THE CITY MANAGER'S OFFICE SUBJECT: PUBLIC HEARING TO RECEIVE PUBLIC INPUT REGARDING MOTORIZED/POWER BOATING ON LODI LAKE PREPARED BY: City Manager RECOMMENDED ACTION: That the City Council conduct a public hearing to receive public input regarding motorized/power boating on Lodi Lake and take action as deemed appropriate. BACKGROUND -I_N-FORMATION:____-___-At_ts regular_meeting of June 3, 1987, the City ___ __ Council set this meeting as the date, time an pace for the public hearing regarding motorized/power boating at Lodi Lake. Attached is a copy of the Council Communication with back-up materials prepared by the Parks and Recreation Director and distributed to the City Council in the agenda packet for the June 3 meetirg. Per the City Council's direction, representatives of the various homeoa:ner's associations along the Mokelumne River have been advised of this hearing. Two display advertisements calling attention to the hearing will also appear in the Lodi hews -Sentinel. Petitions signed by a number of citizens in opposition to power: boat prohibition on the lake have been received and will be presented by the City Clerk. Respectfully submitted, 0161 � Thomas A. THE CITY MANAGER'S OFFICE June 3, 1987 S' I4jEL+ City Council set a .public hearing to consider recommeticiation of the narks and Recreation Commission regarding motorized boating on Lodi Lake. PREPARED BY: Parks and Recreation Director RECOMMENDED ACTION: That the City Council set a public hearing for June 1-7, 1987, to receive public input regarding motorized/power boating on Lodi Lake BACKGROUND INFORMATION: The Parks and Recreation Commission took under • advisement the recommendations of the Lodi Lake Park :.aster Plan of 1975 (Exhibit A attached) and the current plan under development by Mr. Richard Bigler (Exhibit B attached) wherein both have recommended the elimination of motorized/power boating on Lodi Laker due to the size of the Lake, its liability during use, and its disruptive uses by motorized/power boats which restrict the use by any others wishing to put sailboats, canoes, or any other non -motorized crafts in the water. Additionally, it has been stated that use by motorized c -r o f _t -s_ -ha Y e_t o-r-_n_--drum---a n-d--e--rade-d-- t-lie--b-a-n k-s--and--r- e n -u -i reel—e h t -e n s i.-ve--re pal r s to same, i.e. cement retaining walls have been constructed to prevent further bank problems. The Parks and Recreation Commission conducted two meetings to hear public concern over eliminating motorized power boating on the Lake, which were held on April 7 and May 5 during the course of the regular Commission meetings. Approximately pproxzmately 20 people were present at these two meetings, which had bee.i set to explore Lnd discuss the basic problems and receive input. Various legal questions were asked at these meetings, at which time Director Williamson was ask -d to secure answers to lake/.river concerns and report back at the May meeting. These questions were directed to City Attorney, Ron Stein, who was asked to attend the May meeting and answer an y g y questions that might be raised as well as to bring the Commission up-to-date regarding access and liability respon- sibilities. After much discussion and participation by the audience, the Commission moved that (1) all motorized power boating be eliminated from Lodi Lake, with the exception of sanctioned City of Lodi sponsored activities, rental boat recovery needs, and general park patrol functions; (2) that the launch or ramp be kept open for public access, for launching motorized power crafts, which will in turn be required to go directly into the river and exit likewise to recover craft; and (3) that there be a restriction on the types of motorized crafts that can be launched, those types being V -drives, inboards and jet boats, and all others would be approved to launch and have access to the river. It should be noted that this recommendation was put together with assistance from citizens present and met with approval at its conclusion for presentation to the Council. I might additionally bring to your attention the "Lodi Municipal Code" book of the general ordinance of the City and to Section 12: "Streets, sidewalks and public places" Page 203, 12.12.180 "Bo ng - Where Permitted" for review of the current ordinance covering bba in public places (Exhibit C attached.) The recommendation is to discontinue power boating. h r No discussion exists other than to stop power boating. s Power boating, as it now exists should be discontinued. Not only the present use li`e threatening, it is a miracle, no Iife or - limb has been lost to date. The result of such a accident would result in a massive suit against the City. Other negative factors of power bo wing are: a. Noise pollution of a residential area. b. Human powered boats, sail boats, surf craft and power boats do not mix. (photo record) c. Bank damage to the river. The main portion of the lake and some areas of the river are protected"by a low wall., Many of the upper river areas have no protection and the power boating creates wakes that are breaking down the banks. Trees along the bank are being undermined and *are fallino into the