Tete heretofore set forth action of the Council also places an Advisory Measure on the ballot fc- the November 5, 1985 election. State law provides that the City Clerk shall file with the San Joaquin County Board of Supervisors and the San Joaquin County Clerk, at lease 88 days prior to the election_, a certified copy of a resolution requesting consolidation with the Biennial_ School District Election and the Udel Election set for -November 5, 1985. 1'nasrnich as the City of Lodi has, for the last ten years, been able to conduct elections at an average cost of less than 51.00 per registered voter and the fact that the County Registrar of `Voters has quoted a price of $2.00 per voter, if Unified School District and the Delta Ccmmznity College have no contests for f ii.s election, City Clerk Reimche �reccim-e-- Zded that the City include in its Resolution requesting consolidation, a clause whereby the City of Lodi reserves the right to withdraw its request for consolidation should Lodi Unified School District and the Delta Ccrawnity Collect have no contests for this election. Following discussion with questions being directed to the City Clerk, Council, on motion of Council Member Olson, Reid se,:ond, adopted Resolution No. 85-80 -- Resolution of the City Council of the City of Lodi requesting consolidation with the Biennial School Districts Election and the Udel EI.ection -- Novem_I-max 5, 1985 to include the heretofore Listed Advisory Measure. State law requires that the City Clerk file with the San Joaquin County Board of Supervisors and the San Joaquin County Clerk a certified copy of this resolution requesting consolidation at least 88 days prior to the date of the election as specified by State Statute. We have, however, reserved the right to withdraw this request should the Lodi Unified School District and. the Delta Coram pity College District not have contests for the November 5, 1985 election. If the Lodi. Unified School District and the Delta Community College have no contests for the Nove-%nber 5, 1985 election, we would ask as we have in the past, for Council authorization to conduct our own elective. AZE City Clerk RESOLUTION NO. 85-80 RESOLUTION OF THE CITY COUNCIL OFF THE CITY OF ZODI REQUESTING CONSOLIDATION WITH THE BIM IAL SCHOOL DISTRICTS ELWrION AND UDEL ELECTION - N0VEMB�R 5, 1985 BE IT RESOLVED that the City Council of the City of Lodi, pursuant to Section 23301.5 et seq of the Elections Code -of the State of California, does hereby request consolidation with the November 5, 1985 Biennial School District Election and the Udel Election for the purpose of placing masures on the ballot to be voted upon, by the voters of the City of Lodi. The masures requested to be placed on the ballot are attached as Exhibits hereto, identified as Exhibits A, B, C, D, E, and F, and are thereby made a part hereof. BE IT FURTFM RESOLVED that the City Clerk of the City of Lodi is hereby directed to file with the San Joaquin County Board of Supervisors and the San Joaquin County Clerk a certified copy of this resolution requesting consolidation at least 88 days prior to the date of the elections as specified by State Statute. Re' he City Clerk 1 EXHIBIT A KRIS CROMWELL - WINE AND ROSES COUNTRY INN Shall the Land Use Element of the Lodi General Plan be amended to include a 2.18 acre parcel containing the existing Wine and Roses Country Inn, a 17 -unit bed and breakfast inn located at the northwest corner of West Turner Road and Woodhaven Drive? INDEPENDENT ANALYSIS _ Measure A was passed through the initiAive process by the citizens of the City of ',adi on August 25, 1981. Pursuant to said initiative ordinance, any land which was not within the incorporated city limits of the City of Lodi but was in the City's General Pian at the time of the adoption of the ordinance, was no longer in the City's General Plan. Measure A provided further that in order for any lands to be brought back into the City's General plan, there would have to be an affirmative vote of a majority of the City voting in an election. This Parcel was in the City's General Plan prior to the passage of Measure A. The Wine and Roses Country Inn is adjacent to urban development on the south, west and east. The area to its north is in vineyard. If the Measure fails,. the Inn will continue to operate in the County. The subject parcel has been prezoned by the City Council to accommodate the use. The subject property has already received environmental clearance. If the electorate approves the amendment to the General Plan then the proposal will be submitted to the Local Agency For: -.tion Commission and the City Council for approval of the Annexation. Exhibits%7XTD.01B EXHIBIT B FRAME AND GREVEN PARCELS Shall the Land Use Element of the Lodi General Plan be amended to include (i) the Frame property, a developed ,55 acre -parcel located at 14752 North Lower Sacramento Road, and (2) the Greven property, a developed 1.03 acre parcel located at 777 Olive Court? IMPARTIAL ANALYSIS. Measure A (i.e. the Greenbelt Initiative) was passed by the initiative process by the citizens of the City of Lodi on August 25, 1981. Pursuant to said initiative ordinance, any land which wtas not within the incorporated city limits of the City of Lodi but was in the City's General Plan at the time of the adoption of the Ordinance, was no longer in the Land Use Element of the City's General Plan. Measure A further provided that in order for lands to be brought back into the City's General Plan, there would have to be an affirmative vote of a majority of the electorate casting ballots in an election. Both the Frame and Greven properties are presently developed and the parcels have been prezoned by the City Council to R-1, single-family residential. The subject properties have already received environmental clearance. If this ballot measure is approved by the electorate the proposal will be submitted to the Local Agency Formation Commission and City Council for annexation to the City. If the Measure is defeated all City Council and Planning Commission approvals will be null and void. EXHIBITBJTXTD,OIB EXHIBIT C BATCH AND MILLS PARCELS Shall the Land Use Element of the Lodi General Plan be amended to include (1) the Batch property, a 100 acre parcel bounded by Lodi Park West Subdivision on the north; Lower Sacramento Road on the east, and the Woodbridge Irrigation District Canal on the south and west; and (2) ti°:- Mills property, a 20.88 acre parcel bounded by St. Peter's Lutheran Church and Henry A. Glaves, Jr. Park on the north; the Lodi Avenue Baptist Church on the east; Lodi Avenue on the south and Lower Sacramento Road on the west. IMPARTIAL ANALYSIS. The Mills Estate parcel abuts urban development on its north, east and south sides, with Lower Sacramento Road to the west. The subjEc properties have already received environmental clearance. The Batch property has been prezoned for .'' urban uses, containing 325 single-family lots, 246 multiple -family units and a . 14 acrebasin/park site.^The Mills Estate property has been prezoned U -H, Unclassified Holding pending the presentation of a development plan. The Tentative Subdivision Map for the Batch property has been approved by the Planning Commission. If the electorate approves the amendment to the General Plan, then the proposal will be submitted to the [hcal Agency Formation Commission and the City Council for approval of the annexation. In the annexation approval, the City Council will make findings that the utilities are available and that thure is u proper buffer area to protect the abutting ` agricultural land on the south side and the west side of the proposed parcel. IMPARTIAL ANALYSIS. Measure A was passed through the initiative process by the citizens of the City of Lodi on August 25, 1981. Pursuant to said initiative ordinance, any land which was not within the incorporated city limits of the City of Lodi but was in the City's General Plan at the time of the adoption of the ordinance, was no longer in the City's General Plan. Measure A provided further that in order for any lands to be brought back into the City's General Plan, there would have to be an affirmative vote of a majority of the City voting in an election. The Maggio property is adjacent to urban development to its north (i.e. Sam Salas Park), across from agricultural development along Stockton Street and Harney Lane on its east and south and next to the SPRR tracks on its west. The Maggio property has been prezoned for industrial uses and the Tentative Subdivision map for the property has been approved by the Planning Commission. If the electorate approves the amendment to the General Plan, then the proposal will be submitted to the Local Agency 1 f Formation Commission and the City Council for approval of the annexation. In the annexation approval, the City Council will make findings that the utilities are available and that there is a proper buffer area to protect the abutting agricultural land on the south side and the east side of the proposed parcel. If the proposal is denied by the vote of the people, the City Council and Planning Commission approvals of the prezoning and Tentative Subdivision Map will be null and void. EXHIBIT E TAVES PARK Shall the Land Use Element of the Lodi General Plan be amended to include Taves Park, a 23.6 acre project containing commercial, voting in an election. Taves Park was within the City of Lodi's General Plan prior to the passage of Measure A. The Batch property is adjacent to residential and office -institutional development to its east with agricultural uses to the north, south and west. The subject property has already received environmental clearance.
