Council was apprised by Assistant City Manager Glenn
that
no single agency within San Joaquin County has the

In light of this, the San Joaquin County Sheriff's
Department, the police departments of Stockton, Lodi,
Manteca, Tracy, Escalon and Ripon, the California Highway
Patrol, the San Joaquin County District Attorney have
agreed to work together-. with the California Bureau of
Narcotics Erforcement to form a task force to.collectively
and co-operatively increase public awareness of drug
problems, . and to. investigate and enforce controlled
substance laws and other drug related criminal activity.
This formalized drug enforcement task force will be known
as the Combined Rural and City Narcotics Enforcement Team
(CRACNET).
On motion of Council Member Pinkerton, Hinchman second,
Council approved ar; agreement to form a county -wide drug
enforcement team (CRACNET) and authorized the Chief of
Police to execute the agreement on behalf of the City.

ABATING WEEDS
Pursuant to the State Government Code, at the time fixed for receiving and
considering the report, the legislative body shall hear it with any objections
of the property owners liable to be assessed for the abatement. After
confirmation of the report by the Council a copy shall be forwarded to the
County Assessor and Tax Collector who shall add the amount of the assessment to
the next regular tax bill levied against the parcel for municipal purposes.
Notice of this hearing was published purs-.ant to law (see Exhibit "C" attached)
and a copy of the notice was forwarded to each property owner under Declaration
of Mailing.
Attached you will find the report of the Street Superintendent indicating the
cost of the City Weed Abatement Program for 1987 (see Exhibit "A" attached)

(CRACNET)
PREPARED BY: Assistant City Manager
RECOMMENDED ACTION: The City Council authorize the Police Chief to execute
an agreement with other law enforcement agencies in San
Joaquin County to form a narcotics enforcement team. By
signing this agreement the City is committing to
providing a police officer a.id a vehicle to the program.
BACKGROUND INFORMATION: 'No single agency within San Joaquin Countv has the
resources necessary to combat the narcotics problem on
their own. During the past few years numerous potential
na-rcotics investigation cases have beEn_left on tine "back
burner" because of the lack of manpower, vehicles or money to sustain adequate
investigation.
In light of this, the San Joaquin County Sheriff's Department, the police
departments of Stockton, Lodi, Manteca, Tracy, Escalon and Ripon, the California
Highway Patrol, the San Joaquin County District Attorney have agreed to work
together with the California Bureau of Narcotics Enforcement to form a task force
to collectively and co-operatively increase public awareness of drug problems, and
to investigate and enforce controlled substance laws and other drug related
criminal activity.
This formalized drug enforcement task force will be known as the Combined Rural and
City Narcotics Enforcement Team (CRACNET).

FOR THE FORMATION
OF
COMBINED RURAL AND CITY NARCOTIC ENFORCEMENT TEAM
SECTION 1.01 PURPOSE
No single agency within San Joaquin County has the resources
necessary to combat the narcotic problem on their own. No agency
has been able to commit sufficient resources to maintain a
sustained program that narcotic dealers would consider to be a
serious threat. Traffickers are able to continue narcotic sales
without fear of detection and prosecution.
During the past few years, numerous potential narcotic
investigations cases have been left on the "back burner" because
of the lack of manpower, vehicles or money to sustain adequate
investigation. Public sentiment against the illegal production,
sale and illegal use of controlled substances has never been
stronger. This public support serves as a solid foundation for
needed and desired increases in the drug enforcement efforts
within San Joaquin County.

CR TC -NET rGREEMENT
1'h_ purpose of this iioc'u:nent is to formali-ze and certify in
written forI21 that the San Joaquin County Sher ff's DeQart teI2t,
the Stockton Police Department, the Lodi Police Department, the
:ianteca Police Department, the Tracy Police Department, the
Escalon Police Department, the Ripon Police Department, the
California Highway- Patrol, and the District Attorney's Office of
the County of San Joaquin have agreed to work in conjunction with
the California Bureau of Narcoti:s Enforcement to effectively
enforce the controlled substance laws of the State of California
as expressed in the Health and Safety Code and the investigation
of other drug related criminal activity pursuant to California
Penal. Code Section 830.1 and its provisions. Those enforcement
efforts coupled with the above -stated cooperative effort shall be
accomplished by means of utilizing the drug task force concept
rath;>r than relying solely on indiv?'ual agency enforcement
efforts. Use of this task force concept is intended to insure a
well coordinated county -wide narcotic enforcement effort and
increase the flow of narcotic related intelligence information
between the various law enforcement agencies within the County of
San Joaquin. This formalized drug enforcement task force shall
be called the Combined Rural and City Narcotic Enforcement Team
and will hereinafter in this document be referred to as CRACNET.

