As per Council's dirf_ction, I have reviewed the agreement between the City of
Lodi and iCinq Videocable. I find nothing in the agree-rnnt loch would permit us
to regulate the cable cony's showing of hcc, shopping club type programs. The
agreEm'ent.and the City's Request. For Proposals required the cable television -firm
to have certain broad categories of progranining: however, there is nothing
therein that prohibits their sh(> ing on a particular channel, a particular type
of program.
As we learned early on in this field of regulation, the cable co:tpanies have
protection via the first amendment of our Constitution and it is therefore .very
difficult to regulate the type of programing that they may show on cable
television.
