ALIGNMENT Local Assistant Office of the Department of
/ Transportation, they indicated that the Federal
Highway Administration took the position that
public hearings should not be held on a portion
of the alignment of Stockton Street until the
Environmental Assessment (EIR) on Stockton
Street has been approved for circulation. City
Staff has determined that by checking with FHWA
that if the City did proceed with the alignment
hearing prior to their approval, we could jeopar-
dize the City's FAU funding on the Stockton
Street Project. Thn Local Assistant Office felt
it would be a minimum of one month before the
City reet-ived comments on the Environmental Assess-
ment or approval to circulate.
Following discussion, Council, on motion of

Your years ago we took -out a building permit to
build a commercial building on the corner of
Stockton St a Kettleman Lane. The provisions
of the permit required us to deed ten feet of land,
on the Stockton Street side,to the City of Lodi. Also
to pay the amount of $ 4,862.45 to the city for Street
work. We were told at this tine the work would be
done the following November. After checking with the
engineering department, the date was not ahead
because of possible street changes.
After four years and zany calls to the department
we are'now told the City Council has not made up
their minds.
Due to the fact there has been traffic lights installed
on this corner in the past yearSI would assume this
would determine where the street should be located.
This corner is an eyesore. There are holes in the
street that is city property and no sidewalk or
pavement. Since we have already paid for this work
and it will not cost the taxpayers anything, I request
that the work be completed.

Six months have passed since I last wrote you concerning the in-
stallatloA of curb, gutter and sidewalk adjacent to your development
P at 201 E. Kettleman Lane. During that time, we have had numerous
discussions with State and Federal offices in an attempt to get the
So. Stockton St. project mEoving, aid at this time expect confirmation
of their action within 30 days. This means that we are about one
f th closer to construction than we thought we were in September
last year.
T As•a consequence, the City Council is unable to adequately discuss
# the alternates and make a determination as to the ultimate location
of the Improvements. Until such a determination is made, we are
unable to install the Improvements you are requesting.
I fully realize that this is an unsatisfactory answer to your request,

This letter is to confirm our many conversations regarding the Instal-
lation of curb, gutter and eidewslit adjacent to your development at

The City of Lodl Is In the process of putting together the preliminary
work necessary to make a final detorminatlon on the exact location of
the Improvements. At the present time, the environmental Impact state-
ment Is with the federal M i ghway Administration for the I r review and
approval. peed on their track record to this point. we don't feel
that we will rwAlve f11MA approval for another two months. After that
ties, we will be setting up public meetings and/or public hearings
with the City Council to obtain lnforestlon from the residents and
property owners In the area. after which the City Council can be

SUBJECT: Public Hearing for Stockton Street Alignment (Vetter's Request)
In checking with the Local Assistance Office of the Department of Transporta—
tion, they indicated that the Federal Highway Administration took the position
that public hearings should not be held on a portion of the alignment of
Stockton Street until the Environmental Assessment (EIR) on Stockton Street
has been approved for circulation. My staff found by checking with FHWA
that if we did go ahead with the alignment hearing prior to their approval,
we could jeopardize our FRU funding on the Stockton Street Project.
The Local Assistance Office felt it would be a minimum of one month before
we received comments on the Environmental Assessment or approval to circulate.
Since normal hearings could take place within three months, it is recommended
that a special hearing not be set at this time. if approval to circulate is
not received in 30 days, the Council could reconsider at that time setting a
special hearing on this matter.
If there are any additional questions concerning this matter, Rich Prima,
who is most fami ar with this project, will be at the Council meeting.
