RHpEST BY MID City Manager Peterson reported to the Council that at a
FCR AEUITICNAL meeting held April 5, 1985 the UDID Comittee discussed
PFOEFESSICt3AL items of priority in the continued improvemnts being made
SIRV'ICFS AND in the downtown area. The Conmittee was to have met again
IV= TOTHE April 12, 1985 to finalize its proposal to be presented to
LCDI LNITFD the City Council at Wednesday night's meeting. City
DCWN11CM Manager Peterson asked that a Conmittee representative
ASSESSMPNr be in attendance to present a report and answer any
DISTRICT questions Council Members may have.
It is anticipated that the Cwwiittee's proposal will consist
of the following:
1. The funding of a downtown parking study.
2. Funding for the placement of additional street furniture
(12 benches) and 12 more trash receptacles.
3. The establislment of a modest "reserve fund" to provide
for continued replacement of plant material.
The Lodi Design Group has prepared. estimates of these two
projects which project the cost of the parking study at
$4,300 - $5,000 and the cost of the street furniture and
trash receptacles at $14,520. The UDID Contingent Fund
currently has a balance of approximately $40,000. The
plantings would be funded by earned interest.
Following discussion, on motion of Council Member Olson,
Reid second, Council approved the following proposed
projects which costs are to be funded from the United
Qmmw-
Downtown Improvement District (LAID) Contingent Fund and the
UDID Contingency Fund.
1. The funding of a downtown parking study (permit parking
primarily) to be completed by City staff in the amount
of $3,000.
2. Removal of advertising benches presently located in the
City.
3. The funding of additional street furniture (18 benches)
at a cost of $12,782.
4. The funding of 18 trash receptacles at a cots $6,300.
5. The establishment of a modest "reserve fund" to provide
for continued replacement of plant materials in the
planters on a semi-annual basis (City to provide
materials - LDID to furnish labor for planting) at a
cost of $1,200 per year.

The first $20,000 of these charges are to be charged against
the UDID Construction Fund and the balance from the UDID
Contingency Fund.

RECOP&IENDED ACTION: That the City Council Hear the presentation

Improvement District (UDID) and take action
as deemed appropriate.
BACKGROUNDINFORMATION: At a meeting held April 5, 1985 the UDID
Committee disc�zssed items of priority in the continued
improvements being made in the downtown area. The Committee was
to have met again April 12., 1985 to finalize its proposal to be
presented to the City Council at Wednesday night's meeting. I
have asked that a Committee representative be in attendance to
present a report and answer any questions Councilmembers may
have.
It is anticipated that the Committee's proposal will
consist of
the following:
i. The funding of a downtown parking study
2. Finding for the placement of additional street furniture
(12 benches) and 12 more trash receptacles

You have asked our opinion concerning the ability of
the City of Lodi to charge the cost of aerial photographs
of the improvements, installed by the Lodi United Downtown
Assessment District Beautification Project, to the district.
It is our opinion that the City of Lodi may expend
assessment district funds for the purpose of securing aerial.
photographs of the work which was completed pursuant to the
assessment district proceedings. I would term such "as
built" which would be covered by the general language
provided for in these proceedings.
You have also asked our opinion as to the proper
disposition of excess funds on hand in the assessment district
proceedings. In partial answer to this question I would
refer you to Resolution No. 84-017, adopted by the City
Council on February 22, 1984. Paragraph 16 provides as
follows:
"16. If any excess shall be realized from the
assessment, it shall be used in such amounts as
the Council may determine, in accordance with the
provisions of law for one or more of the following
purposes:
(a) Transfer to the general fund of the City,
provided that the amount of any such transfer shall.
not exceed the lesser of X1,000 or 5% of the total
amount expended from the improvement fund;

(b) As a credit upon the assessment and any
supplemental assessment in accordance with the
provisions of Section 10427.1 of the Streets and
Highways Code;
(c) To reimburse the City for any contributions
ora dvances to or for the construction fund that
were not pledged in this Resolution of Intention;
(d) For the maintenance of the improvements or
a specified part thereof." -
In addition to the items set forth in Paragraph 16 the
Council may, in its discretion, adopt a resolution providing
for a change ane modification In the scope of the work of the
project and thereby do addtional work within the boundaries
of the district that would benefit the landowners.
The Council might want to consider additional work
via a change and modif-ication or might want to consider applying
the excess funds pursuant to Section 16(d) which provides for
-the maintenance of the improvements. In this assessment district
I know that some of the improvements will require constant
maintenance.
