BACKGROUND INFORMATION: This item is being brought before the City Council for consideration at the request of Council Member Johnson with concurrence by Mayor Nakanishi. Section 5.2 of the City Council Protocol Manual sets forth the following removal policy for Boards, Committees and Commissions appointed by the City Council: "A majority vote of the City Council may remove any member of a Commission for any reason including, but not limited to, conduct unbecoming a public official, violating the City's Conflict of Interest Code, failing to comply with statutory requirements, or failing to attend fifty percent (50%) of the Commission meetings in a calendar year. Conduct unbecoming a public official includes the conduct that any reasonable commissioner would know is incompatible to public service, would indicate a lack of fitness to perform the functions of a commissioner or would discredit or cause embarrassment to the City. Any member of the City Council may initiate a person's removal from a Commission by requesting that consideration of the person's removal be placed on the Council's agenda at a regular or special meeting for discussion and potential action. The City Clerk shall notify the person affected of the time and place of the meeting. When the item is on the City Council agenda, the City Council may, by majority vote, remove the person from a Commission." Ms. Fox's removal has been recommended based on current and previous lack of compliance with AB 1234 Ethics Training, previous lack of compliance with Conflict of Interest Code filings and attendance shortcomings over the previous two years. Notice of this meeting was provided to Ms. Fox pursuant to Section 5.2 above. The Mayor held interviews with candidates for the Recreation Commission on January 7, 2013. While the incumbents were reappointed at that time, new applicant Ethan Chelli also excelled in the interview process and was determined to be a qualified candidate for Recreation Commissioner. In the alternative, the City Council may direct the posting and application process for the position which will take a minimum of 60-90 days depending upon the number of applications received. In January 2013, only four individuals, including the two incumbents, applied for the two positions. Due to the recent timing of the interviews, it is recommended that if the City Council removes Commissioner Fox from the Recreation Commission then it also appoint Mr. Chelli as the successor Commissioner. FISCAL IMPACT: None. FUNDING AVAILABLE: Not applicable. The person's term of office expires and a different person has been appointed. 2. The person voluntarily resigns from the Commission. 3. The person no longer resides and/or is a registered voter within the required jurisdiction. 4. The person fails to attend three (3) consecutive meetings of the Commission and does not have prior approval for said absences by way of a majority action of the Commission. Comments by the Public, Commission and Staff on Non -Agenda Items Additions to Agenda Commissioner Wall asked if the City has been turned down for the grants for the levee repair for Pigs Lake. Mr. Dutra spoke with Jeff Hood and one grant has been turned down however a CALFED grant may still be a possibility. Mr. Dutra will follow up with Jeff Hood on the status of the grants. Commissioner Wall would like to make a request to have the State come out and tour the area and have the Commission there to help explain the urgency. All the Commissioners present concurred with Commissioner Wall. Mr. Rodems will speak to Blair King about the request. Mr. Rodems shared that a representative from Congressman McNerney's office came out to tour Pigs Lake with Mr. Rodems and Mr. King. Commissioner Wall asked what the procedure is for outside users of LUSD facilities. Mr. Dutra explained the procedure for requesting use of LUSD facilities. Commissioner Wall asked if any changes to Joint Use Agreement will be discussed by the LUSD School Board. Mr. Rodems stated the City is running under an extension of the Joint Use Agreement and he and the school district are in the process of renegotiating this contract and refining this process so it best fits the needs of both organizations. Mr. Rodems shared information regarding an upcoming training for Commissioners at the City of Manteca. Commissioner Long commended staff on the new community brochure. Commissioner Akin asked about the Farmers Market. Mr. Rodems stated it will be every Saturday from May 22 to September 25 from 8:00 a.m. - Noon. Mr. Rodems hopes that we make it visible. The billboard on Turner Road will be utilized to