river. (photo record) The banks that fall into the river cause silting and fil of the river and foredam. In the discussion of the infra discussion of the marsh, it is pointed out that further silting of the river and lake areas would cause the mars) to expand to a condition that would be unmanageable. Th whole of the existing waterways could be choked with ree (photo record) € EXHIBIT B r;_ The existing nattir31 amenities lend themselves to a nature interpretation _,rogram which can be used in conjunction with the school system and can be offered to the general public on weekends and holidays during the high -use seasons of the year. F. The 13 -acre area to the west of the existing park, because of its rela- tive protection from flooding and its large, flat land area offers the opportunity for development of high intensity park uses such as group picnicking, informal games and sport fields and a large parking lot. G. Because of the extreme cost and physical difficulty in developing a total circulation system, several circulation alternatives should be considered including: perimeter road system, one-way perimeter road system, and elimination of automobiles and use of a tram system. H. The existing facilities at Lodi Lake Pari: should be studied and their functions combined into fewer new structures appropriately located to reduce congestion at the main entrance area, and provide improved service to the park users. I. Because of its relatively small size and configuration, power boating on jj Lodi Lake itself should be eliminated. The project would initially involve development of Phase I and portions of Phase II as outlined in the Master Plan. (pg.?_ i Implementation of Phase I t calls for development of the 58 acres northeast of the present park into a `{ limited use Nature Study Area. This would be comprised of a paved bicycle, emergency/service access, and hiking trail around the perimeter of the 58 acres. There will be two paved access trails which cut across the nature area and tie in with the trail around the perimeter. These trails are necessary for emergency equipment access and fire protection. The fire hazard in this area has been a serious problem for years. In addition to the paved trail, therewillbe an unpaved nature trailthroughthe area to allow for nature study tours by individuals and organized groups. A water system will be installed in the area which will provide for fire protection and irrigation of the levee adjacent to the homes located along Fdgewood Drive. Pig's Lake, the drainage ditch, and rainfall will provide much of the water necessary to plant and wildlife inhabiting the area. f Chemical toilets will be installed to service the nature study area, so that extension of a sewer line will not be necessary. This area would be developed with minimal environmental impact to preserve its natural aspects, while allowing limited public recreation use. JThe City plans to implement portions of Phase II in conjunction with develop - went of the nature study area to help alleviate a deficiency in high intensity recreation use areas. This would entail removal of the grape vineyard from the 13 -acre parcel west of the lake. The land would be graded and prepared for lawn seeding and some tree plantings. No person in a park shall launch, dock or operate any boat of any kind on any waters between the closing hour of the park at night and opening hour the fol- lowing morning, nor shall any person be on. or remain on or in any boat during the closed hours of the park. ( Prior code § 15A-32) 12.12.210 Picnic areas—Use. No person in a park shall picnic or lunch in a place other than those desig- nated for that purpose. Attendants shall have the authority to regulate the activities in such areas when necessary to prevent congestion and to secure the maximum use for the comfort and con- venience of all. Visitors shall comply with any directions given to achieve this end. Field asked that Steve Boomer present the report as he was the individual assigned to the job of compiling the information contained in the tro documents submitted to the Commission. Boomer indicated that six communities were surveyed and had been asked specifically to address the costs of player fees, sponsor fees, and if, in fact, any department assessed teams and/or players a small charge to be placed in an account that would be used to fund capital outlay projects for their softball facilities Eoomer indicated upon receiving the informnation from the cormmuni- ties and compiling same, he then had the Lodi Sports Advisory Board review the information, and the second document that he has submitted to the Commission contains their recommendations to the Commission and staff, one being that the Adult Advisory Board would survey the adult softball teams at the conclusion of this sinner's season to investigate the following items: a. How do most teams feel about the City considering increasing the basic team fees and/or player fees? b. Do the teams feel the need for more than ten games in a summer season? c. Do the teams feel that the City, by raising umpires' salaries_ could in fact provide the league with a better caliber of officiating? d. Mould the Lodi teams