RECOMMENDED ACTION: That the City Council authorize the sale, by the Police
Department, of certain surplus weapons and further, authorize
the proceeds of said sale to be used for replacement and
additional weapons as needed.
BACKGROUND INFORMATION: The attached memo prepared by Chief of Police Floyd
W-iTTiams reconimen `s—Te e sale of several weapons presently in use by our officers
which may be unsafe in certain circumstances. In addition, it would be appropriate
to also dispose of a number of weapons confiscated by department personnel over a
period of time. Chief Williams has made arrangements for the efficient disposal
of these weapons as discussed in his memo.
The timing is critical because the California Penal Code p-ovides that the sale
of such weapons may be accomplished each year only during the period of July 1
to July 10. The weapons auctioneers need time to inventory and otherwise
organize and ready this surplus material for sale. This is a routine item and
as such has been placed on the Consent Calendar. However, Chief Williams will
be in attendance in the event Council Members have any questions.

We have two categories of weapons which I would like to have auctioned off, with
the proceeds of the sale used to restock our Armory with new weapons.
The first is City owned handguns. We recently learned that several of the City
owned and issued .38 caliber Smith 8 Wesson revolvers are pre -1958 and are un-
safe when used in conjunction with today's police ammunition. These weapons
are being identified and picked up at the present time and will need replacement.
The second are those weapons we have confiscated over the.years because of hav-
ing been used in a crime. At the present time our gun locker (used for storage
of these weapons) is bulging. By law, we have two options (per 12028 Penal
Code):
1) Sell at auction, or
2) Destroy
The second option, is both time consuming and costly. The first would pay for
weapons we need in our Armory without asking for additional funds.
Roger Ernst 8 Associates Auctioneers will handle the auction for us, selling
only to individua!s possessing a federal firearms license. They will, upon
completion of the auction, supply us with a list of the weapons sold, to whom
sold and the ,rice received for each weapon. A copy of this list is then sent
to the State of California Department of Justice, showing disposition. For
their service, Ernst keeps 25% of the gross - out of which they pay a I I expenses.

Due to time constraints (sale must be between July I and July 10), it is im-
portant to get this before Council. Ernst states they need to start on the
process by the second week in May. I request a shirt -sleeve on either
April 23 or .April 30, and consent calendar on May I, 1985.
We do not need Council authorization to sell the weapons but we do need
authorization to use the funds for replacement and additional weapons.
Also, we need them declared as surplus - those weapons which are City owned.
I will furnish a list as soon as possible.
