FRWil THE CITY MANAGER'S OFFICE JUNE 1, 19-82 Proposed ordinance re Animals in Publ ic Places Attached hereto is a copy of a letter which this office has received from Mrs. Linda Mayo regarding the possibility of the enactment of an ordinance dealing with the problem of dogs creating a nuisance by defecating- in --public places; or more commonly known as the "poop scoop" ordinance. Please be advised that upon receipt of the above letter, I contacted the League of California Cities and asked that they send to me copies of other cities' ordinances relating to, thi-s-. -For your consideration, I am attaching those ordinances herewith. Where a police off1cdr has A right to enter or be present in or at any place, public or private, in the performance of official_ police duties, any dog, and the handler of any dog, used by the police department in the performance of official duties shall have the right to enter or be present in or at any such- -place.. B. It is unlawful and a misdemeanor for any person to wilfully torture, tease, torment, beat, kick, strike, muti- late, injure, disable, or kill any dog used by the police department in the performance of its functions or duties or to interfere with or meddle with any such dog which is used or being used by the police department., or any officer or member thereof, in the performance of any of the functions or duties of the police department or of such officer or, member. C. The provisions of Sections 6.04.210 and 6.04.240 shall not apply to dogs which have been trained for official police duties and which are used for said purposes by the police department during the performance of said, official police duties. COIlTROLLING ANIMALS IN PUBLIC PLACES P THE CITY COUNCIL. OF THE CITY OF TEHACHAPI DOES ORDAIN AS FOLLOWS: Section 1. PROHIBITION; No person owning, or having the charge. care custody or >` control of any animal. except dogs. shall cause. permit or allow such animal to --enter, :remain or be upon any, land or water owned. managed., controlled or operated as a city park. playground or tot lot. Dogs are allowed in and upon a city park. playground or tot lot only when ledorrestrained by a substantial leash. chain, strap. cord or rope (not to exceed eight (8) feet in length) attached to their collars and actually held by some person. except during pub-lic gatherings. at which time all dogs shall be pro- hibited therefrom. The -times and dates of public gatherings shall be designated-by.resolution of the Tehachapi City Council. This section shall be inapplicable to any person wholly. or partially blind using A -guide dog provided that said dog at all times is kept under the charge, care. custody or control of such person and is restrained by a substantial leash. chain. strap. cord. rope or harness not exceeding eight (8) feet in length. Section 7.12 of the Cotati Municipal Code is hereby amended by adding Section 7.12.070 to read as follows: Section _7.12.070.._Dog to be controlled so as not to Commit Nuisances. (A) It shall be unlawful for any person owning or having control or custody of any dog -to permittheanimal to defecate upon the public property in any, city park unless the person does immediately remove the feces and properly dispose of it - (B) Visually handicapped persons who use "seeing. eye" guide -dogs shall not be required to comply with the provisions of this section. Section 2. Posting of Sign in Parks. The -City Manager shall cause the posting of signs upon each City park to suf €iciently advise the public as to the general provision of this ordinance. Section 3. Effective Date. This ordinance shall become -effective 30 days after passage. Section -4.. Severability. If any section, subsection. sentence, clause, phrase or portion of this ordinance is for any reason held invalid or, unconsti- tutional nconst -tutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision of such holding and shall not of€eet the validity of the remaining portions thereof. Section 3. Penalty for Violation.. Any person violating any provision of this ._ section is guilty of an infraction and upon conviction thereof shall be punished as provided by law. Section 6.
