Turner Rand and authorize the City Marager and City Cleric t® execute somas for the City. r DEVELOPMENT AGREEMENT for the IMPROVEMENT 1. of 1333 Eo Turner Road BY ASSESSMENT THIS AGREEMENT is wade and entered into by and between the CITY OF LODE, hereinafter referred to as "City," and CALIFORNIA WASTE REMOVAL SYSTEMS, INC hereinafter referred to as B1Developer" RECITALS: WHEREAS, Developer is the owner of that certain real property known as 1333 E. Turner Road in the City of Lodi, also known as a portion of ASSESSOR PARCEL 40. 049-080-24 and WHEREAS, Developer has requested issuance of a building permit prior to the construction and completion of improvements required pursuant to Article 5, Chapter 5 of the Lodi City Code, which Improvements include all streets, highways or !public ways and public utility facilities which are a part of, or appuraenant to, the on-site development, all In accordance with, and as required by, the plans and for all or any of said Improve- ments In, appurteinant to, or outside the limits of development, and NOW, THEREFORE, in order to insure satisfactory performance by Developer of Developer's obligations pursuant to Article 5, Chapter 5 of the Lodi City Code, the parties agree as follows: 1. Performance of Work by Developer: Developer will do and perform, or cause to be done an performed at Developer's (mn expense, in a good and workmanlike runner, and furnish all required materials, all under the direction and to the satis- faction of the Public Works Director, al"i of the work and Improvements normal to development within the City of Lodi, as required by City, said items to be constructed or Installed as part of an assessment district currently being formed. 2. Building Permit Issuance: Subject to requirements of the Convaunity Development Department, City will approve issuance of a building permit on subject property. 3.
