HomeMy WebLinkAboutAgenda Report - August 19, 1987 (103)(1102M CONSIDER EXTENDING THE MORATORIUM ESTABLISHED PURSUANT TO ORDINANCE NO. 1387 ON THE CONSTRUCTION OR RECONSTRUCTION OF OFF -PREMISE SIGNS URGENCY ORDINANCE NO. 1405 ADOPTED Notice thereof having been published according to law, an file in the office of affidavit of which publication is on Clerk, Mayor Olson called for the Public Hearing the City to consider extending the moratorium established pursuant Council on CC -171 to Ordinance No. 1387 adopted by the. Lodi City of August 6, 1986 on the construction or reconstruction off -premise signs as defined in Lodi Municipal Code Section 17.63.370. Council was reminded that on August 6; 1986, pursuant to 65858, Ordinance No. 1387 was Government Code Section adopted establishing a twelve-month moratorium on the issuance of building permits for construction or of off -premise signs as defined in Lodi reconstruction Lodi, wcould the City and Municipal Code segni0requi so that th requirements reviewed improved. Council is now asked to consider extending this moratorium for a period of six months. The extension of the moratorium will provide the necessary time for staff to complete a draft sign ordinance which requires a number of public hearings before the Planning Commission and the City Council, as well as a review by s Jones and Stokes of Sacramento, consultants. This review is indicated because the Council, in updating of the City's general plan, has included an aesthetic element, and in order to properly evaluate the draft sign ordinance, it should be reviewed for consistency with the aesthetic element. Further, the Assistant Planner who was working with the City Attorney on the development of the draft sign ordinance, moved away from the City, and the Community Development Director now has taken on this responsibility, along with his numerous additional responsibilities. There were no persons in the audience wishing to speak on the matter, and the public portion of the hearing was `. closed. Following discussion, with questions being directed to _K Staff, Council, on motion of Council Member Reid, Ninchman second, adopted Ordinance No. 1405 entitled, "An urgency Ordinance of the Lodi City Council Extending for Six Months, the Moratorium on the Construction or Reconstruction of Off -Premise Signs Within the City of. Lodi". The motion carried the following vote: Ayes: Council Members - Ninchman, Pinkerton, Reid, and Olson (Mayor).:. FROM: THE CITY MANAGER'S OFFICE August 19, 1987 SUBJECT: PUBLIC HEARING TO CONSIDER EXTENDING THE MORATORIUM ESTABLISHED PURSUANT TO ORDINANCE NO. 1387 ADOPTED BY THE LODI CITY COUNCIL ON AUGUST 6, 1986 ON THE CONSTRUCTION OR RECONSTRUCTION OF OFF -PREMISE SIGNS AS DEFINED IN LODI MUNICIPAL CODE SECTION 17.63.370 (ADOPT URGENCY ORDINANCE) PREPARED BY: City Attorney RECOMMENDED ACTION: That the Council, by a four-fifths vote, by urgency ordinance, extend for six months, the moratorium on the issuance of building permits for the construction or reconstruction of off -premises signs within the City of Lodi. BACKGROUND INFORMATION: On August 6, 1986, pursuant to Government Code Section 65858, Council adopted Ordinance No. 1387 establishing a twelve-month moratorium on the issuance of building permits for construction or reconstruction of off -premises signs as defined in Lodi Municipal Code Section 17.63.370 within the City of Lodi, so that the sign requirements could be reviewed and improved. RMS:vc cccsigns/txta.Gly PUBLIC HEARING.TO CONSIDER EXTENDING THE MORATORIUM ESTABLISHED PURSUANT TO ORDINANCE NO. 1387 ADOPTED BY THE LODI CITY COUNCIL ON AUGUST 6, 1986 ON THE CONSTRUCTION OR RECONSTRUCTION OF OFF -PREMISE SIGNS AS DEFINED IN LODI MUNICIPAL CODE SECTION 17.63.370 WHEREAS, pursuant to Section 65856 of the State of California Government code and, after public hearing held pursuant to said section, the City Council of the City of Lodi did, on August 6, 1986, adopt Ordinance No. 1387 entitled "An Ordinance Of The Lodi City Council Establishing A Moratorium On The Construction Or Reconstruction Of Off -premise Signs Within The City of Lodi", and WHEREAS, Ordinance No. 1387 declares a moratorium on the construction or reconstruction of off -premise signs as defined in Lodi Municipal Code Section 17.63.370 within the City of Lodi for a period of twelve months, and WHEREAS, the City Council of the City of Lodi is now asked to consider extending the moratorium for a period of six months. The extension of time will provide the necessary time for staff to complete a draft sign ordinance. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lodi does hereby call a public hearing on Wednesday, August 19, 1987, at the hour of 7:30 p.m., to receive public testimony to extend for six months the moratorium on the issuance of building permits for the construction or reconstruction of off -premises signs within the City of Lodi as set forth in Ordinance No. 1387. The public hearing will be conducted in the Council Chambers, 2nd floor, City Hall, 221 West Pine Street, Lodi, California. All interested persons are invited to present their views on this matter. Written statements may be filed with the City Clerk at any time prior to the hearing scheduled herein and oral statements may be made at said hearing. BE IT ORDAINED BY THE LODI CITY COUNCIL. SECTION 1. Pursuant to Section 65858 of the State of California Government Code, and after public hearing held pursuant to said section, the City Council of the City of Lodi hereby declares by the adoption of urgency ordinance, a six-month extension of the moratorium established by Ordinance 1387 adopted by the Lodi City Council on August 6, 1986, on the construction or reconstruction of off -premises signs as defined in Lodi Municipal Code Section 17.63.370. SECTION 2. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict ma.y,exist. SECTION 3. This urgency ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect immediately.