endorse a proposal of being assessed an additional charge, which monies would then be placed in a reserve account for future capital projects? At this time Williamson summarized for the Commission the basic reason for the report as these were some concerns that were voiced at an earlier Commission meeting by Bob Johnson. At this time Bob Johnson was asked to approach the Commission. Johnson explained he felt the report still does not address the basic concern that he expressed in October to the Commission, whi which was, why in fact do the adults in the various sports pro- grams not do something toward enhancing facilities or providing additional equipment to the programs such as what the B.O.B.S. organization does for the betterment of youth sports programs. Johnson indicated that currently the City is replacing the rest- room facilities at Armory Park and had recently replaced the fencing around Armory Park. fie understands that these items are being underwritten totally by the Department's capital outlay program and City funds when, in fact, some of these costs should have or could have been borne by the adult participants in soft- ball themselves. Commissioner Swanson asked that Staff prepare for the May meeting a breakdown of adult softball with regard to how the sponsor fees and player fees relate to the actual cost of offering the activity on a per -game basis. Williamson indicated to the Commission that the Department also submits an $8,000:00 Lodi Arts Commission budget, which in fact is prepared by the'Arts Commission totally and we are just a ',.means of housing said budget'. Kyle Roper, Park Ranger, indicated that he sate many problems in being able to enforce this rule. ouperintendent Field stated that in order to make such a ruling meaningful, the Commission would have to deter- mine what the reprimands would be for violators, how in fact would the rule be enforced, should there be a refund given on the rental, etc. milliamson directed Superintendent Essin to canvas several near -by lake operations that are known to have city -operated boat rentals to determine what their existing policies are and if in fact they would reco=. end further rules and regulations. Chairzan Devine asked if there were any other items fromthefloor. Russ Munson asked Director Williamson what the status of the replace - meat and/or remodeling of the press box in,the Grape Bowl was. Williamson explained that he had met witn School District football coaches and athletic directors and several discussions had been held with regard to the desires of the coaches. Upon the costing out of what was desired and the City's contention that 90% of the use is made by the School District, it is felt that the School District should fund the major part of the project. The Committee had come back with a revised proposal of a basic one-story design that would cost in the neighborhood of $40,000. viilliamson alsostatedthat the School District has come up with no means of funding the project, so everything ts on hold. The adult Softball Sports Fee Final Report -- Superintendent Field asked the commission to comment on the t:-ro reports submitted by staff. She asked the Commission to note that one. - report had been prepared to include mowing costs of the adult softball facilities whereas the. identical report submitted did not include the -mowing- costs as staff felt these areas are park sites and would have to be mowed whether they were developed as softball diamonds or some other recreation use. Dennis Swanson asked Bob Johnson how he felt about the report`. Bob Johnson indicated the report addressed the questions that he had and the findings that the adult, softball program r -as costing the City some w100 per team was not surprising to him. He reiterated again the concerns that he continues to have with 5: regard to the adult softball program as far as: 1. He feels the fees should be covering the costs of operating _ said program.. _ 2. Because.of. the Department's 5 -pear capital program which lists some $300,000 to $500,000 being expended on improvements to said softball facilities, the City should in no way be underwriting the costs of adult softball. After a discussion, on a motion by Dean Devine, seconded by Dennis Swanson, the Commission directed staff to submit the reports to the Adult Sports Board and ask the Board to recommend to the Commission what they-f"eel would be ways and/or means of makin; the adult softball program self-supporting. B. Lodi Lake power boats and use of ramp for launching of power boats -- Director Williamson addressed specific questions"to City Attorney Ron Stein so that the Commission and membersVf , the audience would be clear on the City's legal, liability with re-ard to the boating question in Lodi Lake and the adjacent F: river. ' 1. The City has no legal responsibility to provide a'boat launch ramp to the river and/or Lodi Lake. ` 2. The final action item was the Department's rental craft/life jacket policy on Lodi Lake -- After a discussion and confirmation by City Attorney Ron Stein, the Department's policy of making it mandatory for youth under the age of 18 to wear a life jacket at all times when h renting any City craft and to issue a life jacket to all adults who are -using said craft will continue. Pon ,illiamson opened up the hearing with a brief history of the Department and the Commission's plans and proposals for the complete development of Lodi Lake Park. Williamson then turned over the hearing to the landscape architect, Rir,hard Bigler, who again presented a brief history of the Mokelumne River and Lodi Lake Park. Basic points covered by Bigler were: 1. The Mokelumne River has a tremendous amount of sediment (sand) 2. The river banks are rapidly eroding. Some steps need to be taken to minimize this situation. 