SUBJECT: City of Lodi Design Standards and Annexation Conditions
RECOMMENDED ACTION: That the City Council deny the appeals and require Dauber &
Kikuchi to provide a private ponding basin per existing design criteria
requirements.
BACKGROUND INFORMATION. The present professional offices owned by Dauber &
Kikuchi on Lower Sacramento Road are located within a remodeled single family
residential house. The City allowed this change of use and remodel without the
installation of full offsite improvements and storm drainage facilities. The
City, however, made it clear at the time of the initial remodel that any future
expansion of the present facilities would require installation of all of the
standard offsite improvements (i.e., curb, gutter, sidewalk, street
improvements, street lights, water, sewer and storm drainage facilities).
Tauber & Kikuchi are now proposing an expansion of their professional center
ihich will more than triple the present square footage. Exhibit A shows the
existing facility and proposed additions. With this expansion, they will be
installing offsite improvements along their Lower Sacramento Road and Tokay
S`reet frontages.
11ascd on their proposed addition as it is presently drawn, there is inadequate
room for the required private ponding basin necessary to handle the street and
o:,site drainage. Dauber & Kikuchi, under their attached letter dated June 12,
1984, are requesting City Council approval to use a portion of the existing
ponding basin constructed by the Temple Baptist Church. This basin is located
west of Lower Sacramento Road and north of Vine Street and is also shown on
Exhibit A. This use would be limited to a 10 -year time frame with a provision
for renegotiations after the 10 -year period.
The Temple Baptist Church ponding basir, was constructed in conformance with the
City's design criteria for a private ponding basin serving a single parcel.
Since it served only a single parcel, this basin was not required to be tied-
into the City's existing storm drain system (i.e., have a terminal discharge').
Therefore, the ponding basin has no storm water disposal other than evaporation
and percolation.
Dauber & Kikuchi's request is to use a portion of Temple Baptist's basin, in its
present condition, to also serve their parcel. The design criteria approved by
the City Council, for a private ponding basin serving multiple parcels, would

require that the basin have a terminal discharge to the City's existing storm
drain system. The criteria would also require that existing storm drainage
basin be operated and maintained by City forces at Developer's expense. There
art other minor items which would also be nonconforming.
Dauber b Kikuchi are appealing the requirements under Sections 3.600, "Private
Ponding Basins, Multiple Parcel", of the Design Standards approved by the City
Council on November 17, 1976. A copy of the Design Standards is attached as
Exhibit B.
The appeal of Dauber b Kikuchi is further complicated by the conditions that
were placed upon the Temple Baptist Church annexation by the City Council in
1976. Based on the proposed ultimate development plan of Temple Baptist Church,
the City Council was concerned at the time of the annexation request that the
Temple Baptist Church comply with the City's design criteria related to private
basin ponds serving single and multiple parcels. A copy of the proposed
Development Plan is attached as Exhibit C. It was clear that the ultimate
development of the Temple Baptist Church property included a senior citizen
retirement housing complex. Since it is typical for that type of development tc
be on a separate parcel from the Church, the Council was concerned that, if the
private pond was to be used for more than the single parcel, terminal storm
drainage would be ,required for the proposed ponding basin.
Attached as Exhibit D is a copy of the Council minutes for their meeting of
April 28, 1976, at which time the Council reviewed the Temple Baptist Church
request for annexation. Also attached as Exhibit E is a copy of City of Lodi
Resolution No. 4219, which conditions the Temple Baptist annexation by requiring
terminal bcorm drainage if the basin was to serve multiple parcels.
Temple Baptist Church, under tneir attached letter of June 14, 1984, is
requesting that the City Council waive the condition for annexation under
Resolution No. 421.9, which relates to providing terminal drainage.
Items for Council to consider;
1. At the end of the 10 -year period, if Temple Baptist Church would no
longer allow Dauber b Kikuchi to use their ponding facility, what happens
to the street drainage on Lower Sacramento Road, Tokay Street and Dauber
8 Kikucti's onsite drainage?
It is felt that, whether they use the T.mple Eiptist pond or not, their
proposed development plan must provide an unused open area so they can
handle their drainage problem in the future. If this area is provided,
there is no reason that it cannot be developed as a private pond now and
when the City's F Drainage Area fully develops, their pond could be
eliminated and additional building coverage could be added at that time.
2. If terminal drainage were provided to the existing Temple Baptist ponding
basin, a storm line would be tied into the Vine Street storm drain and
ponding basin, which presently s.-rves the Sunwest-Cochran area. This
Sunwest-Cochran area is in the City's ultimate G Drainage Area arid its
runoff is presently being pumped into the B-1 Drainage Area, which is

already overchar4ed. No additional runoff should be added to the B-1
Drainage Area finless there is no other alternative.
3. Does the City really want to take over the maintenance and operation of
an additional private drainage pond in r Drainage which willbe serving
only two parcels?
4. Both the Temple Baptist Church and Dauber & Kikuchi developed in a
drainage area which they knew would not be immediately developed. They
were both very aware of the drainage requirements at the time they
purchased and developed their properties.
5. If the Council does allow Dauber b Kikuchi to tie into the Temple Baptist
pond, what happens when:
(1) Temple Baptist develops fully and needs the pond?
(2) Temple Baptist splits their property into multiple parcels?
Staff has to handle the next substandard request?