advertise the event. Mr. Rodems stated that Grace Malson is working diligently for certification for the senior WIC program as well as establishing a route to transport seniors to the event from a couple of the senior residents in town. Commissioner Akin also asked about the Mokelumne River Challenge. Mr. Rodems stated the event is moving forward. A meeting was held last week and things are being put in place (i.e. staffing). Comments by the Public, Commission and Staff on Non -Agenda Items Additions to Agenda Alan Maclsaac, Mokelumne River Adventure Challenge Coordinator — Mr. Maclsaac gave the Commission and update on the 2010 event and let them know where the event stands for 2011. Mr. Maclsaac thanked Jim Rodems and his staff as well as the Commission, the City of Lodi Fire Department, and other agencies that were involved. Special thanks to the Juvenile Diabetes Research Foundation, Camanche Recreation Company, Holiday Day Express, REI, and the City of Lodi Parks and Recreation. There were 46 participants with a total of 11 teams. There were plenty of volunteers from Lodi/Tokay Rotary, Tokay Cross Country Track Team, as well as individuals from throughout the community. They were able to donate from the proceeds $1000 to Juvenile Diabetes Research Foundation, $500 to Lodi/Tokay Rotary Club, and $500 to the Tokay High Cross Country Track Team. Mr. Maclsaac thanked all the sponsors. Mr. Maclsaac has already been contacted by Epies Great Race to have this event as a feeder event for their program. He's also been contacted by Current Adventures boat company for kayak rentals. All the benefactors have committed for next year. The race is tentatively set for June 12, 2011. Commissioner Akin commended Mr. Maclsaac on a great event. Commissioner Akin asked what team finished last. Mr. Maclsaac stated it was the Lodi/Tokay Rotary. Commissioner Wall also thanked Mr. Maclsaac for a wonderful event. Commissioner Long thought it was a very good event as well. Commissioner Sasaki asked if the time frame could be extended due to the cherry season. He wondered if the event could be pushed out so cherry growers could participate. Action Items Review and Approve Access and Design Concept for Mokelumne Water Treatment Plant Mr. Rodems introduced this item. Wally Sandelin, Public Works Director, informed the Commission of the status of the Mokelumne Water Treatment Plant. The cost of the plant is in the range of $30,000,000 to $40,000,000. Mr. Sandelin feels at this point in time its important for the Commission and staff to begin to firm up what the uses are going to be, what the building location might be for the group picnic facility, as well as a restroom facility. Mr. Sandelin stated in previous preliminary designs there was a restroom facility incorporated into the Water Treatment Plant building but with new Homeland Security requirements, this is no longer a viable option. Commissioner Wardrobe -Fox asked if the development of this site will continue to include upgrades and infrastructure upgrades to the remaining park portion of the 13 acres. Mr. Sandelin feels this is a discussion that the Parks and Recreation Commission, the Council, and the City Manager need to have. Commissioner Akin recalls this being part of Council's understanding. Commissioner Sasaki met with Nancy Beckman, Director of Visit Lodi, and there was a question of why the softball program has dwindled and hurt tourism due to the lack of tournaments in Lodi. Mr. Rodems shared that in the 1980's Lodi had a big softball tourism program and unfortunately our fields have not grown to accommodate the growth of these types of programs. Commissioner Sasaki will share this information with Nancy Beckman. Commissioner Wardrobe -Fox asked if our fields are marketed for tournaments. Mr. Rodems stated that some Babe Ruth tournaments have been bid for in addition to girl's softball tournaments. Commissioner Wall asked if we still have an Adult Sports Advisory Board. Ms. Lovell stated it's still in existence however they don't meet very often. Typically they meet when there's an issue. Ms. Lovell shared that the Commission has received a thank you card from former Commissioner Scott Davis for the plant and basket he received on behalf of his father. Mr. Rodems stated that effective today installation is complete with the lights at the Grape Bowl. The lights are being tested remotely from Iowa and training for staff will take place on the new system next week. Mr. Dutra stated the security lighting was also improved at no additional cost to the City. Commissioner Akin asked if DeBenedetti will be lit. Mr. Rodems stated