T- CiTY OF LODI PUBLIC WORKS DEPARTMENT COUNCIL COMMUNICATION F. l.: g F TO: City Counc i i *` FRCA: City l naSar DATE: August 12, 1982 SUBJECT: Abandonment of 20 foot roadway in WALNUT ORCHARD TRACT RECOMMENDED ACTION: That the City Council adopt a Resolution of intention to abandon afoot strip of land lying north of lot 37. WALNUT ORCHARD TRACT. The Council should also forward this item to the Planning Commission for their ^: recommendation and set a public hearing for September 15, 1982. BACKGROUND INFORMATION: The City has received a request from Leonard Williams, owner o of 37 to a ndon the 20 -foot strip. The strip of land is not being used for streetpurposes and the reason for acquiring the property with the Subdivision is unknown. Mr. Williams his submitted a check for necessary advertising costs, and it appears reasonable to proceed with the abandonment. A sketch of he area is attached. t c L. RESOLUTION.DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO VACATE A 20 -FOOT STRIP OF LAND LYING NORTH OF LOT 37, WALNUT ORCHARD TRACT, LOM, CALIFORNIA BE IT RESOLVED by the City Council of the City of - Lodi as follows: Section 1. It is the intention of the pity Council of the City ofLodi, acting in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, to vacate, close, and abandon the following portions of a street situated in the City of Lodi& County of San Joaquin, State of California, more particularly depicted as follows: 82-87 -1- lw-1 I W Appw#tod by pt,%VA.", Pw%"C *orb$ D4foctw Dots RCE Y. 1: Y. i• Reserving, however, and excepting from the vacation of said street, the permanent easement and the right therein to construct, maintain, repair and operate lines for public utilities, both publicly and privately owned, in, over, and across said alleys. Reference is hereby madD to a map or plan on file i'-� the office of the City Clerk for particulars as to the proposed vacation. Section 2. NOTICE IS HEREBY GIVEN that this City Council does ereby fix WEDNESDAY, October 6, 1982, at the hour of 8:00 p.m. in the City Council Chambers, City Hall, Lodi., California, as the time and place when and where all persons interested in or objecting to the vacation herein proposed may appear before this City Council and be heard. Section 3. Upon adopting of this resolution, the Super ntendent of Streets shall post, or cause to be posted, notice of.such passage and of the time, form and manner as prescribed by law for the vacation of streets. Section 4. This resolution shall be published one time in tSe"Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi, said publication to be completed at least fifteen days prior to said hearing.
