March 24, 1987 Consider Ordinance relating to Solid Waste Transportation Within the City PREPARED BY: City Attorney RECOMENDED 71L'I'ION'- That the City Council introduce the ordinance. BACKGROUND INFORMATION: At the last City Council .need--, 1 was asked to prepare an ordinance which would require that no solid waste and/or garbage shall be removed and carried on and along the streets and alleys of the City, unless such materials are enclosed - or otherwise secured so as to prevent the solid waste and/or other garbage from being blown, dropped, spilled, or leaked. This ordinance is to confona with San Joaquin County's new requirements that all such matter as described above that is being taken the Harney Lane Landfill shall be so secured. For the present time, the enforecsnent of this ordinance will be by citation. It is recamended that for the first 30 days after the ordinance becanes law, that the Police Department warn individuals that they are in violation, rather than issuing citations..'. 4 This office will be exploring with the City's solid waste franchisee, tile- possibility of some regulation within the new franchise agreement which will be similar to that which the County has proposed.` m; RMS:vc cccwell/txta.0ly Respectfully submitted, Ronald M. BE IT ORDAINED BY THE LODI CITY COUTJCIL. SECTION 1 Lodi Municipal Code Chapter 13.16 is 'ereby amended to add a new section relating to solid waste transportation as folloF,-s: "Section Solid waste transportation. No solid waste and/or garbage shall be removed and carried on and along the streets and alleys of the City unless such materials are enclosed or otherwise secured so as to prevent tie solid waste and/or other garbage frac being blown, dropped, spilled, or leaked." SECTION 2. ,.All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 3. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published; in the City of Lodi and shall. be in force and take effect thirty days from and after its passage and approval.