3. Large oak trees growing alongside the river are having their root systems washed away due to the banks eroding. :ie feels a large amount of this erosion is being caused by the boats with waterskiiers running up and down the river. 4. Lodi Lake itself is filling with sand and sediment. One of the ways to minimize this condition is to close off the lake with an inlet and outlet pipe from there to the river, which would also control the lake and water level. Bigler then asked the audience if he could address the 58 -acre Wilderness Area as he felt this was the one segment to the total Lake blaster Plan that would have the greatest controversy. Bigler emphasized that this 58 -acres was one of the most pristine natural areas in northern California. One of the concerns that needsto be addressed immediately with regard to this area is that the area has lost most of its natural bird life. There are very few nests and very few birds living in the area. Bigler feels one of the main reasons is the numbers of cats that live and hunt in the area, the '. large dogs that are running through the area, and the intrusion of humans. One of the best ways to maintain this area in its natural state is to control the access to the area. This can be done by fencing along the levee and placing a nature study building at the entrance to the property. The 58 -acre Wilderness Area would be joined to - I - ... .,��-.. �: I' Yi_:.i :_. ._ _._-__,.__ _• -- Jit,._ !.a, it _• \lt. ,. t. �`-;' ...odi Lake Proper via a jagging/bicycle trail which would continue around the circumference of Lodi Lake. Addressing Lodi Lake Proper, Bigler indicated no major changes -would take place other than modifying the existing parking areas to allow more parking in existing space and to redesign the entrance to Lodi Lake. Bigler recommended.to the audience that the organized trailer group area, now located on the north side of Lodi Lake, be moved to the northwest portion of the undeveloped 13 ares and that in addi- tion to moving the trailer area to the 13 acres, a large group picnic area or areas be developed adjacent to the recommended trailer site and to have a large turf area to be user for iniorrnal ballgames, volleyball, and other group type activities. The following is a synopsis of concerns as voiced by members of the audience. Donna Phillips -- Lodi Lake Park should not be designed and master - planned as a regional park. She feels there is not adequate enough acreage to call it a regional park and all designs and use of said facility should be for local residents only, Paul Wood -- Leave Lodi Lake as it is, including the Wilderness Area. Any development of this project would increase property taxes and would encourage lots of out of town people to use the area. The Recreation and Parks Department should concentrate all of its efforts in cleaning up the river to make it safe for boating. Vi and Bob Riggle -- We both walk the Wilderness Area all the time. We are diametrically opposed to any control over this area. The public should be allowed to use this area any time they desire and should not be encouraged to join a docent group or other organized tours. Larry Simpferderfer -- Keep away from any type of tour concept for using the Wilderness Area. He has talked to Audubon Society representatives and they feel the area is teeming with bird life. Loren Wilson -- Recreation and Parks Department must check with Woodbridge Irrigation District prior to any plans or proposal with regard to the lake and its environs. Keep the Wilderness Area exactly as it is.. Donna Phillips -- Department has ignored the impact this facility., poses on individuals who reside on Laurel Avenue. Residents adjacent to the park would appreciate any consideration that 2 _ (Ca-ment by Donna Phillips cont`d) can be given to mi-Imizing the amount of traffic, both vehicular and pedestrian, that uses Laurel Avenue and the intrusion of people spilling over the park levee into the m front yards. After some two hours of discussion the public hearing was concluded witl: those in attendance agreeing on the following specific items: 1. '.cove the organized trailer area to the recommended location in the 13 acres. 2. Install a large group picnic area in the 13 acres. 3. Redo the main entrance to the park. 4_ Construct a new concession stand and boat rental operation. 5. Redesign the south side parking areas. 6. Install a bicycle/jogging trail around the circumference of Lodi Lake connecting to a bicycle/jogging trail around the Wilderness Area. 7. Eliminate power boats from the lake entirely. 