industrial waste/sanitary sewer line within
this parcel. The City of Lodi desires to obtain
a future well site locate within the Lakeshore
Village property. This well site location
conforms with the recommendation of the City's
adopted Water Master Plan.
Staff therefore recommended that the City Coun-
cil approve and accept a Letter of Ao r.eement which
will exchange ownership of the 2,5001 strip
parcel owned by the City of Lodi for the 50'
60' well site. The City of Lodi will retain
a public utility easement over the 2,500 strip
parcel, which will be incorporated in the Lake-
shore Village development, and will be maintained
by the homeowners of this development. A copy
of this proposed Letter 'kgreement was presented
for uc.uncil ° s perusal.
On ;notion c-¢ ,uncilman Pinkerton, Katnich
second, Council approved the Letter Agreement
with Grupe Communities covering exchange of
land parcels and authorized the Mayor and City
Clerk to execute the agreements on behalf of the
City.
RECOMMENDED ACTION: That the City Council authorize the Mayor and the City Clerk
to execute the attached Letter of Agreement.
BACWAxOUND INFORMAT1OMo The City of Lodi presently owns in fee title a strip

side of and contiguous to the Lakeshore Village property owned by Grupe Com-
munities, Inco The City of Lodt presently has a 60 KV power line and a 30"
Industrial waste/sanitary sewer line within this parcel. Refer to attached
Exhibit P. The City of Lodi desires to obtain a future well site located
within the Lakeshore Village property, as shown on attached exhibit. T'hi's well
site location conforms with the recomnendattons of City's adopted Water Master
Man.
It is, therefore, recommended that the City Council approve and accept the
attached Letter of Agreement which will exchange ownership of the 2,5006 strip
parcel owned by the City of Lodi for the 50' x 60' well site all as shown on
Exhibit #I. The City of Lodi will retain a public utility easement over the
2,5006 strip parcel, which will be incorporated in the Lakeshore Village
development, and will be maintained by the homeowners of this development.
The attached Letter of Agreement has been reviewed and approved by the City
Attorney,

Gentlemen-.
GRUPE COMMUNITIES, INC. presently owns a parcel of
real property located south of Highway 12 and gest of this
Woodbridge Irrigation District Canal, shorn on the trap
attached hereto as Exhibit "A" and more particularly described.
in Exhibit "B* attached hereto.
The City of Lodi requires an additional ground water
well and desires to place a well on Grupe's property, on an
approximately 50 foot by 60.foot site, which is specified
on the attached trap, and more particularly described in
Exhibit "C" attached hereto.
Pursuant to our oral understanding, Grupe will ex-
change and grant to the City the property described in Exhibit
"C" for the ground water well site. In addition, Grupe shall
grant to the City the following easements: a 25 foot under-
ground public utility easement for electricity, water and
storm drains, and a 25 foot surface easement for ingress and
egress to said well site. Said easements will be reserved
on the final subdivision map of Lakeshore Village Unit leo. 1,
Trace 1682, subdivisions of San Joaquin County.
Grupe shall erect a fence with a minimum height of
six (6) feet on the gest and south boundaries of the well,
site, and the City shall have the obligation and responsi-
bility to erect a fence with a minimum height of six (6)
feet on the north and east boundaries of the well site, to
shield the property from the public Griew. prior to either
party's construction of the fence, they shall jointly agree
on its specifications.

the City of Lodi, while reserving a 15 foot easement for
power poles and transmission lines, shall exchange and convey

y grant deed to Grupe a parcel of land approximately 20
feet wide lying immediately south, of and parallel to Highway
12 and gest of the Woodbridge Irrigation District Canal.
The 20 foot strip is more particularly described in Exhibit
"D" attached hereto.- Grupe agrees to maintain said strip of
land in accordance with its development plans.
If the above is agreeable with you, Wi1,1 you please
execute a copy of this letter and return it to the under-
signed® At such time as we receive your executed copy, both
parties shall deposit in escrow with Title Insurance & rust
Company, their respective deeds and'6asements. As soon as
the escrow holder has received both Grupe's and the City's
grant deeds, they shall be simultaneously recorded, with
each party paling one-half of all escrow and*'Xecording fees
