COUNCIL APPROVED THE SUBDIVISION AGREEMENT AND AADDEN- DUM WITH GRUPE COMMUNITIES, INC., THE CITY MANAGER ANDCITY HE CLERK CITYTo EXECUTE THE AGREEMENT ON BEHALF CITY OF LODI PUBLIC WORKS DEPARTMENT COUNCIL COMMUNICATION TO: City Council FROM: City Manager DATE: July 29, 1981 SUBJECT: Approve Subdivision Agreement Addendum Lakeshore Village, Unit No. 1 RECOMMENDED ACTION: That the City Council approve the subdivision agree- ment addendum with Grupe Communities, Inc. and authorize the City Manager and City Clerk to sign on behalf of the City. BACKGROUND INFORMATION: Grupe Communities, Inc. dedicated the property or Well 20 within the Lakeshore Village, Unit No. 1 subdivision, the City is responsible for installing the water and storm drain facilities to serve that well site. it is in the City's best interest to install these improvements at the time subdivision improvements are installed. The subdivider's contractor has priced these improvements at $8,453.50. The price is reasonable and we recommend that the Council approve the agreement to have this work completed. SUBDIVISION AGREEMENT ADDENDUM Lakeshore Village,Unit No. 1 THIS AGREEMENT entered into as of this day of , 1981, between the City of Lodi, hereinafter referred to as "City," and Grupe Communities, Inc., referred to as "Subdivider." WITNESSETH: WHEREAS, the parties heretofore entered into a subdivision agreement dated May 4, 1981, which agreement covered the responsibilities of City and of Sub- divider for the development of LAKESHORE VILLAGE, UNIT N0, l; WHEREAS, the City is responsible for installing water and storm drain facilities to serve the Well 20 site;and WHEREAS, Subdivider has provided City with a firm figure from Subdivider's contractor for doing said work; and WHEREAS, it is in Subdivider's and City's best interest to do the work at the time the subdivision construction is done. NOW THEREFORE, it is agreed between the parties hereto as follows: 1. That this document is considered an addendum to the original subdivision agreement between the two parties dated May 4, 1981; 2. That Subdivider will see that the work shown on the development plans for the subdivision shall be completed at the same time and in the same manner as work in t -he subdivision. 3. The work is as follows: ITEMS QUANTITY DESCRIPTION TOTAL AMOUNT 1. 261 LF 12" Water Main including Valve $5,280.00 2. 181 LF 18" Storm Drain includinq Manhole $3.173.50 TOTAL $8,453.50 4. Based on the above prices, City agrees to reimburse Subdivider in the . normal fashion for contract work, i.e., to pay monthly for work ac- complished, withholding 10% until acceptance of the work by the City Council. at which time payment in full will be made to the Subdivider.