CR.AC-NET AGREEMENT
Section 1.2 Goals and
The initial goals and objectives of CRACNET are generally stated
as follows:
I. Initiate investigation involving all levels of drug
traffickers with the overall objective of identifying and
apprehending major drug traffickers.
2. Assist requesting agencies on specific drug problems within
the respective jurisdictions in San Joaquin County as
needed and authorized by the CRACNET Council.
3. Gather and disseminate drug or criminal intelligence
information to the police agencies served by the task force.
4. Provide formal and on-the-job training in narcotic
enforcement to other officers employed by participating
agencies.
5. Conduct public presentations to service clubs, civic groups,
and educational entities with approval of the task force
supervisor.

6. Conduct an ongoing assessment of task force policies,
management systems, evidence handling, reporting
procedures, and methods of operation and make
recommendations to the governing board through the task
force supervisor for improvement.
7. Demonstrate by concentrated narcotic enforcement a positive
impact on the occurrence of drug related crimes.
SECTION 2.41 TASK FORCE COUNCIL
The department head from each participating agency, or his
designee, shall serve on a task force council which shall be
solely responsible for the establishment of operational policies
and administrative procedures for the task force. This governing
body shall be known as the CRACNET Council. Each member of the
CRACNET Council will have an equal vote on all policy matters.

Council shall meet monthly to discuss task force activities, make
changes in policies and procedures, and give guidance to the task
force supervisor concerning enforcement priorities.

CRAC-NET AGREEMENT
S'ECTIGN 2.2 Council Chairman,
The CRACNET Council shall annually elect a Council Chairman for
the council. The Council Chairman will be the task force
supervisor's primary contact with the council on normal
operational matters and will bring to the council's attention any
matters which would require a consensus of the council prior to a
regularly scheduled monthly meeting. The Council Chairman shall
also preside over CP.ACNET Council meetings and is responsible for
the formulation of minutes for the meetings and notification of
council members of upcoming meetings. The Council Chairman shall
not be a member of the Bureau of Narcotic Enforcement. No person
shall hold the position of Council Chairman for consecutive
terms.
Sectio•i 2.3 Changes in organization
In the event that a member or members of the CRACNET Council
wishes to change a task force procedure or policy as expressed in
this agreement or the task force manual of instructions, those
changes will be made with the consent of the entire council

resulting from a majority vote in favor of such change. The
Council Chairman of the CRACNET Council shall notify the task
force supervisor of the pertinent policy changes prior to the
effective date of such change.
Section 3.1 CALIFORNIA BUREAU OF NARCOTIC ENFORCEMENT
It is agreed that the California Bureau of Narcotic Enforcement
will provide a Special Agent Supervisor as a full-time member of
the CRACNET. The Special Agent Supervisor will assume the title
and responsibility of Task Force Supervisor and as such will have
the primary responsibility for supervision of all activities of
task force members.
The Special Agent in Charge from the California Bureau of
Narcotic Enforcement shall in his capacity as a CRACNET Council
member and through attendance at the task force council meetings
and contact with the task force supervisor insure that Bureau of
Narcotic Enforcement commitments made to CRACNET are being
carried out. The Special Agent in Charge will also act as a
liaison between CRACNET and other Department of Justice sponsored
narcotic enforcement teams in other counties of California.

CIRAC-NET AGREEMENT
Section 3.2 Enforcement Priorities
It is understood and agreed that the priorities for levels of
narcotic enforcement bar CPACNET will be set by a consensus or
majority vote of the CRACNET Council. Current drug trafficking
trends and enforcement problem areas identified by the Bureau of
Narcotic Enforcement Task Force Supervisor will be considered
when establishing enforcement priorities and goals.
It is also agreed that CRACNET, unless otherwise directed by the
council shall pursue a multi-level enforcement posture when
considering investigating individuals or groups of individuals
involved in illicit drug trafficking. Specifically, the task
force will address itself to localizing street -level drug
activity in particular geographic areas as well as addressing the
more long-term and complicated investigations which might involve
larger geographic areas and more sophisticated levels of drug
trafficking.
Section 3.3 Policy and Procedures Manuals

it is agreed that all members of the task force shall abide by
applicable policies and procedures as expressed in the California
Bureau of Narcotic Enforcement manual of instructions for a
period of not more than six months. The task force supervisor
will, within the six-month period, establish and submit for
approval by the council a task force manual of instructions which
is specific in content to the needs, objectives, and goals of
CRACNET.
Section 3.4 Reports
It is zgreed that the task force supervisor will submit a monthly
report of activity to the council no later than 15 days following
the month of reported activity. This report will summarize task
force activity, fund expenditures, and drug trends. The task
force supervisor will also prepare a standard Bureau of Narcotic
Enforcement Violator Classification Sheet for each person
investigated by the task force. The Violator Classification
Sheet will assist the council and the task force supervisor in
determining if the multi-level approach to narcotic enforcement
is being acted upon by members of the task force.

