DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF
LODI TO VACATE THAT PORTION OF TIMBERLAKE CIRCLE, EAST OF
LAKESHORE DRIVE, LODI, CALIFORNIA.
BE IT RESOLVED by the City Council of the City ob Lodi
as follows:
Section 1. It is the intention of the City Council of the City
of Lo-dT,—acting in accordance with the provisions of Part 3 of
Division.9 of the Streets and Highways Code of the State of
California, to vacate, close, and abandon the following portions
of a street situated in the City of Lodi, County of San Joaquin,
State of California, more particularly depicted as follows:

• Reserving, however, and excepting from the vacation
of said street, the permanent easement and the right therein
to construct, maintain, repair and operate lines for public
utilities, both publicly and privately owned, in, over, and
across said alleys.
Reference is hereby made to a map or plan on file in
the office of the City Clerk for particulars as to the proposed
vacation.
Section 2. NOTICE IS HEREBY GIVEN that this City Council does
hereby � WEDNESDAY, August 4, 1982, at the hour of 8:00 p.m.
in the City Council Chambers, City Hall, Lodi, California,
as the time and place when and where all persons interested in or
objecting to the vacation herein proposed may appear before this
City Council and be heard.
Section 3. Upon adopting of this resolution, the Superintendent
of Streeta shall post, or cause to be posted, notice of such
passage and of the time, forut and manner as prescribed by law
for the vacation of streets.
Section 4. This resolution shall be published one time in the
Low ews Sentinel", a daily newspaper of general circulation
printed and published in the City of Lodi, said publication to
be completed at least fifteen days prior to said hearing.

ORDER VACATING THAT PORTION OF TI14BERLAKE CIRCLE,

WHEREAS, this City Council, acting in accordance
with provisions of Part III of Division 9 of the Streets and
Highways Code of this state, did on the seventh day of July,
1982 pass and adopt a Resolution of Intention No. 82-66
therein declaring the intention of said City Council to
vacate that portion of Timberlake Circle, East of Lakeshore
Drive, Lodi, California, County of San Joaquin, State of
California, and more particularly described as follows, to

Being a portion of Timberlake Circle situate in
Section 14,.Township 3 North, Range 6 East,
Mount Diablo Base and Meridian, City of Lodi, San
Joaquin County, California, shown on that certain
Map of Tract No. 1710, Subdivisions of San Joaquin
County, Lakeshore Village, Unit No. 1, filed for
record in Book of Maps and Plats, Volume
25, Page III, San Joaquin County Records, said
portion of Timberlake Circle being more particularly
- - - described as follows:
Beginning at a point on the boundary of said
Timberlake Circle, said point being the south-
easterly corner of Lot 5 shown on said maps thence
along the boundary of said Timberlake Circle, (1)
South 22. 00' East 80.00 feet, (2) South 68. 00'
West 77.75 feet, and (3) along the arc of a curve
to the left having a radius of 20 feet, a central
angle of 58. 55' 25", an arc length of 20.57 feet,
and a chord bearing South .38* 32' 17" West 19.67
feet: thence leaving said boundary along a line
33.00 feet easterly of measured at right angles
to the centerline of Lakeshore Drive as shown on
said map, (1) North 340 28' West 20.56 feet, and
(2) along the arc of a curve to the right having a
radius of 219.50 feet, a central angle of 20. 379
450, an arc length of 79.03 feet, and a chord
bearing North 24" 09' 07" West 78.60 feet to a
point on the northerly boundary of said Timberlake
Circle; thence along said northerly boundary,
(1) from a tangent bearing South 55! 32' 23"
East along the arc of a curve to the left having
a radius of 20 feet, a central angle of 560 271"

bearing South 83" 46' 11" East 18.92 feet, and (2)
North 680 00' East 85.60 feet to the point of

WHEREAS, notice of said intended vacation was
regularly given by publication and by posting, both in time,
form and manner as required by law as is evidenced by
affidavits on file and of record in the office of the City
Clerk of the City of i; and
WHEREAS, in accordance with the provisions stated in
Resolution No. 82-66 and also contained in the posted
notices of the adoption of said resolution, notice was given
that a public hearing would be held before the City Council
in the City Council Chambers, City Rall, Lodi, California,
beginning at 8:OO p.m. on Wednesday, August 4, 1982 where
and when any person interested in or objecting to said
vacation could appear and be heard in relation thereto: and,
WHEREAS, at that time and place a public hearing was
held and conducted and testimony received for and against
the vacation contemplated, and from the evidence submitted
the City Council of the City of. Lodi did determine that said
portion of said street is unnecessary for present or future
public use and did so find and declare;
that the Planning Commission did find that the
subject vacation was consistent with the general plan of the
_ City of Lodi;
MOW, THEREFORE, BE IT RESOLVED that pursuant to the
findings and under the authority of Section 8323 of the
Streets and Highways Code of the State of California, that
there is hereby abandoned that portion of Timberlake Circle,
East of Lakeshore Drive, Lodi, California, and more
particularly described as follows:
Being a portion of Timberlake Circle situate in
Section 14, Township 3 North, Range 6 East,
Mount Diablo Base and Meridian, City of Lodi,
San Joaquin County, California, shown on that
certain Map of Tract No. 1710, Subdivisions of
San Joaquin County, Lakeshore Village, Unit No. 1,.
filed for record in Book of Maps and Plats, Volume
25, Page 111, San Joaquin County Records, said
portion of Timberlake Circle being more particularly
described as follows:
Beginning at -a point on the boundary of said
Timberlake Circle, said point being the south-
easterly corner of Lot 5 shown on said map; thence
along the boundary of said Timberlake Circle,
(1) South 22° 00' East 80.00 feet, (2) South 68°
00' West 77.75 feet, and (3) along the arc of a
curve to the left having a radius of 20 feet, a

radius of 219.50 feet, a central angle of 20° 37'
45", an arc length of 79.03 feet, and a chord
bearing North 24. 09' 07" West 78.60 feet to a point
on the northerly boundary of said Timberlake Circle;
thence along said northerly boundary, (1) from a
tangent bearing South Sb" 32' 23" East along the
arc of a curve to the left having a radius of 20
feet, a central angle of 56' 27' 37", an arc length
of 19.71 feet, and a chord bearing South 83" 46' 11"
East 18.92 feet, and (2) North 660 00' East 85.60
feet to the point of beginning, containing 0.191
acres, more or less.
RESERVING, however, and excepting from the vacation
of said street, the permanent easement and the right therein
to construct, maintain, repair and operate lines for public
utilities, both publicly and privately owned, in, over, and
across said street.
Reference is hereby made to a map or plan on file in
the office of the City Clerk of the City of Lodi for the
particulars as to the proposed vacation.

that portion of Timberlake Circle, East of
Lakeshore Drive, Lodi, California with the
conditions heretofore stated, was passed and
adopted by the Lodi City Council in a regular
meeting held August 4, 1982 by the following vote:
Ayes: Council Members - Olson, Snider, Pinkerton
and Reid
Noes: Council Members - None
Absent -Council Members - Murphy