8. Provide safe access to Lodi Lake across Turner Road for .pedestrians and vehicles. The group suggested stop suns and/or traffic signal. 9. Fence the Wilderness Area along the levee, providing access gates at the southeast and southwest ends of the acreage. In conclusion Director Williamson indicated that Staff was working on a new fee proposal for organized trailer groups and that this recommendation would be submitted to the City Council for action in the near future. Additionally, it has been stated that use by motorized --`-craf_ts have torn down and erode-d- the banks -and require-ex ensue repairs to same, i.e. cement retaining walls have been constructed to prevent further bank problems. The Parks and Recreation Commission conducted two meetings to hear public concern over eliminating motorized power boating on the Lake, which were held on April 7 and May 5 during the course of the regular Commission r meetings. Approximately 20 people were present at these two meetings, which had been set to explore and discuss the basic problems and receive input. Various legal questions were asked at these meetings, at which time Director Williamson was asked to secure answers to lake/river concerns and report back at the May meeting. These questions were directed to City Attorney, Ron Stein, who was asked to attend the May meeting and answer any questions that might be raised as well as to bring the Commission up-to-date regarding access and liability respon- sibilities. After much discussion and participation by the audience, the Commission moved that (1) all motorized power boating be eliminated from Lodi Lake, with the exception of sanctioned City of Lodi sponsored activities, rental boat recovery reeds, and general park patrol functions; (2) that the launch or ramp be kept open for public access, for launching motorized power crafts, which will in turn be required to go directly into the river and exit likewise to recover craft; and (3) that there be a restriction on the types of motorized crafts that can be launched, those types being V -drives, inboards and jet boats, and all others would be approved to launch and have access to the river. It shoulJ be noted that this recommendation was put together with assistance from citizens present and met with approval at its conclusion for presentation to the Council. The existing natural amenities lend themselves to a nature interpretation program which can be used in conjunction with the school system and can be offered to the general public on weekends and holidays during the high -use seasons of the year. F. The 13 -acre area to the west of the existing park, because of its rela- tive protection from flooding and its large, flat land area offers the opportunity for develoriment of high intensity park uses such as group picnicking, info Wal games and sport fields and a large parking lot. G. Because of the extreme cost and physical difficulty in developing a total circulation system, several circulation alternatives should be considered including: perimeter road system, one -:ray perimeter road system, and elimination of automobiles and use of a tram system. H. The existing facilities at Lori Lake Park should be studied and their functions combined into fewer new structures appropriately located to reduce congestion at the main entrance area, and provide improved service to the pari; users. I. Because of its relatively small -size-and -configuration, power boating on. f Lodi Lake itself should be eliminated. The project would initially involve development of Phase I and portions of Phase II as outlined in the Master Plan. (pg.2 ) Implementation of Phase I calls for development of the 58 acres northeast of the present park into a limited use Nature Study Area. This would be comprised of a paved bicycle, emer;ency/service access, and hiking trail around the perimeter of the 58 acres. There will be two caved access trails which cut across the nature area and tie in with the trail around the perimeter. These trails are necessary for emergency equipment access and fire protection. The fire hazard in this area has been a serious problem for years. In addition to the paved trail, there will be an unpaved nature trail through the area to allow for nature study tours by individuals and organized groups. A water system will be installed in the area which will provide for fire protection and irrigation of the levee adjacent to the homes located along Edgewood Drive. Pig's Lake, the drainage ditch, and rainfall will provide much of the water necessary to plant and wildlife inhabiting the area. Chemical toilets will be installed to service the nature study area, so that extension of a sewer line will not be necessary. This area would be developed with minimal environmental impact to preserve its natural aspects, while allowing limited public recreation use. The City plans to implement portions of Phase II in conjunction with develop- ment of the nature study area to help alleviate a deficiency in high intensity recreation use areas. This would entail removal of the grape vineyard from the 13 -acre parcel west of the lake. The land would be graded and prepared for lawn seeding and some tree plantings.