I would -like to have an item placed on the June 20th City
Council Agenda regarding our Lower Sacrmento Road Office
development located on the northwest vomer of Lower Sacra-
mento Road and Tbkay Street. The item is in regards to
our stnun drainage system for which we propose to have an
agreement with Twnple Baptist Church and would jointly
utilize their existing stoma drainage basin for a proposed
10 -year time spam subject to renegotiation after then.
We feel that this solution to our atom drainage would be
the mast viable due to the impact a atom drainage pond
would hays on our small parcel of property.
As indicated by City staff (Jack Rons)w, Public Works
Director) , I was informed that it would take a City Council
action to approve our concept on the sharing of the Temple
Baptist Qrurch stray drainage basins.

however, due to our circumstances,, we feel that our proposed
solution will still be the best possible solution. Exactly
what we propose is to enter- into an agrement with Twple
'f Baptist Church to handle all the on- and off-site storm drain-

is the new proposed section of Tbkay Street ar',d west side of
Lower Sacramento Road in front of our parcel and our 1.1 acre
parcel which we propose to develop into our personal offices.

Our engineer and the church's engineer concur that the amount
of water we propose to put into the Temple Baptist Church's
basin, the storm basin will more than adequately hold.
We propose this solution to our drainage situation due to the
fact that we are proposing to install Tbkay Street which
presently does not touch our property and would not normally
be our responsibility. In fact, it would be the Church's
responsibility under most normal circumstances and their pond
initially was designed to handle Zbkay Street winter.
Since we propose to develop first, we offered to put in Tbkay
Street and since we are developing first we ended up with that
additional waiter on our 1.1 acre parcel which caused our pro-
posed drainage pond oca our property to became quite large and
very deep; 16 feet deep to be exact. So, in light of this
huge basin, we propose to jointly use the Church's existing
basin. We feel this will be the most viable answer to this
problem.
We feel that the storm drainage basin on the 7WVle Baptist's
praperty is more than adequate to handle our 1.1 acre parcel
and we have already planned for futur>.- ooxections to the City's
future drainage system. Also, the Church's basin is well
maintained and is much like the City's own drainage ponds inr
design.
We would like to request a waiver of the City's design criteria
on private ponds serving multiple parcels and the condition
placed on the Temple Baptist annexation regarding terminal
drainage.

drain at the point of concentration and shall have a minimum of 1 foot of
freeboard between the top of curb and the Hydraulic Grade line.

3.500 PRIVATE PONDING BASINS, SINGLE PARCEL.
If o temporary ponding basin on private property to drain a single. one owner-
ship parcel is approved by the Public W*&s Director it shall be designed based on the
following criteria:
1. A 48-hour, 10-yeor storm, total rainfall of 3.3 inches shall be used if
a reasonable outlet is provided. If no disposal other than evaporation,
percolation or irrigation is provided, a 48-hour, 100 -year storm, total
rainfall of 4.8 inches, shall be used.
2. The maximum water surface of the basin shall be 1 foot below the
elevation of the top of curb at the lowest catch basin Snlet within the

7. The basin shall not be able to be reasonably served by any public storm
drainage system.

3.700 VERTICAL ALIGNMENT
The minimum cover on main line storm drains shall be 2 feet in residential
streets and 21 feet in all other streets.
Catch basin laterals that have less than 18 inches of cover shall be encased in
concrete.
A minimum vertical clearance of 3 inches shall be maintained between a
sanitary sewer, water main, or other underground utility.
At points of convergence of pipes of various sizes, the tops of tilw pipe elevations shall
match unless specifically approved by the public Works Director. This does not apply
to catch basin laterals.

The City Manager reviewed the staff report
which listed the following items as the reason

quest without review of the City Council.
1. The property being requested for annexation
had all City utility services available except
terminal storm drain.

3. Preliminary Indications are that the Temple
Baptist Church property will be divided into two
parcels. one for a church complex and the second

Bethel Open Bible Church, English Oaks
Seventh-Day tdventlst Church and Century
Assembly of God, all of which have senior citizen
hoummng facilities. has determined that the church

are under separate ownership. Preliminary indi-
cations are that the Temple Baptist Church will
follow the same procedure because of financing

A RESOLUTION APPROVING THE ANNEXATION OF CERTAri
UNINHABITED TERRITORY, DESIGNATED "TEMPLE
BAPTIST CHURCH ADDITION" TO THE CITY OF LODI.
WHEREAS, pursuant to the provisions of the Annexation
of Uninhabited Territory Act of 1939, a petition signed by all of
the owners of certain uninhabited territory, hereinafter more
particularly described, was presented to the City of Lodi. which
petition did request annexation of said territory to the City of
Lodi; and,
WHEREAS, said petition was presented to the San
Joaquin County Local Agency Formation Commission for their
approval and the approval of that body was given at its meeting
held June 18, 1976; and,
WHEREAS, the San Joaquin County Local Agency
Formation Commission granted the City of Lodi power to waive
notice and hearing on the proposed annexation pursuant to the pro-
visions of Section 54797. 1 of the Government Code; and,
WHEREAS, said petition was presented to the City
Council of the City of Lodi at a regular meeting held July 7. 1976;
and,
WHEREAS, the City Council of the City of Lodi finds
the foregoing statements to be true and correct; that said territory
is contiguous to the City of Lodi. and that the same is uninhabited
territory in the County of San Joaquin;
NOW, THEREFORE. the City Council of the City of Lodi
does hereby approve the annexation to the City of Lodi of the terri-
tory hereinafter described and does hereby further resolve that
said -territory be and the same is hereby aancxed to the City of
Lodi.
