Following introduction of the matter by Assistant City Manager `
Glenn, and Council discussion, Council, on motion of Council
Member Olson, Reid second, received for filing "Addendtxn to
Memorandum of Understanding Covering Period July 1, 1985 - June
30, 1988 Between City of Lodi and IBEW Local 1245, Maintenance
and Operators Unit and General Services Unit".
Further, Council, on nation of Council Member Olson, Reid
second, adopted Resolution No. 85-114 - "Resolution Modifying
Resolution 3344" as it pertains to the decertification of
Established Units, which section will now read as follows:
B. Decertification of Established Unit
(1) A petition for decertification alleging that an employee
organization granted formal recognition is no longer the
majority representative of the employees in an appropriate
unit may be filed with the Municipal Employee Relations
Officer only during the month of November of each year
following the first full year of formal recognition,
except that such date may be charged to a period 90 . to 6
days before the expiration of a current N,ezmrandum of
Understandina if mutually agreed to by both parties.

ADDENDUM
TO
MEMORANDUM OF UNDERSTANDING
COVERING PERIOD JULY 1, 1985 - JUNE 30, 1988

CITY OF NODI AND IBEW FOCAL 1245
MAINTEdANCE AND OPERATORS UNIT AND GENERAL SERVICES UNIT
UNION SECURITY
Article 1. Delete Paragraph 1.3
1.4. IBEW Local Union 1245 will maintain exclusive representation
.rights during the term of this agreement; except that between the
last 90 to 60 days of the then current terns employees may seek to be
represented by another organization of their choosing or not to be
represented by any organization. The procedures for such
decertification are specified in City of Lodi Resolution 3344,
Section 3B1.
1.5. Every employee covered by this memorandum of understanding who
is a member of IBEW local 1245 on September 6, 1985 shall as a
condition of employment (1) maintain his or her mmbership in good
standing in accordance with its Constitution and Bylaws of the
IBEW, Local Union 1245; or (2) in the alternative, an employee must
tender a registration fee to the Union equal to the initiation fee
required of Union members, and shall tender, monthly, a
representation fee in an amount equal to the amount of the monthly
dues and per capita fees required of a BA member in his base wage
rate, either by payroll deduction or cash payment.

RESOLUTION MODIFYING RESOLUTION 3344
RESOLVED, by the City Council of the City of Lodi that Resolution 3344
dated January 21, 1970 be modified as follows:
Section 3 Rule 1 - Representation Proceedings
B. Decertification of Established Unit
(1) A petition for decertification alleging that an employee
organization granted formal recognition is no longer t,.e majority
representative of the employees in an appropriate unit may be filed with the
Municipal Employee Relations Officer only during the month of November of each
year following the first full year of formal recognition, except, that such
date may be changed to a period 90 to 60 days before the expiration of a
current Memorandum of Understanding if mutually agreed to by both parties.
