July i, 1987 SUBJECT: APPROVE AGREEMENT BETWEEN SAN JOAQUIN COUNTY AND CITY OF LODI FOR CHARGES BY THE COUNTY FOR COLLECTION OF SPECIAL ASSESSMENTS RECOMMENDED ACTION: That the City Council adopt Resolution Number 87-78, approve the agreement with San Joaquin County and authorize the City Manager and City Clerk to execute the agreement. BACKGROUND INFORMATION: Government Code Section 51800 allows counties that collect property taxes for cities to charge cities a fee for collection of special assessments. Presently the City of Lodi has two special assessment districts: Turner/Cluff Assessment District and the Unites; Downtown Assessment District Beautification Project. The cost formula developed by the County Auditor Controller is based upon 1% of the total assessment or $3.00 per parcel, whichever is less. Based upon the 1986-87 assessment, the 1% fee would be $2,839.57, and the $3.00 per parcel fee would be $405.00. Rober N. BE IT FURTHER RESOLVED that the City Souncil of the City of Lodi does hereby authorize the City Manager and City Clerk to execute the subject agreement on behalf of the City. Peterson, City Manager FROM: Robert H. fiolm, Finance Director DATE: June 15, 1987 SUBJECT: County Collection Fee --Special Assessments Attached is a letter from San Joaquin Auditor Controller Paul Heurlin and an agreement from the County Board of Supervisors regarding a new fes to be collected for all special assessments against property for the City of Lodi. I have researched the Government Code sections that apply and find chem to be correct. The smaller fee, based upon the number of parcels, is also correct and applies to both the United Downtown Assessment District and the Turner/Cluff Assessment District. The collection fee is the amount fixed by agreement between the County and the City. We have developed a formula which we believe will be fair and equitable both to the County and each of the Cities. :t is based on 1% of the total assessment amount or $3.00 per assessment per parcel whichever is less.
