Please accept this request for a rate increase, for you understand
in today®s inflation it is impossible to hold prices with the cost of
manpower, fuel and supplies used going up almost on a daily basis. We
have a responsibility to the people we serve to provide the best quality
service to the sick and injured that is humanly possible. To keep a
high standard today, we must keep current with our equipment and man-
power. Paramedics are professional personnel trained to the highest
competency of all state and county levels of emergency field medicine.
To keep the professional paramedic, we must compensate them for their
knowledge, skills and time so that we do not lose quality trained per-
sonnel to other cities.
With all of these demands upon the company, we find it necessary
to request an inflation increase to our present rate structure. A cost
projection of 23% inflationary raise would enable us to stay at a level
of professional service that our community now enjoys. This still would
bring us below the state average of cost of service, but place us high
in quality for the services the people receive. As always, we will do
all possible to hold cost to the best interest of the people we serve.

between the City of Lodi and the ambulance service operating hist
Attached for your information is a copy of City Code Section 2A-1 et
seg. regaxding the operation of ambulance vehicles within the City of
Lodi. The relationship of the City of Lodi to the arkulance r aniy
is one of the City, thresh its police power, licensing the dance
cmpany within the City of U�di.
Basically, an ambulance conpany which inks to operate in a city is
required to file for a permit to operate. The City Council would then
conduct a hearing regarding the mead and necessity for the propr8ei
service in the City of Lodi and the qualifications of the parti..-ular
ambulance company to serve the citizens of the City.
As to the issue of the rates to be charged by the ambulance any,
the City's position appears to be one of non --regulation except where
there appears to be a need to regulate the ambulance company in
changing rates to the citizens of the City of Lodi. Section 2A-3 per-
mits the City Council to fiscally determim and fix the rates to be
charged by the operator if they so choose. Other cities, such as
Stockton., set the rates after a long and arduous procedure requiring
any meetings between the ambulance conpany and the City Council to
determine the adequacy of the rates. The City of Lodi's position
allows the City Council to set rates if there is a need, but des not

For the purposes of this chapter, the following words and phrases
%hail have the meanings respectively ascribed to there by this section:

Sec. 2A-2. Establishment of rules and regulations for opera-
tion and maintenance.
The city council by maolution may prescribe rules and regulations
for the operation and maintenance of ambulance service. (Ord. No.
756, 3 14.)
Sec. 2A-3. Rate schedule to be filed; adherence to rate sched-
ule required.
The owner of every ambulance operating in the city shall file, with
his application for an operator's permit, a true and correct schedule
of rates to be charged for the transportation of passengers in all ve-
hicles operated by such owner. Such rates shall not be changed or
modified in any manner without first filing the chi r ged or modified
rates with the city council thirty days prior to the effective date of
such change or modification.
The city council reserves the right to finally determine and fix, by
resolution, the rates to be charged by the operator of the ambulance
service. (Ord._ No. 756, J 13.)
Sec. 2A-4. Only licensed ambulance drivers and atter�danta
to be employed by ambulance service.
Each permittee and ambulance opemtov under this chapter shall
employ only those persona who have obtained an ambulance driver's
or attendants permit issued by the department of motor vehicles of

It shall be unlawful for any person to engage in the business of
operating an ambulance in the city without first securing a permit so
to do from the city according to each and every requirement of this
and without emplying with each and every regulation con-
tained in this chapter pertaining to 0business of carrying or tr=8-
porting wounded, injured or sack persons for hire. (®rd. No. 756,

No ambulance operator's permit shall be required of any person
who delivess but does not pick up wounded, Injured or sick persons in
the city or of any person who picks up wounded, injured or sick per-
sona in the city to deliver to a point outside the city. (Ord. No. 756,
12.)
Sec. a7. Applicat ; fee.
Any pennon desiring to obtain the permit required by vection 2A-5,
shall pay a fee of ten dollars to the city cleric, and shall make appli-
cation for such permit to the city council. 'Duna application shall be
signed by the applicant and shall set forth:
(a) The name, businm and address. of the applicant.
(b) '11e name and address of the owner of the ambulance busi-

(e) The color scheme, insilmia, name, monogram or other dis-
tinguishing characteristics to be used to designate the private
ambulance or private ambulances of the applicant.
(f) °The location and description of the place from which the
business is intended to operate and the vehicles are to be
stored.
(g) The schedule of rates proposed to be charged for ambulance
service.
(h) The experience of the applicant in the transportation of
grounded, injured and sick persons.
(i) The fact that all operators of ambulances shall hold ambu-
lance drivers' certificates issuee by the department of motor
vehicles of the state.
( j) Any Facts which the applicant believes tend to prove that pub -
lie convenience and necessity require the granting of a per-
mit and such other information as the city council may rew
quire. (Ord. No. 756, § 3.)
Sec. 2A-8. Investigation; fingerprinting and photographing of
applicant.
Upon the filing of an application for an ambulance operator's per-
mit, the city clerk shall direct the chief of police to cause an investign.

