E,2-51 Alternate "A", with the City of Lodi to pay for the $50,000 Performance Bond, and directing Staff to negotiate with Mr. Hunger for the yellow brick at the site. t3 .;f". y . - f� e 9 CITY OF LODI PUBLIC WORKS DEPARTMENT TO: City Council FROM: City Manager DATE: May 19, 1982 COUNCIL COMMUNICATION SUBJECT: Award Contract for "Lodi Community Center Demolition of Excess Buildings" RECOMMENDED ACTION: That the City Council award the bid for "Lodi Community Center Demolltlon of Excess Buildings" to R. L. Hunger Building b Wrecking, the low bidder, In the amount of $0.00 for Alternate "A." BACKGROUND INFORMATION: Plans and specifications for this project were approved y the City Council on April 21, 1982. Bids were opened on Wednesday, May 19, 1982, and eight bids were received. A tabulation of the bids received is attached The amount budgeted for bull ding demolition was $39.000. Under the Alternate "A" bid, the contractor was required to demolish the build - Ings, remove everything -from the site and fill and regrade existing ground. Under Alternate "B� the contractor was required to demolish the buildings, stockpile the brick on site, fill and regrade existing ground. Then after a period of time, remove the debris from the City's brick salvage operation. Under the bid documents, the contractor Is required to provide the City with a Faithful Performance Bond in the amount of 100% of the bid and a Labor and Materials Bond in the amount of 50% of the bid.. Since the bid was $0.00, the City Is asking the contractor, based on the other bids received, to provide the City with a Performance Bond only in the amount of $50,000. The City will be obligated to pay the cost of this Performance Bond. it is felt that this small investment is In the City's best interest to insure the proper completion of the project. I personally talked to the contractor and he is concerned about the safety and liability of the science building. He indicated he would do everything in hl s power to pro a us with all the necessary bonds and certificates of insurance, ekc. by this/F iday„in hopes of demolishing the science building over the weekend. May 19, 1982 at 11:00 a.m. for the contract for Lodi Community Center Demolition of Excess Buildings as described in the specifications therefor approved by the City Council April 21, 1982; and WHEREAS, said bids have been compared, checked, and tabulated and a report thereof filed with the City Manager as shown on Exhibit "A" attached hereto and thereby made a part hereof. WHEREAS, the City Manager recommends that award be made to the low bidder, R.L. Hunger Building & Wrecking;, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi that award of contract for Lodi Community Center Demolition of Excess Buildings be and the same is hereby made to R.L. Hunger Building & Wrecking, the low bidder, in the amount of $0.00. BE IT FURTHER RESOLVED that the City Council of the City of Lodi does hereby assume the responsibility of paying for the $50,000 Performance Bor.3 which is to be provided by the contractor R.L. Hunger Building & Wrecking. REI CHE City Clerk 1 RESOLUTION NO. 82-52 RESOLUTION ADOPTING AN APPROPRIATIONS SPENDING LIMIT FOR 1982-83 IN COMPLIANCE WITH PROPOSITION 4 ARTICLE XIIB OF THE CONSTITUTION RESOLVED, that the City Council of the City of Lodi does hereby adopt the following Appropriation Spending Limit for 1.982-83 in compliance with Proposition 4, now Article XII B of the State Constitution. Total Appropriation for 1981-82 year as adopted by the City of Lodi $9,_468,985. Increased by Allowable Accumulated Growth and Consumer Price Index to 1982-83 of $10.908 Therefore the Spending Limit for 1982-83 $10,501.104. REI CHE City Clerk 82-52 RESOLUTION NO. 81-47 RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE ON BEHALF OF THE CITY OF LODI EASEMENTS WITH THE SOUTHERN PACIFIC TRANSPORTATION COMPANY FOR 100 FEET BY 80 FEET CROSSINGS AT LOCKEFORD STREET, LOCUST STREET, ELM STREET, AND LODI AVENUE, LODI, CALIFORNIA NOW THEREFORE BE IT RESOLVED that the City Council of the City of Lodi does hereby authorize the Mayor and City Clerk to execute easements with the Southern Pacific Transportation Company for 100 feet by 80 feet crossings at Lockeford Street, Locust Street, Elm Street, and Lodi Avenue, Lodi, California. REIMCHE City Clerk RESOLUTION NO. 82-49 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI, MAKING APPLICABLE THE PROVISIONS OF CODE OF CIVIL PROCEDURE SECTION 1094.6 PROVIDING FOR JUDI.CIAL REVIEW OF ADMINISTRATIVE DECISIONS WHEREAS, California Code of Civil Procedure Section 1094.6(g) permits the governing body of a local agency to adopt a resolution making Code of Civil Procedure Section 1094.6 applicable to such local agency; and WHEREAS, the Council finds and determines that such will provide an orderly and reasonable procedure for the. review of administrative decisions; NOW, THEREFORE, the City Council of the City of Lodi HEREBY RESOLVES that the provisions of Section 1094.6 of the California Code of Civil Procedure are applicable to the City of Lodi.