that it will be lit but no money is available at this time to install them. IV. Commissioner Sasaki suggested possibly having an organic market so it doesn't interfere with the Thursday night market. Commissioner Sasaki also offered his assistance. Commissioner Akin asked about the Mokelumne River Challenge. Mr. Rodems stated Mr. Mclsaac has obtained a permit from the County to close the river from 7:00 —12:00. Mr. Mclsaac currently has 25 applicants and expects to have 75 participants. Commissioner Wall asked if there was an update on the Mokelumne River levee. Mr. Rodems shared that Jeff Hood continues to look for funding sources for the repair. There have also been discussions with the Army Corp of Engineers. Commissioner Wall wants to keep this issue in the forefront. Mr. Rodems stated that invitations have been put forward to representatives however they're not interested in taking a tour but they did provide staff with what a potential fix would be. Commissioner Sasaki asked about funding for the Grape Bowl from Waste Management. Mr. Rodems stated this is a done deal and changes to the contract are being written into the contract by the City Attorney. The City has received its first payment and will receive subsequent monthly payments until they reach the $1,000,000 mark. Commissioner Long thanked Mr. Dutra for doing a good job with Arbor Day. Jeff Hood, Communications Specialist for the City of Lodi, updated the Commission on the current status of Pigs Lake. Mr. Hood stated that in November 2008 the City applied for Proposition 84 monies and was declined. Both McNerney and Hubert looked at the situation at Pigs Lake. The Bond Committee didn't like the application that was submitted by staff because they didn't feel it was environmentally prudent. Mr. Hood shared there are three options: do nothing, wait for funding for hardened embankment, and retreat behind Pigs Lake. Commissioner Long stated that Mr. Hood suggested maybe taking a fall back position to protect further losing land and give up Pigs Lake. Mr. Rodems stated there are many discussions going on about refreshing Pigs Lake. There are also discussions regarding possibly dredging Lodi Lake which would allow for better water quality and improve habitat for fish. This may also allow staff to access grant funds for Pigs Lake. Mr. Rodems stated there is no eminent danger of losing the Nature Area however there is eminent danger of losing the bank of Pigs Lake. Commissioner Wall asked if the roof of the building that houses the Parks Department has been repaired. Mr. Dutra stated it hasn't. Mr. Rodems asked to table Section V., Item C. under the Regular Agenda. IV. Action Items V. Regular Agenda — Discussion Items Joint Use Agreement Mr. Rodems introduced this item. Mr. Rodems stated there are a couple of sticking points with the Joint Use Agreement. Council wanted to see some sort of penalty introduced for being bumped from use of a school district facility once approval has been given. The school district has taken the stance that they are unwilling to agree or partake in any agreement that would give a monetary penalty in this instance. Mr. Rodems stated they will be working on additional language to go in the agreement. The City has asked the School District to take this agreement to their Board and advise them that this is the City's stance prior to bringing the agreement to Council for their approval. Mr. Raingruber is particularly concerned with the condition of Pigs Lake. Mr. Raingruber stated there is public concern about the erosion in this area. Mr. Raingruber stated this area is a mini conservation area that is not available anywhere in this valley and the educational benefits for youth are extensive. Mr. Raingruber stated Lodi Lake and Pigs Lake is a getaway for the community as well as a tourist attraction. Mr. Raingruber feels that rip rap should be put in the area to stop the erosion. Mr. Rodems gave an update on the status of Pigs Lake. Mr. Rodems stated the State is very reluctant to allow rip rap to be put in the water. This project is number one on the list of the "One Voice" projects that go to the government. Applications for grant monies continue to take place. Commissioner Wardrobe -Fox recalled from the architects report that because of the construction up stream it has changed the flow of the water near Pigs Lake. Mr. Dutra will be attending the Lower Mokelumne River Watershed Committee meeting to discuss possible funding for this project. Commissioner Akin was overwhelmed with how beautiful the Grape Bowl is. Commissioner Akin thanked Mr. Rodems for all the work that has been