It is our opinion that the City of Lodi may expend assessment district funds for the purpose of securing aerial. photographs of the work which was completed pursuant to the assessment district proceedings. I would term such "as built" which would be covered by the general language provided for in these proceedings. You have also asked our opinion as to the proper disposition of excess funds on hand in the assessment district proceedings. In partial answer to this question I would refer you to Resolution No. 84-017, adopted by the City Council on February 22, 1984. Paragraph 16 provides as follows: "16. If any excess shall be realized from the assessment, it shall be used in such amounts as the Council may determine, in accordance with the provisions of law for one or more of the following purposes: (a) Transfer to the general fund of the City, provided that the amount of any such transfer shall. not exceed the lesser of X1,000 or 5% of the total amount expended from the improvement fund; BLEWETT.
