USE PERMIT FROM THE
PLANNING COMMISSION
Ordinance No. 1356 - An Ordinance amending
R -C -P, Residential-Ccanriercial-Professional
District to permit the rental and sale of special
respiratory and convalescent equipment after
acquiring a Use Permit frau the Planning
Commission, having been introduced at a regular
meeting of the Lodi City Council held June 5,
1985 and which adoption was continued frau the
meeting of May 29, 1985, was brought up for
passage on motion of Mayor Pro Tempore Reid,
Olson second.
Council Member Snider asked to abstain frau
voting on the matter because of a possible
conflict of. interest.
The motion for adoption carried by the following
vote:
AYES: Council Members - Olson, Reid, and
Hinchman (Mayor)
NOES: Council Members - None
ABSENT: Council Members - Pinkerton
ABSTAIN: Council Members - Snider

SUBJECT: ADOPTION OF ORDINANCE NO. 1356 - AMENDING USES IN THE R -C -P
DISTRICT SUBJECT TO SECURING A USE PERMIT AND THEREBY
ALLOWING THE RENTAL AND SALE OF SPECIAL RESPIRATORY AND
CONVALESCENT EQUIPMENT
Ordinance No. 1356 entitled "An Ordinance Amending the Lodi
Municipal Code Section 17.27.030 entitled 'Permitted Uses - Use
Permit' by amending uses permitted in the R -C -P District, subject
to securing a Use Permit, thereby allowing the rental and sale of
special respiratory and convalescent equipment" was introduced at
an adjourned regular meeting of the Lodi City Council held May 29,
1985. The adoption of this ordinance was continued from the
Regular meeting of June 5, 1985, inasmuch as pursuant to State
statute there were not a sufficient number of Council Members
present who could vote on the matter.
The draft ordinance, which is attached, has been approved as to
form by. the City Attorney.
RECCMVIENDED ACTION; Following reading by title, it would be.
appropriate -Tor 'tTFe Lodi City Council to adopt Ordinance No. 1356.

ORDINANCE AMENDING LODI MUNICIPAL CODE SECTION 17.27.030
ENTITLED "PERMITTED USES - USE PERMIT" BY AMENDING USES
PERMITTED IN THE R -C -P DISTRICT SUBJECT TO SECURING A
USE PEW.1IT THEREBY ALLOWING THE RENTAL AND SALE
OF SPECIAL RESPIRATORY AND CONVALESCENT EQUIPMENT
Be It Ordained by the Lodi City Council
Section 1. Section 17.27.030 - Permitted Uses - Use permit is
hereby amended to read as follows:
The following uses are permitted in the R -C -P district
subject to securing a use permit:
A. All uses permitted in the R-3 district, as provided in
Section 17.18.030, except when included as a permitted
use in Section 17.27.020;
B. Hospital;
to C. Lodge or private club;
D. Funeral homes and mortuaries;
E. Dispensing pharmacy or coffee shop when completely
enclosed within a pi.:-)fessional office complex or
hospital and when serving as an accessory use.
F. The business of the rental and sale of special
respiratory and convalescent
equipment.
Section 2. - All ordinances and parts of ordinances in conflict
herewith are repealed insofar as such conflict may exist.
Section 3. - This ordinance shall be published one time in the
"Lodi" dews Sentinel", a daily newspaper of general
circulation printed and published in the City of Lodi and shall
be in force and take effect thirty days from and after its
passage and approval.