done at this facility. Mr. Rodems thanked staff for their hard work on this project. Commissioner Sasaki asked how the turf held up during the rain. Mr. Reese stated the field played very well during the in climate weather from the previous weekend's games. Mr. Dutra stated that his staff performs pre event and post event inspections of the turf. Mr. Dutra stated that the expectation is that users remove all items that they bring in. Commissioner Wardrobe -Fox plugged the upcoming CPRS conference. Mr. Dutra invited the Commissioners to attend a community outreach meeting tomorrow at Larson School shared that Tree Lodi will be having a to gain volunteers to plant 200 - 280 trees next year in DeBenedetti Park. Commissioner Akin asked if the two tier system is now in effect. Mr. Rodems stated it's been in effect since January 1, 2009. Mr. Rodems stated the BOBS fees are not reviewed by staff however the administrative fee associated with those programs can be looked at and adjusted by staff. Ms. Miller had an idea about putting in additional culverts while the Lake is drained. Mr. Dutra shared his conversations with Ms. Miller on this subject and he stated he's given Ms. Miller additional City resource names regarding this issue as well. Mr. Rodems explained restrictions that are placed on these types of projects by the State as well as some of the issues the City would like to address at the Lake. Commissioner Wall asked Mr. Dutra if the restrictions from the Lake to the river were removed does the Lake then become an open waterway. Mr. Dutra stated the river is not in the City's limit and the Lake is therefore the County is the agency in charge of the river. Commissioner Sasaki discussed Parks and Recreation staff person, Leann Brunet, and the possibility of putting Ms. Brunet on full time after 13 years as a part time employee. Mr. Rodems discussed the position, what transpired with this position, and what he'd like to do in the future with this position. Commissioner Wall understands and respects Commissioner Sasaki however he feels that discussion of personnel is not something that should take place in this forum. Commissioner Wardrobe -Fox asked if the City is doing anything with Prop 84. Mr. Rodems stated the paperwork has been submitted for Prop 84 and it's waiting at the State level. Mr. Rodems shared that there has been communication with the State regarding projects being completed with grant funding. Regular Agenda — Discussion Items Grape Bowl Plans Mr. Rodems introduced this item and covered the following points: • The first phase demolition plan would be presented to Council 2/18/09. Demolition funding would come from CDBG funding to support a 12,000 seat facility. • Option 2 is the most accepted plan for costing purposes. The first phase demolition plan must be approved by 2/18/09. • Demolition is consistent between all three options. Lighting upgrades will be discussed at the next Commission meeting. • No asbestos or lead was detected and therefore no abatement work was necessary. • Synthetic turf life was approximately 10-15 years with an $80, 000 replacement cost. Maintenance/preparation costs were comparable. Synthetic turf will be covered to protect from damage. • New soil would have to be brought in possibly from Pixley Park for the option of semi -pro football use. • No maintenance dollars have been added in. • A business plan will be developed as of completion of phase one. • The seating costs included the additional ADA requirements through phase 1 that would include funding of $740,000 for accessible seating. • Having a neutral site/facility that is not in LUSD property will reduce vandalism, will increase revenues from professional use. Changes to the Joint Use Agreements will be forthcoming. • $1.3 million lighting impact -funding loan of $1 million from impact fees, borrowing from parks funds, donations, CDBG funding, generated revenue, and loan to RDA will generate funding. Commissioner Wall asked if 2010 is the drop dead date for ADA compliance. Also, what is the deadline date to receive San Joaquin County funding? Mr. Rodems will bring this information back to the Commission at the next meeting. Commissioner Long asked to verify the amount of San Joaquin funding available and if $150,000 had been taken away from available San Joaquin County funding because of budgetary issues. Mr. Rodems would put Lodi in the upper end of median, low end of the good at this point in time in regards to the effects on our department and generally everyone is taking cuts. A Shirtsleeve site visit is scheduled for April 14 at 7:00 a.m. Mr. Rodems is asking