NCIL COMMUNICATION, DATE NO, May 29, 1985 SUBJECT: ADOPTION OF ORDINANCE NO. 1356 - AMENDING USES IN THE R -C -P DISTRICT SUBJECT TO SECURING A USE PERMIT AND THEREBY ALLOWING THE RENTAL AND ALE OF SPECIAL RESPIRATORY AND CONVALESCENT EQUIPMENT Ordinance No. 1356 entitled ."An Ordinance Amending the Lodi Municipal Code Section 17.27.030 entitled 'Permitted Uses - Use Permit' by amending uses permitted in the R -C -P District, subject to securing a Use Permit, thereby allowing the rental and sale of special respiratory and convalescent equipment" was introduced at an .adjourned regular meeting of the Lodi City Council held May 29, 1985. The Draft Ordinance which is -attached has been approved as to form by the City Attorney. State Statute allows for the adoption of an Ordinance five days after its introduction. RECOMMENDED ACTION: Following reading by --title; it would-be appropriate for the Lodi City Council to adopt Ordinance No. 1356. Alit 'Re mche --- City Clerk ORDINANCE NO. 1356 ORDINANCE AMENDING LODI MUNICIPAL CODE SECTION 17.27.030 ENTITLED "PERMITTED USES - USE PERMIT" BY AMENDING USES PERMITTED IN THE R -C -P DISTRICT SUBJECT TO SECURING A USE PERMIT THEREBY ALLOWING THE RENTAL AND SALE OF SPECIAL RESPIRATORY AND CONVALESCENT EQUIPMENT Be It Ordained by the Lodi City Council Section_ 1. Section 17.27.030 - Permitted Uses - Use permit is hereby amended to read as follows: The following uses are permitted in the R -C -P district subject to securing a use permit: A. All uses permitted in the R-3 district, as provided in Section 17.18.030, except when included as a permitted use in Section 17.27.020; B. Hospital; C. Lodge or private club; D. Funeral homes and mortuaries; E. Dispensing pharmacy or coffee shop when completely enclosed within a professional office complex or hospital and when serving as an accessary use. F. The business of the rental and sale of special respiratory and convalescent equipment. Section 2. - All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. Section 3. - This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval.
