Forbes and Elise A. Forbes and the City of Lodi and authorize the City Manager and City Clerk to execute this agree- ment. gree- ment. . BACKGROUND INFORMATION: The agreementcovers dedication of property to the planned rigfx-of-way width and the modification to the existing building at the corner of Lodi Avenue and Pleasant Avenue. It will be the City's responsibility to modify the building as necessary to clear the right-of-way at such time as it is determined necessary to widen Lodi Avenue. This agree- ment is very similar to that which we have with Pinkerton Foundry. Based on previous agreements of this type, it appears that it is in order for the Council to ap rove the agreement. GLAVES, City Manager ,n"^ ' This Agreement entered into this day of February, 1985 between the CITY OF LODI, hereinafter called "City" and RONALD A. FORBES and ELISE A. FORBES, hereinafter called "Owner". W I T N E S S E T H Owner owns the property located at 303 South Pleasant Avenue, Lodi, California, described as: A portion of Lot 6, Block 2, STURLA SCHOOL ADDITION, according to the official Map or Plat thereof filed for record April 6, 1920 in Vol. 10 of Map and Plats, page 6, San Joaquin County Records. City and Owner agree as follows: 1. Owner is dedicating on said Map, the necessary land for the future widening of Lodi Avenue and Pleasant Avenue. 2. City acknowledges and agrees that it is City's responsibility to modify the buildings presently in the newly dedicated right-of-way at such time that City.desires to widen either or both streets and agrees to modify the buildings at City's cost at such time as City deems it necessary to so widen said streets. 3. Owner acknowledges that in the event the buildings presently in the newly dedicated right-of-way are intentionally demolished or damaged or partially destroyed' by fire or any other calamity or act of God to the extent of more than fifty percent of its reasonable value at that -1- .. •�.•..
