Notice thereof having been published according to law, an
affidavit of publication being on file in the office of the
City Clerk, Mayor Hinchman called for the Public Hearings
to consider:
1) The Planning Camtission's recannendation that the City
Council approve the General Plan - Land Use Element No.
GPA -LU -86-1 which consists of three sections -
Subsection C - to redesignate the parcels at 15 and 17
Daisy Avenue, Lodi, from High Density Multiple Family
to Heavy Industrial. (Note: Sections 1 and 2 were
recaimended by the Planning Conuassion and Section 3
was an appeal).

The matter was introduc,=d by Canminity Development Director �
Schroeder who presented diagrams of the subject area and
responded to questions regarding the matter as were posed `
by the Council.
Speaking in favor of the matter was b"r. Ted Molfino, 831 E.
Pine, Lodi, who was representing the property owner Inez
Huppert.
The following persons spoke in opposition to the matter:
Mr. Bob Hesseltine, speaking on behalf of bars. Georgia S.
Anundson, 600 N. School Street, Lodi.
Mr. Larry Anundson, 1811 Normandy Lane, Lodi, speaking on
behalf of Mrs. Georgia 'S. Amundson, 600 N. School Street,
Lodi.
Mr. Glen Hinz, 801 Laver Court, Lodi.

There being no other persons wishing to speak on the •` 1
matter, Mayor Hirschman closed the public portion of the
hearing.
On' motion of Council Membar Snider, Olson second, Council
voted by unanimus vote to deny approval of General Plan -
Land Use Element No. GPA -LU -86-1 which consists of three
sections - Subsections
C - to redesignate the parcels at
15 and 17 Daisy Avenue, Lodi, from
High Density Multiple
Family to Heavy Industrial which
section was an appeal of
T. A. Molfino on behalf of Inez Huppert.

At its meeting of Monday, January 27, 1986 the Lodi City Planning
Commission denied your request on behalf of Inez Huppert for an
amendment to the Land Use Element of the General Plan by redesignating
the parcels at 15 and 17 Daisy Avenue from High Density Multiple Family
to Heavy Industrial. In denying this request Planning Commission
members expressed concern about permitting additional industrial
development into a residential area.
Since the Commission denied the General Plan Amendment it did not act
on the following items:
1. Your request on behalf of Inez Huppert to rezone the parcels at 15
and 17 Daisy Avenue from R -HD, High Density Multiple Family
Residential to M-2, Heavy Industrial; and
2. The filing of a Negative Declaration by the Community Development
Director on the General Plan and rezoning requests.
Section. 17.84.050 of the Lodi Municipal Ccde provides as follows:
"If the report of the Planning Commission recommends
disapproval of the proposed change or amendment or
reclassification, the applicant, upon notification of such
action may, within twenty (20) days thereafter, appeal to
the City Council."

Dear Ms. Reimche:
The Community Development Director's letter of 29 January 1986 advised that
the Lodi City Planning Commission had denied our request on behalf of Inez
Huppert for an amendment to the Land Use Element of the General Plan by re -
designating parcels at 15 and 17 Daisy Avenue from High Density Multiple
Family to Heavy Industrial.
This letter is our appeal to the City of Lodi Council for action to overturn
the Lodi City Planning Commission's denial of the rezoning application as
contained in our letter of 9 January 1986.

At its meeting of Monday, January 27, 1986 the Lodi City Planning
Commission recommended that the City Council approve your request on
behalf of Johnson Ranch, a General Partnership, to amend the Land Use
Element of the General Plan by—redesigrating a 4.0 acre parcel
proposed
for the northwest corner of Cherokee Lane and East Century Boulevard
from Commercial to Medium Density Multiple Family.
In related actions, the Planning Commission recommended that the City
Council:
1. Amend P -D (19), Planned Development District No. 19 by
redesignating a proposed 4.0 acre parcel at the northwest corner
of Cherokee Lane and East Century Boulevard from Commercial
conforming to the C -S, Commercial Shopping District to Multiole-
Family conforming to the R -GA, Garden Apartment Residential
District; and
2. Certify the filing of a Negative Declaration by the Community
Development Director as adequate environmental documentation on
the above projects.
