Section 5 of the aforementioned Resolution stipulates that the City of Lodi is designated as the conducting agency and is authorized to complete proceedings for uninhabited reorganization without public notice and hearing by the City Council pursuant to Section 56439.5 of the District Reorganization Act. NO. 81-111 A lengthy discussion followed with questions being directed to Staff. , On motion of Councilman Pinkerton,g Hu hea .a second, Council adopted Resolution No. 81-111 - "Resolution Approving the LDS Church Reorgani- zation, Including Annexation to the City of Lodi and Detachment from the Woodbridge Rural County Fire Protection District and the Wood- bridge Irrigation District" - with the under- : standing as stated in Resolution No. 81-75 appriving the application of this reorganization that the utility extension costs, including streets, are to be borne by the developers. Upon successful completion of City proceedings, the City must request that LAFCo execute and file a Certificate of Completion and State of Boundary Change. Such request must be accompanied by six certified copies of your resolution ordering.the boundary change and a check payable to the State Board of Equalization covering its filing fee. Very truly yours, E D Executive Officer GFS:rq cc: Board of Supervisors c/o Clerk of the Board County Surveyor County Assessor Woodbridge Rural County Fire Protection District Woodbridge Irrigation District James Schroeder, City of Lodi JUL 2 3 �@1 =t: RESOLUTION NO. 520 BEFORE THE LOCAL AGENCY FORMATION COMMISSION OF SAN JOAQUIN COUNTY RESOLUTION APPROVING THE LDS CHURCH REORGANIZATION (LAFC 21-81), INCLUDING ANNEXATION TO THE CITY OF LODI AND DETACHMENT FROM WOODBRIDGE RURAL COUNTY FIRE PROTECTION DISTRICT AND WOODBRIDGE IRRIGATION DISTRICT WHEREAS, the above entitled proposal was initiated by Resolution of the City of Lodi, and on June 23, 1981, the Executive Officer certified the application filed for processing in accordance with the District Reorganization Act; and, WHEREAS, the Commission held a public hearing on the proposed reorganization on July 17, 1981, in the Board of Supervisors Chambers, County Courthouse, pursuant to notice of hearing which was published, posted and mailed in accordance with State law; and, WHEREAS, at said hearing the Commission heard and received evidence, both oral and documentary, submitted in favor of and in opposition to the proposed reorganization and all persons present were given an opportunity to hear and be heard in respect to any matter relating to said proposal; NOW, THEREFORE, the Local Agency Formation Commission of San Joaquin County DOES HEREBY RESOLVE, DETERMINE, AND ORDER as follows: Section 1. The Negative Declaration adopted by the City of Lodi as lead agency has been reviewed and considered. Section 2. The above entitled reorganization is approved subject to the terms and conditions contained herein. Section 3. The boundaries are hereby approved as amended, said boundaries being set forth in Exhibit "A". Section 4. The affected territory is uninhabited. Section 5. The City of Lodi is designated as the conducting agency and is authorized to complete proceedings for uninhabited reorganization without public notice and hearing by the City Council pursuant to Section 56439.5 of the District Reorganizetion Act. Section 6. The Executive Officer is hereby authorized and directed to mail and file certified copies of this Resolution as required by Section 56272 of the Government Code. (b) Thereafter appropriate proceedings were conducted by said Local Agency wFormation Commission and the said Commission on the 17th day of July, 1981, adopted Resolution No. 520 approving the proposed reorganization without public notice and hearing with certain amendments. (c) Resolution No. 520 of the Local Agency Formation Commis--lion•approving the proposed reorganization also authorizing the City of Lodi to take pro- ceedings for reorganization as designated conducting Agency, pursuant to Part 5, Division I, Title 6 of the Government Code, commencing with Section 56290, et seq. SECTION II: RESOLVED BY THE CITY COUNCIL OF THE CITY OF LODI: (a) That each of the changes in the organization contained in the proposal for organization is ORDERED without an election pursuant to Government Code Section 56439 (c). The changes of organization consist of: 81-111 Page No. 1 (1) Annexation of the LDS Church Addition as shown on Exhibit "A" attached. (2) Detachment of the LDS Church Addition as shown on Exhibit "A" attached, from the Woodbridge Rural County Fire Protection District and the Woodbridge Irrigation District.