the Commission to approve the loss of 3.31 acres into the basin and this would allow staff to start development of the 11.78 acres of field space. Commissioner Wall asked if there's been any indication from the BOBS that they have any concerns with the loss of the 3.31 acres. Mr. Rodems stated he's heard nothing from the BOBS. Commissioner Wall would like it communicated that we're not losing activity space, we're just moving dirt. Commissioner Long asked if the Council would like Commissioners to attend the April 15th meeting. Mr. Rodems stated that was the directive from the Council that there be a Commission presence at that meeting. Mr. Rodems would have to discuss the possibility of bringing this issue up with the City Manager. Commissioner Akin feels this may be the appropriate time to discuss it with the budget issues as they are. Mr. Rodems stated he can discuss this topic with the City Manager and bring it back to the Commission at their May meeting. Commissioner Wardrobe -Fox is in favor of looking at this issue again. Commissioner Akin attended the Arbor Day event and he feels it was a magnificent success. Commissioner Akin commended Mr. Dutra on his hard work and the success of this community event. IV. Action Items IZIMOUK V. Regular Agenda — Discussion Items Funding Research Mr. Rodems introduced this item. Mr. Rodems obtained information on this issue from "The California Municipal Revenue Sources Handbook 2008". The two ways that additional revenue can be obtained is through sales and use tax or a parcel tax. The soonest this issue could go to the public is the 2010 general election. If you choose to move forward and select a committee, City staff is unable to participate in on committee. Commissioner Long asked if the Council can put this item on the ballot or does it need to go by signature. Mr. Rodems stated the Council could put it on the ballot or it could go on by signature. Commissioner Long has been involved in this process for the City of Stockton and it's extremely difficult for it to pass. Action Items Delta Velo Bicycle Race and Festival Mr. Rodems introduced this item. Mr. Rodems asked the Commissioners to discuss this item and take action tonight on the Delta Velo Bicycle Race. Grace Malson introduced Dominic Brooks and Damien Gonzalez from Delta Velo Bicycle Team. They plan on approximately 2,000 spectators and over 500 professional bicyclists. Ms. Malson feels this event will have a positive impact on the downtown area. Dominic Brooks — Race Director for Delta Velo. The race is scheduled to be in downtown Lodi. Mr. Brooks stated these races would be similar to races that have been held in Davis and San Luis Obispo. Mr. Brooks would like to see Lodi be a stop on the AmGen Tour of California as Davis and San Luis Obispo have been. The racers range from amateurs to professional racers along with a children's event for under 13 year olds. Mr. Rodems stated there have been a number of pathways laid out for this race. The map that the Commission has is a revised map after discussions with the Downtown Lodi Business Partnership (DLBP). The DLBP tried to mitigate some of the impact they see from downtown events and provide better access to businesses even though part of the downtown will be closed for the race. Mr. Rodems and Mr. Brooks had a discussion of this map prior to tonight's meeting and they didn't see a huge issue with the outline of the course as long as it achieved the goals of the organization and it does not additionally impact the adjacent residencies. Mr. Rodems also stated that the Parks and Recreation Department is doing this race in partnership with the Delta Velo organization as an inaugural event to try to start bringing in more events into Lodi under the umbrella of an event arm of Recreation. Our involvement allows Delta Velo to bring their costs down and Recreation allows Delta Velo access to our equipment as well as our name will go on all the materials as a co-sponsor. The goal of the Recreation Department is to bring events into Lodi that will increase revenues for the City. Commissioner Sasaki asked for history of who has been presented with the idea of this proposed race. Mr. Brooks stated that most if not all shops along the proposed race route have been contacted by Mr. Gonzalez and the DLBP has endorsed this particular course as well as the event itself. The Fire Marshall's concern was closing Church Street down completely. However the new race route will allow for north and south bound traffic on Church Street. Mr. Gonzalez stated his concern was parking for the churches on the west side of Church Street so