In Re: Parking and related problems operation
Lodi Sports Center.
Cent lement
Mr. and Mrs. Max Hittle have retained our of#ice to assist them in securing
relief from the dangerous and hazardous conditions resulting from traffic
congestion generated by the opening of the sports center and the anticipated
aggravatim -of this problem in the coming Booths with the saticipated in-
cs -am of the facilities.
This latter will formally put you on notice that you must Immediately,
(1) -take necessary action to remove the rubbish container from. the amo-
unt -way
ame-meat-ray along side the south boundary of your property; and (2) that all
parkins mot be terminated to the subject easement way, as it has prey ted,
and will continue to prevent, my clients' free and unencumbered use of the
rights of ingress and agrsss through such easement way to which they are
legally entitled.
Your operations " presently maintained, with totally inadequate parking,
are, in my opinion, an invasion of their property rights to the nature of
a trespass and constitute good and sufficient basis for a legal claim, both
for damages and possible injunctive relief, including relief from expasaton
of membeinhip until existing parking conditions are corrected.
We are %tilling to meet with you or your legal representative and those City
officials who we believe are in part responsible for this condition arising
in an effort to find an acceptable solution. Absent your immediate and full
ooaperstion, I have been instructed to initiate appropriate legal procaadin$s
for the relief and damages as above indicated.
Very truly yours,
