Council was apprised that a letter had been received
from Jerald Kirsten, Lodi Park West, inclicatinj that
they are desirous of immediately improving the City-
mvned median between Lower Sacramento RoLd and the
frontage road, and proposing that they will arrange for
and pay the cost of installing sprinklers and trees in
the median if the City will construct the major street
curb and gutter and maintain the landscaping they will
install.
Follcwing discussion, with questions being directed to
Staff, Council, on motion of Council Member Reid,
flinchman second, approved the request received from
Lodi Park West for completion of Laver Sacramento
Frontage Road Median, and authorized that the curbing
and drainage be funded with SB 325 funds; and that the
City amend the Agreement with the Developer in order to
have his contractor provide for the construction.

SUBJECT: Request from Lodi Park West for Completion of
Lower Sacramento Frontage Road Median
Attached is a letter from Mr. Jerald Kirsten requesting that the frontage road
median fronting the Lodi Park West development be completed at this time.
Under the attached Resolution No. 3570, the City of Lodi has the responsibility
for construction of the curb and gutter on the Lower Sacramento Road side, the
pave -out from the curb to the existing pavement and the installation of the
median sprinkler system and landscaping.
Mr. Kirsten is proposing that if the City constructs the curbing on the Lower
Sacramento Road side at this time, Lodi Park West Development will design and
install the sprinkler system and landscaping in the median at their cost. As
indicated above, the installation and design of the sprinkler system and land-
scaping is a City responsibility under Resolution No. 3570. Therefore, this
proposal will save the City the cost of the sprinkler system and landscaping
and it appears to be in the City's best interest to install the requested curb-
ing at this time.
On the east side of Lower Sacramento Road, at Oxford, Elm and Tejon Streets,
the City has installed some c:urbi.g and provided some landscaping of the
existing median.

It is recommended that the proposal be approved and that the curbing and drain-

RESOLUTION NO. 3570
LIMITED ACCESS MAJOR ARTERIAL STREET POLICY
WHEREAS, the City Council has adopted specific plans for limited
access major arterial streets both with frontage roads and without frontage
roads, and
WHEREAS, the City Council has previously adopted Resolution
No. 3076 entitled, "City Participation in Specific Plan for Lower Sacramento
Road, " fixing responsibility on said street with frontage roads, and
WHEREAS, the City Council desires to fix responsibility o'
development on all limited access major arterial streets between the City of
Lodi and adjacent developers of property.
NOW, THEREFORE, BE IT RESOLVED that Resolution No. 3076 is
hereby rescinded and the following shall be the responsibility of developers
and the City:
1. Limited Access Major Arterial Streets Without Frontage Road
A. Developers' Responsibility
a. dedicate required right of way
b. relinquish access rights
c, construct major street curb and gutter
d. construct major street sidewalk
e. construct tree wells
f. install irrigation system for tree wells
g, construct fence or wall
B. City Responsibility
a, grade and pave between major street curb and
gutter and existing paving
b. plant street trees on the major street
c. install street lighting on the major street
Z. Limited Access Major Arterial Street With Frontage Road
A. Developers' Responsibility
a. dedicate required right of way
b. relinquish access rights
c. construct frontage road including street lights
B. City Responsibility
a. construct major street curb and gutter
b. grade and pave between major street curb and
gutter and existing paving
c, landscape medians
d. install street lighting on major street
e, participate in construction at access points as
listed in Exhibit "A" attached hereto and made a
part hereof.

Persuant to your meeting with Ron Thomas, please know
that we are very desirous of immediately improving the City
owned median between Lower Sacramento Road and the frontage
road
In that regard, we are proposing that we will arrange
for and pay the cost of installing sprinklers and trees in
the median (2.B.c. of Resolution No. 3570) if the City will
construct the major street curb and gutter (2.B.a. of
Resolution No. 3570) and maintain the landscaping we will
install.
Please let us know of your decision as soon as possible,
so that we may begin the work.

The Lodi City Cotmcil further directed that the City amend the