filing; of the application. 'Ilse chief of police shall require the ap-
plicant or any person named in the application to be fingerprinted and
photographed. (Ord. No. 756, J 3.)
See. 2A-4. Council hearing to determine public convenience
and necessity—Required.
Upon the filling of a fully completed application for a permit to
engage in the business of operating an ambulance, and receipt of the
report of the chief of police, the city clerk shall present the application
to the city council Who shall fix a time for a public hearing; thereon
for the purpose of determining; whether the public convenience and
necessity require the proposed service. No permit shall be granted
until the council shall, after investigation and hearing;, declare by res-
olution that the public convenience and necessity require the proposed

rvice and that the same will promote the convenience, safety and
welfare of the general public. (Ord. No. 756, § 4.)
Sec. 2A-10. Sarno—Notice.
Notice of the hearing required by section 2A-9 shall be given to
all persons to whom permits for operation of ambulances have been
theretofore issued. Notice of the time and place of the public hear-
ing before the city council shall also be given to the general public
by causing a notice of such hearing to be published in a newspaper
of Wmeral circulation in the city. One publication shall be made at
least five days befom the hearing. (Ord. No. 756, J 5.)
«11. Liability Insurance mquirecl.
No ambulance operators permit shall be rued or eantinued in
operation unless there 1.s in full force and effect a policy of insurance

Insurance company approved by the city attorney, whereby the owner
and the driver of each of the vehicles described in such permit are
Insured agsipst liability for damage to property and for injury to or
death of any person as a result of the ownership, operation or other
use thereof, the minimum liability limits upon each such vehicle be-
ing not less than one hundred thousand dollars on account of personal
injury to or death of any one person in any one accident and two hun-
dmd thousand dollars on account of personal injuries to or death of
two or more persons in any one accident, and the minimum liability
limits upon each such vehicle being not less than fifteen thousand dol-
lars for damage to or destruction of property in any one socident.
Such policy of insurance shall contain sin endorsement providinIF that
the policy will not be cancelled until notice in writing shall have
been given to the city addressed in care of the City Clem, City Hall,
Lodi, California, at least ten days immediately prior to the time such
cancellation shall become effective. (Ord. No. 756, 1 12.)
24.12- Prerequisites 4o issuance.
Upon completing its investigation and hearing pursuant to section
2A-9 the city council shall grant the applicant an ambulance operatoes
permit if it finds:

(b) That the color scheme, insignia, naive, monogram or other
distinguishing characteristics proposed to be used upon such ambu-
lances is not in conflict with and does not imitate any color scheme,
insignia, name, monogram or other distinguishing characteristics used
by any other person in such manner as to mislead or tend to mis-
lead, deceive or defraud the public.
(c) That further ambulance service in the city is required by the
public convenience and necessity and that the applicant is fit, willing
and able to perform ambulance service and to conform to the provi-
sions of this chapter and such rules and regulations as may be pro-
mulgated by the city council. In malting such finding the city coun-
cil shall take into consideration the number of ambulances already in
operation, whether existing ambulance service is adequate to meet
the public need, the probable effect of increased ambulance service on
local traffic conditions and the character, experience send responsibility
of the applicant. (Ord. No. 756, § 6.)
Sec. 2A-13. Issuance; contents.
If the city council, by resolution, shall find and declare that pub-
lic convenience and necessity require the proposed ambulance service
or will admit additional ambulance service, a permit to that effect
shall be issued by the city clerk to the person entitled thereto, and
the city council in its discretion shall determine the total number of
ambulances which may be operated under such permit. The permit
when issued shall state the name and address of the applicant, the
number of ambulances that may be operated under such permit and
the date of issuance thereof. No permit authorized under this article
shall be issued to any person who shall not have fully complied with
all the requirements of this chapter (Ord. No. 756, ii 2.)
An ambulance operator's permit issued pursuant to this article shall
continue to be valid from the date of issuance until the conditions
stated in the application have been changed or the permit is suspend-
ed or revoked by the city council for any of the reasons set forth in
this chapter. (Ord. No. 756, § &.)

has been issued desires to sell or transfer his business, the interested
bu;er or transferor shall make application for an ambulance opertitoes
permit as required by this article accompanied by an affidavit of
seller of intention to surrender and cancel the permit held by such
ambulance operator conditionally upon and concurrently with con-
summation of such We and issuance of a permit in the tiame of the
buyer. If a buyer -applicant or tranferee-applicant for a permit meets
all the requirements set forth in this chapter for issuance of an am-
bulance operators permit, the city council shall issue a new permit
to the buyer-appli�caat and concurrently therewith cancel the seller%
permit. (Ord. No. 756. 1 10.)
Any person holding a permit to operate one or more ambulances
as provided in this chapter who desires to change or amend such per-
mit to substitute a different vehicle or :add another vehicle for a ve-
hicle operated under such permit shall do to only when them has been
obtained permission therefor from the city clerk. Such permission
shall be granted upon written application setting forth the ,particulars
of such proposed substitution or additions, and upon otherwise com-
plying with the requirements of this chapter. (Ord. No. 756, ; 11.)
Sec. -1 B. Daily operations of ambulance service eequirod;
failure grounds for revocation of permit.
Every person to whom an ambulance operator's permit has been

of the license year to the extent reasonably necessary to meet the
public demand for such service. upon an ambulance operator% fall-
ure to provide such service, the city clerk may, upon £stns days' writ-
ten notice to the holder of such permit, and unbar good and sufficient
cause for such abandonment is evidenced, revoke such permit. (Ord.
No. 756, 1 15.)
Sec. -18. Revocation or suspension--- City council.
The city council may at any time revoke, suspend or change, after

attendant fails to operate at! ambulance authorized tender this

law and this chapter. All permits which shall have been sus-
pended or revoked by the city council shall be surrendered to
the city cleric and the operation of all ambulances covered by
such permits shall cease, and the continued operation thereof
shall thereafter constitute a violation of this chapter. (Ord. No.

Sec. 2A-19. Same --Chief of police.
The chief of police may suspend or revoke any ambulance
operator's permit upon finding that the permit holder no longer
complies in full with the conditions of this application and this
chapter. (Ord. No. 756, § 16.)