RAC -NET AGREEMENT
The task force supervisor is also charged with the responsibility
of initiating a reporting system or systems for CRACNET which
will record the task force's detailed fiscal and statistical
data. These reporting systems will serve as the support system
for the creation of monthly activity reports as well as insure an
ongoing accounting of the expenditures of funds and manpower
resources.
It. is agreed that a valuable method of assessing the
effectiveness of CRAC14ET is to conduct a complete inspection of
all CRACNET's operational and administrative activities on an
annual basis. This inspection shall be conducted by the Special
Agent in Charge - Inspections for the Bureau of Narcotic
Enforcement. Whenever possible, members of the CRACNET Council
will take part in the inspection process. A complete report of
inspection findings shall be forwarded to the CRACNET Council for
use in realigning enforcement priorities, establishing revised
administrative record systems, or changing operational
methodology when necessary. As a part of the inspection process,
each available CRACNET Council member will be interviewed by the
inspection team fcr valuable input prior to the issuance of an
inspection report.

CRAC-NET AGREEMENT

an annual report of activity no later than July 30 of each year.
This annual report will summarize for the CRACNET Council the
proceeding year's operation and shall include a section for
statistical data broken down in a similar fashion to that of the
monthly reports. This report shall also contain sufficient
information regarding controlled substance abuse and trafficking
trends to enable the CRACNET Council to reassess task force goals
and objectives annually.
Section 3.4 LiabilitieF
Each part.cipating agency of CRACNET (hereinafter referred to as
the "indemnifying party") shall be responsible for the acts of
its participating officer(s) and shall incur any liabilities
arising out of the services and activities of those officers
while participating in the CRACNET. The indemnifying party shall
hold harmless and indemnify every other party to this agreement
(referred to hereinafter as the "indemnified party or parties")
from and against any and all liability, claims, demands, damages,
attorney fees, and other costs arising out of or relating to the
indemnifying party's performance under this agreement, including
but not limited to all liability, claims, demands, damages,

attorneys fees, and other costs arising out of or relating to any
defects in the vehicles or other equipment supplied or operated
by the indemnifying party pursuant to this agreement and/or any
negligent acts or omissions of an employee of the indemnifying
party which occurs in the performance of this agreement to the
extent allowed by law.
Should an indemnified party or parties or any employee or agent
of an indemnified party or parties be named in any suit, or
should any claim or demand be made against it or them by suit or
otherwise, whether the same be groundless or not, arising out of.
or relating to the indemnifying party's duties and obligations
under this agreement, then the indemnifying party shall defend
the indemnified party or parties and/or the officers or agents of
the indemnified party or parties and shall pay any Judgement
rendered against it or them or any sums paid out in settlement or
otherwise. The provisions of this section shall not, however,
relieve any indemnified party or parties from the obligation of
presenting to the indemnifying party a verified tort claim for
indemnification in the manner and within the time provided by the
California Tort Claims Act, provided that not withstanding
anything in this section to the contrary, each participating
agency shall be solely liable for any and all worker's

compensation benefits for personnel which are empioved by them
and are injured in the course and scope of their duties while
assigned to CRACNET.
This agreement is between lay: enforcement agencies and is not
intended to be a joint powers agreement under Section 6500 of the
Government C -3de of the State of California.
Personnel assigned to CRACNET shall be deemed continuing under
the employment of their jurisdiction and shall have the same
powers, duties, privileges, responsibilities, and immunities as
are conferred upon him as a peace officer in his own
jurisdiction.
Section 4.1 Salaries Benefits, and Insurance
Each participating agency will incur its own salary, worker's
compensation, benefits and upkeep of its own personnel, vehicle.

CRAC-NET AGREEMENT
The task force supervisor shall schedule manpower rosrEctina the
overtime policies of the parent agency and shall maintain
communication with the effected agency when scheduling such
overtime whenever practical.
SECTION 4.2 Internal Affairs Investigation
It is specifically understood that CRACNET is not an internal
affairs investigative unit. Members of CRACNET shall, however,
participate as any other officer in the parent agency in
cooperating in such internal affairs investigation as a witness.
Nothing in this paragraph is meant to limit task force members
from investigating criminal activities of government employees.
Section 5.1 Base term of Aqreement
This agreement shall commence on July 1, 1987 and remain in
effect until June 30, 1989. The participating agencies may, by
mutual agreement, elect to extend the term of the agreement prior

to its expiration by a formal vote of the CRACNET Council and the

approval of the affected legislative bodes or officials of each

agency as required.
Section 5.2 Prior Termination by Agency
Any participating agency desiring to terminate its participation
in this agreement shall indicate such intent, in writing, to the
CRACNET Council setting forth its reasons for termination of the
agreement. The termination of participation in this agreement by
such jurisdiction shall be deemed to take effect not less than
thirty (30) days following the first monthly meeting of the
CRACNET Council following receipt of the written communication of
the intent to terminate.
Section 5.3 Termination by California Bureau of Narcotic
Enforcement.

