Order of Abandonment to Abandon Portion of
Easement at 12069 1218 and 1230 South Fairmont
RECOMMENDEO'ACTION: That the City Council NOT adopt an order of Abandonment
to abandon the a ve easement as shown on the attached map.
BACKGROUND INFORMATION: At the Council meeting of July 15, 1981, the City
Council adopted a reso ution of intent to abandon this easement and forwarded
It to the Planning Commission for their finding. The Planning Commission
determined that there was a public need for this easement.
Determination of the exact location of the easement and utilities in it
makes it impossible to abandon the easement at this time. The Public Yorks
Department is working with the owner to resolve the problem with an encroach-
ment permit.

Dear Mr. Hochhalter:
Please be advised that following a staff review of
your request to abandon a portion of an easement. at
'1206# 1218 and 1230 S. Fairmont, it has been determined
that a public need exists. The Lodi City Council, at
its regular meeting of August 19, 1981 following
receipt of this report, voted to deny the request to
abandon said easement.
