July 24, 1985 Pursuant to State of California Government Code Sect'_ a 35012, upon approval of LAFCO, a city may annex non-contiguous territory not exceeding 300 acres in area, which is located in the county in which the City is located exclusive of territory which is used by a city for reclamation, disposal, and storage of treated waste. On April 17, 1985, with the passage of Resolution No. 85-50 the City Council of the City of Lodi initiated the reorganization including non-contiguous annexation to the City of Lodi of G-Basin/Park. S f The subject Resolution and pertinent documentation concerning the matter was filed with the Executive Officer of LAFCO for processing a non-contiguous annexation in accordance with the District Reorganization Act. f On June 21, 1985 LAFCO held a public hearing on the proposed reorganization to hear and receive evidence, both oral and documentary regarding the matter. Following the hearing the Local Agency Formation Commission of San Joaquin County adopted Resolution No. 654 approving the G-Basin/Park Reorganization (I>AFC 16-85) including non-contiguous annexation to the City of Lodi, and detachment from the Woodbridge Fire Protection District and the Woodbridge Irrigation District. Further LAFCO designated the City of Lodi as the Conducting Authority and authorized the City Council to complete the proceedings for uninhabited reorganization without notice and hearir_g in accordance with Section 56439.5 of the Government Code. A copy of LAFCO Resolution 654 including a legal description and diagram of the subject area is attached. RECOMMENDED ACTION: Adopt Resolution making determinations and ordering the G-Basin/Park Reorganization (LAFC 16-86) including non-contiguous annexation to the City of Lodi, and detachment from the Woodbridge Fire Protection District and the Woodbridge Irrigation District. RESOLUTION NO. 85-90 A'RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI A_T"TER HEARING ORDERING A14NEXATION - G - BASIN/PARK IN THE MATTER OF ) RESOLUTION MAKING ANNEXATION TO THE ) DETERMINATIONS AND ORDERING CITY OF LODI ) ANNEXATION WITHOUT ELECTION . . Section 1 - RESOLVED by the City Council of the City of Lodi that it determines: a) Preliminary proceedings for the annexation of certain described non-contiguous, City owned territory to the City of Lodi were initiated by the filing of Resolution No. 85-50 with the Local Agency Formation Commission in the County of San Joaquin pursuant to the requirements of the Municipal Organization Act. b) Thereafter, appropriate proceedings were conducted by the said Local Agency Formation Commission and the said Commission on the 21st day of June, 1985, adopted a resolution approving the proposed Annexation subject to certain conditions. c) Resolution No. 654 of the Local Agency Formation ' Commission approving the proposed annexation also authorized the City of Lodi to take proceedings for annexation as the designated conducting agency in accordance with Section 3501.2 of the Government Code. Section 2 RESOLVED by the City Council of the City of Lodi: a) That the proposal for annexation is ORDERED without an election, puruant to Government Code Section Organizationn 35012. The change of consists of: 1. Reimche City Clerk BIT A Revised: May 31, 1985 G-BASIN/PARK REORGANIZATION ANNEXATION TO THE CITY OF LODI A portion of the north half of the southeast quarter of Section 15, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, more par- ticularly described as follows: Commencing at the northwest corner of said southeast quarter, said corner being on the centerline of 80 foot wide Lower Sacramento Road; thence South 89°12'05" East along the north line of said southeast quarter 40.00 feet to the northwest corner of that certain 29.11 acre parcel of land shown on map of sur- vey filed in Book of Surveys, Volume 28, page 105, San Joaquin. County Records, said northwest corner being on the east line of said Lower Sacramento Road and being the TRUE POINT OF BEGIVMING; thence along the boundary of said 29.11 acre parcel the following four (4) courses; (1) South 89°12'05" East along said north line of southeast quarter 959.48 feet, (2) South 0°07'35" East 1320.13 feet, (3) North 89°09'55" West 962.46 feet to said east line of Lower Sacramento Road, and (4) North 0°00'10" East along said east line 1319.48 feet to the True Point of Beginning.