if representation to the task force of sworn personnel by local
agencies falls below four (4) assigned officers, grounds shall be
deemed to exist to constitute withdrawal of the field supervisor from

assignment. Withdrawal of the supervisor shall be in compliance
with the provisions of paragraph 5.2.
Section 6.2 Seizure and Forfeitures
Any assets seized and forfeitures accomplished through the
efforts of the task force shall be utilized for the purposes of
enhancement of the task force capacities. A reasonable reserve
shall be established by the CRACNET Council. Sums or assets in
excess of that amount shall be distributed as equitably as
possible based upon the manpower contribution of each agency to
the unit.
Should however, any agency terminate its participation pursuant
to Section 5.2 or 5.3 of this agreement they will terminate their
right to participate in any distribution pursuant to this
paragraph effective the date of the effect of their termination.
Section 6.2 Operational Assets

CRAC-NET AGREEMENT
The California Bureau of Narcotic Enforcement will provide in
addition to manpower, funds for office rent, telephone and
utilities expenses, a radio base station and $40,000.00 in "buy
moneys".
Basic office furniture and supplies sufficient to sustain this
task force will be provided by the participating agencies
(specific equipment from individual agencies is to be
negotiated). However, this will not preclude other agreements
for such furniture and supplies as deemed appropriate by the
CRACNET Council.
Equipment purchased by the unit shall belong equally to all those
agencies in proportion to their manpower contributions. In the
event that the unit is disbanded, such equipment will be
distributed as equally as possible based upon the manpower
contribution of each agency. However, if one agency terminates
this agreement pursuant to Section 5.2 or 5.3 and the unit
continues, all equipment will remain with the unit.
All funds handled by the unit, including any petty cash, shall be
documented by the appropriate receipt and shall be part of the
monthly report submitted to the CRACNET Council.

CRAC-NET AGREEMENT
Section 7.1 SAN JOAQUIN COUNTY SHERIFF'S OFFICE
The Sheriff of San Joaquin County has agreed to contribute to
CRACNET the following manpower and/or equipment:
Two (2) Deputy Sheriffs
Two (2) radio equipped undercover vehicles
miscellaneous investigative equipment.
Section 7.2 STOCKTON POLICE DEPARTMENT
The Chief of Police of the City of Stockton has agreed to
contribute to CP.ACNET the following manpower and/or equipment:
Two (2) Police Officers
Two radio -equipped undercover vehicles
miscellaneous investigative equipment.
Section 7.3 LODI POLICE DEPARTMENT

CRAG-NET AGREEMENT
The Chief of Poi:_ce of the City of Lodi has agreed to contribute
to CRACNET the following manpower and/or equipment:
One (1) Police Office
One radio -equipped undercover vehicle
miscellaneous investigative equipment.
Section 7.4 MANTECA POLICE CEPARTt;E,3T
The Chief of Police of the City of Manteca has agreed to
contribute to CRACNET the following manpower and/or equipment:
One. (1) Police Office
One radio -equipped undercover vehicle

Section 7.7 RIPON POLICE DEPARTMENT
The Chief of Police of the City of Ripon has agreed to contribute
to CRACNET the following manpower and/or equipment:

Section 7.9 CALIFORNIA HIGHWAY PATROL
The Commander of the Stockton Area California Highway Patrol
Office has agreed to contribute to Cn'+CNET the following manpower
and/or equipment:
One (1) Patrol Officer

Section 7.10 SAN JOA UIN COUNTY PROBATION DEPARTME14T
The San Joaquin County Probation Department (hereinafter referred
to as Probation), while unable to supply manpower and equipment
does agree to provide on call services to determine if a suspect
is currently on probation and to inform CRACNET Personnel of the
conditions of that probation. Probation shall cooperate with
CRACNET Personnel in the arrest of probationary suspects.
Section 8.1 SIGNATURES
The undersigned represents that he/she has the authority to
execute this agreement on behalf of the agency that they
represent. In signing of this formai agreement represents and
concurs with the establishment of the Combined Rural and City
Narcotic Enforcement Team as set forth in this agreement and for
the period and purposes as stated herein.
