NO. 1384 INTRODUCED City Attorney Stein reported that at the request of the City, Assemblyman Phil Isenberg introduced legislation last CC-24 year that would permit the removal by a peace officer, of vehicles which are parked in a fire lane on public or private property. Until this legislation was passed, only the property owner could cause the remval of these v6-icles. In order to implement this procedure, it is necessary that Council adopt an enforcing ordinance. Fallowing discussion, Council Member Snider moved introduction of Ordinance No. 1384 - An Ordinance of the Lodi City Council Establishing the Procedure for the Removal by Peace Officers of Private Vehicles from Fire Lanes. The motion was seconded by Mayor Pro 'Dore Olson and carried by a unanimous vote of the Council. -- - .. Until this legislation was passed, only the property owner could cause the removal of these vehicles. In order to implement this procedure, it is necessary that Council adopt the attached ordinance. SECTION 1. Title 15, Buildings and Construction Chapter 15.40 On-site Fire Protection, Section 15.40.100 Access Maintenance, Subsection C Parking Prohibitions, is amended to read as follows: "C. Parking Prohibitions. If in the judgment Of the Fire Chief it is necessary to prohibit vehicular parking along private access ways in order to keep then clear and unobstructed, he may require the Owner, lessee or other person in charge of the premises to paint the curbs red and/or paint the edge of the roadway red to a width of four inches, upon which is clearly marked the wards 'FIRE LANE' in white letters four inches in might having a 1/2" stroke, at intervals of not less than 50 feet. Thereafter, it is unlawful for such owner, lessee or other person in charge to fail to install and maintain in good condition the form of notice so prescribed. When such areas are marked and signed as provided in this subsection, no person shall park or leave standing a vehicle adjacent to any such curb marking and/or contrary to such sign and shall be subject to being towed or removal at the direction of a peace officer. "All required signs shall be 17 inches vertically by 22 inches horizontally. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 3.
