage and benefit
package.
12. Severability:
In the event that any provision of this Agreement is
found by a court of competent jurisdiction to be
invalid, all other provisions shall be severable and
shall continue in full force and effect.
13. Concerted Activities:
Represented employees agree that they will not
strike, withhold services, engage in "slow downs" or
"sick ins" or participate in any other form of
concerted activity which is inz�ended to or which

does adversely affect job performance or rendering
of City services.
14. City Rights:
It is further understood and agreed between the
parties that nothing contained in this Memorandum
shall be construed to waive or reduce any rights of
the City, which include, but are not limited to the
exclusive rights: to determine the mission of its
constituent departments, commissions and boards, to
set standards of service; to determine the
procedures and standards of selection for
employment; to direct its employees; to maintain the
efficiency of governmental operations; to determine
the methods, means and personnel by which government
operations are to be conducted; to take all
necessary actions to carry out its mission in
emergencies; and to exercise complete control and
discretion and the technology of performing its
work. City rights also include the right to
determifle the procedures and standards of selection
for promotion, to relieve employees from duty
because of lack of work or other legitimate reasons,
to take disciplinary action, and to determine the
content of job classifications; provided, however,
that the exercisc by the City of the rights in this
paragraph does not preclude employees or their

RESOLUTION MODIFYING SALARY RANGES
RESOLVED, that the City Council of the City of Lodi does
hereby modify salary schedules for the General Services and Maintenance
and Operators Unit effective the pay period beginning August 30, 1982
as shown on exhibits "A" and "B", attached hereto and thereby made a
part thereof.
FURTHER RESOLVED, that those positions marked by an asterisk
receive the newly established salary effective July 5, 1982.

AMENDMENTS
RESOLVED, that the City Council of the City of Lodi does
hereby approve the payment of $10.00 per month for dental
insurance
premiums for all employees in the General Services and Maintenance
and Operator Units effective September 1, 1982.