Delta Velo has freed up the big parking lot so it won't impact parking. Commissioner Sasaki asked if the City would be liable for any issues. Mr. Rodems stated that Delta Velo has been asked to provide liability insurance by the City in addition to coming under the Parks and Recreation Department umbrella as a co-sponsor. Mr. Gonzalez stated that all racers participating in this event sign a liability waiver that frees up the racing organization as well as the City of any liability. The racers are also covered with insurance through USA Cycling as well. Mr. Rodems stated that the City gave Delta Velo their insurance requirements and the additional liability coverage's are acceptable to the City. She also feels that money needs to be spent on advertising and marketing to make this market a success. She has heard from the community that they want the market. Commissioner Akin asked what Ms. Sanders vision is for a successful market. She hears from people who go to the Market that they hadn't heard about the Market. Commissioner Long asked how many vendors are there. Ms. Sanders said it's down to two vendors, DePalma Farms and Parma Farms. Commissioner Wall feels there's a lot of advertising that can be done without spending a lot of money (i.e. partnering with the GrapeLine, go out to senior housing. Ms. Sanders also suggested senior vouchers and WIC coupons through the State. Ms. Sanders is willing to help coordinate the market for next year. She states it needs to start in January. Todd Nortman, 20201 Windwood Dr., Woodbridge — Mr. Nortman represents Parma Farms. Mr. Nortman stated they'll be back next year. Mr. Nortman said a few key things would be constant communication with the vendors and advertising. Mr. Rodems explained some of the issues that were encountered in starting this project. Comments by the Public, Commission and Staff on Non -Agenda Items Additions to Agenda David Shorts, 661 Louie Ave., Lodi — Mr. Shorts distributed a flyer to the Commission. Mr. Shorts would like a designated park space for use by park flyer electric aircraft. Mr. Shorts explained these aircraft are less than 2 lbs. in weight and go less than 60 mph. Mr. Shorts feel that a special area with certain times designated for flying of aircraft will allow people who fly planes at other areas (i.e. Target and Walmart) to have a safe area to utilize. He recommends having a partnership with Academy of Model Aeronautics for the purpose of liability as well as a liaison for people in the community. He also recommends that each flyer have an insurance policy of $500,000 in case there was ever an accident. Commissioner Wardrobe -Fox asked if this was a program where lessons could be taught. Mr. Shorts feels this is something that could be done. Commissioner Long feels that Mr. Shorts should work with staff on this issue. Mr. Dutra would be happy to have a conversation with Mr. Shorts regarding this issue. Commissioner Wall asked for an update on Century Park. Mr. Dutra stated Mr. Rodems was given a staff report as well as the City's Risk Manager. Mr. Dutra stated that based upon evaluation the westerly portion of the play structure is savable. The total cost of a limited replacement is $22,337. Mr. Rodems stated there is a $25,000 deductible through the City's insurance company. Mr. Rodems will take the report forward to the Risk Manager to look at the options through the City's insurance company in addition look for fund sources outside the Parks budget for replacement. Commissioner Wall asked that this item be added to the agenda for the November meeting. Commissioner Wall spoke with Tracy Williams of the Loel Center and they would be happy to get on board with Parks and Recreation for the Farmers Market and use of a senior coupon and shuttle service. Commissioner Wall asked that staff contact Ms. Williams. Commissioner Wardrobe -Fox asked about the lights at the Adult Sports Complex. Mr. Dutra stated there's no change of status from their phone conversation. Mr. Dutra stated that staff is at the mercy of other City departments for the appropriate equipment. Mr. Rodems shared that he has asked staff to give him the inventory for the boat house as well as the last 3 years of revenues, expenditures, and staffing to look at possibly partnering with another organization to run the facility. Mr. Rodems will be bringing this issue back to the Commission when all the data has been compiled. Commissioner Wall asked if Donna Phillips has moved away from Lodi Lake Park. Mr. Dutra stated she no longer lives by Lodi Lake Park. Commissioner Sasaki asked what the status is of the water treatment plant.
