DEPARTMENT OF RECREATION AND PARKS
TOPIC: Bids for Lodi Lake Concession Operation
Area to be serviced:
Location: Lodi Lake Park
Facility: Concession Stand and Park Area
Location: 1301 W. Turner Road
Contract Duration: May 1, 1986 December 31, 1988
Bid Instructions
Percentage of gross payments are to be made monthly no later than
the 10th of the month. Any deviation can be construed as a breech
of contract.
The vender will have the sole and exclusive rights/license to vend
foods, drinks (except alcoholic beverages of any kind), toys,
souvenirs, etc., at the concession stand at Lodi Lake Park for a
period of 2 1/2 years beginning May 1, 1986 and must follow all
general specifications.
The City of Lodi retains the right to reject any and all bids.
Note
The high percentage bid may or may not be the successful bidder.
There will be other considerations, i.e. past experience, financial
ability, and/or stability to perform and provide a successful
operation. References will be required if requested by the City of
Lodi.
GENERAL SPECIFICATIONS
The City .will provide:
1. Enclosed concession stand with some limited city owned equipment,
which concessionaire will be expected to service and maintain at
their sole cost and expense.
2. Utilities for good operating situations and will pay for same, i.e.
water, gas, and electricity.
3. The city will maintain the general property of the concession
building at its cost, unless abuse and lack of general care is
apparent, at which time cost and expenses will be that of the
concessionaire. Likewise, the city will assist with vandal
caused damage to building only.

removal. The concessionaire will be asked to remove large
boxes and storage containers, etc. which may accumulate in
equipment or food storage packaging.
Regarding the LODI LAKE operations:

The length of the contract is for two and one half (2 1/2) years,
beginning with 1986 through 1988 (covered within).
The concessionaire to provide the City of Lodi with insurance
certificate covering public liability, product insurance, and
property damage in the amount of $1,00o,000 for each liabiNty
and occurence. insurer agrees to indemnify and hold Vie City
of Lodi free and against all costs, expenses, and liability arisln-j
out of, or based upon, any and all property damage or damages
for personal injuries, including death, sustained in accidents occuring.
in or about the demised premises; where such accident, damage, or
injury, including death, results, or is claimed to have resulted,
from any act or omission on the part of the Lessee, or Lessee's
agents or employees.
3. Concessionaire will generally follow the product and price schedule
attached. Since the contract is for two and one half (2 1/2) years, -
prices will be reviewed each year. The concessionaire can also
add to or delete from the product list with the approval of the
City Manager or his representative.
R. Concessionaire will keep the concession stand and immediate
surrounding area in a clean and presentable condition at all times
and follow the strictest of sanitary conditions and ordinances
applicable to the business to be conducted.
5. Concessionaire will provide all equipment and products to operate
said concession.
6. Bidders will pay percentage as per contract of gross receipts
after taxes to the City of Lodi on the tenth (10th) of each month
while in operation. The concessionaire will be expected to keep
accurage . records and books of account of all purchases and sales
and does hereby give to the city or its authorized agents the right

to examine and audit said books at any time they desire.
7. Concessionaire will be expected to operate any time that the park
is open between May 1 and September 30 of each year or at such
times that the City Manager of the City of Lodi (or his representa-
tive) directs. The hours of operation will be set by the Director
of Recreation and Parks in coordination and cooperation with
mutually agreed upon hours by the Director and Concessionaire,
which will best suit and service the public and its concession
needs.

8. The successful bidder will have exclusive rights to all concession
sales at Lodi Lake Park.
9. Bidders should be aware that a Possessory Interest Tax is
charged each year by the County Assessor for the use of the
facility. The estimated cost is $250.00
10. The Director of Recreation and Parks for the City of Lodi reserves
the right to approve any employee or operator of said concession
stand.
11. Concessionaire will upon normal examination or breach of contract/
agreement allow the City Manager or his representative the right
of entry or re-entry to the concession stand area.
12. The concessionaire shall not have the right to sell, mortgage, assign
or sublet his contract/agreement or any part thereof without the
prior written consent of the City Manager of the City of Lodi and
a breach of this condition shall automatically terminate any: contract
or agreement.
13. At the conclusion of or termination of any stated agreement/contract
the concessionaire will be expected to surrender said concession
premises in as good an order as that in which they would receive
same, with ordinary wear and tear excepted. Damage to or mistreat-
ment of the building or city equipment will be the responsibility of
the concessionaire to repair, replace, or reimburse for repair or
replacement.
14. The agreement/contract may be terminated by mutual agreement of
the two parties once thirty ( 30) days notice is given by one and
accepted by the other. Such notice shall be delivered to the City
of Lodi at the office of the City Manager, City Hall, or to the
Concessionaire at the premises teased herein.

Concessionaire and City Manager.

office, City Hall, 221 West Pine Street, Lodi, CA 95240, until

they will be publicly opened and read for providing the following
services.
The undersigned declares that he/she has carefully examined the
Bid and general specifications of this bid and submits this

LODI LAKE 'ARK CONCESSION OPERATIONS
The City of Lodi invites sealed proposals for LODI LAKE
PARK CONCESSION OPERATIONS, conforming to specifications
on file in the office of the Purchasing Agent, City Hall,
Lodi, CA, where copies of said specifications may be
inspected or obtained.
Sealed proposals shall be delivered to the Purchasing Agent
at City Hall, 22`1 W. Pine Street, Lodi, on or before
11:00 A.M., TUESDAY, APRIL 29, 1986
and will by opened on the above day and hour in the City
Hall Council Chambers, City Hall, Lodi, CA.
The City of Lodi reserves the right to reject any or all
bids.
Reference is hereby made to said specifications for further
details which specifications and this notice shall be
considered part of any contract made pursuant thereto.
