BACKGROUND -INFORMATION: During design stages of the commercial area along tt eman Lane. it was determined that it would be necessary to adjust or eliminate certain lot lines within Lakeshore Village, Unit No. i, to handle building size and parking areas in the most efficient manner. As a con- sequence, a parcel map covering some of the commercial area is to be filed In the near future with new easements being dedicated on that map. Prior to fanaling out the map, it is necessary to abandon the easements s!•.,,an on Map i attached. The owners also wish to file a parcel map covering the area east of Sand Creek Drive that fronts the lake, and find the easement along Lot 42 (shown on Map ii attached) creates problems for the "resubdivision." An alternate easement will be dedicated on the new parcel map. The owners of the property have provided funds for the necessary ad- vertising, and PG 6 E. Fairmont RECOMMENDED ACTION: That the City Council adopt a Resolution of Intention to Abandon a portion of the easement shown on the attached map, refer it to the Planning Commission, and set the matter for a Public Hearing on August 19, 1981. BACKGROUND INFORMATION: This easement was acquired from Mr. t Mrs. a ter an r. s rs. Dollinger in 1963 for the extension of all utilities. Since that time, because of the general expansion of the Lodi Nut Company, it has been determined that an extension of a 3" water main through the property is no longer appropriate. The owners of the property have provided funds for the necessary ad- vertising, and PG t E, Pacific Telephone, and Lodi Cable TV have been notified of the proposed abandonment and their approval will be secured prior.to the final action. RESOLUTION NO. 81-93 ` RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI DECLARING ITS INTENTION TO VACATE A PORTION OF EASEMENT AT 1206, 1218 AND 1230 S. LODI, CALIF IIIA RESOLVED by the City Council of the City of Lodi as follows: It is the intention of the City Council of the City of Lodi, acting in accordance with the provisions of Section 50430 et seq of the Government Code of the State of California to vacate and abandon a portion of the easement at 1206, 1218, and 1230 S. Fairmont Avenue. Reference is hereby made to a map or plan on file in the office of the City Clerk of the City of Lodi for the particulars as to the proposed vacation. FURTHER RESOLVED that the City Council does hereby fix Wednesday, August 19, 1981, at the hour of 8:00 p.m. in the City Council Chambers, City Hall, Lodi, California, as the time and place when and where all persons interested in or objecting to the vacation herein proposed may appear before the City Council and be heard. FURTHER RESOLVED the Director of Public Works shall cause to be posted Notices of Easement Vacation conspicuously along the line of the easement hereinabove describer and proposed to be vacated in the manner, form and for the length of time set forth in Section 50441 of the Government Code of the State 01-93 -1- of California. FURTHER RESOLVED that copies of this resolution shall be published for at least two successive prior to August 19, 1981 in the Lodi Life and Times", a ncnvspaper of general circulation printed and published in the City of Lodi, County of San Joaquin. RE MCKE City Clerk 81-93 -2- follows: RESOLUTION NO. 81-92 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODE TO ABANDON PORTION OF EASEMENT AT LOTS 42, 33, 31 AND 30 AT LAKESHORE VILLAGE UNIT NO. 1, LODI, CALIFORNIA RESOLVED by the City Council of the City of Lord as It is the intention of the City Council of the City of Lodi, acting in accordance with the provisions of Section 50430 et seq of the Government Code of the State of California, to vacate and abandon certain public service easements described as follows: Portions of easement located at Lots 42, 33, 31 and 30 at Lakeshore Village Unit No. 1 Reference is hereby made to a map or plan on file in the office of the City Clerk of the City of Lodi for the particulars as to the proposed vacation. FURTHER RESOLVED that the City Council of the City of Lodi does hereby fix Wednesday, August 19, 1981, at the hour of 8:00 p.m. in the City Council Chambers, City Hall, Lodi, California, as the time and place when and where all persons interested in or objecting to the vacation herein proposed may appear before the City Council and be heard. FURTHER RESOLVED that the Director of Public Works shall cause to be posted Notices of Easement Vacations conspicuously along the line of the easements herein described and proposed to be vacated in the manner, form and for the length of time net 81-92 -1- -77 forth in Section 50441 of the Government Code of the State of California. FURTHER RESOLVED that copies of this resolution shall be published for at least two successive weeks prior to August 19, 1981 in the "Lodi Life and Times", a newspaper of general circulation printed and published in the City of Lodi? County of San Joaquin.
