C"--,±cil was apprised that in the 1982-83 Capital
Iuprovem-rt, the City Council authorized the procurement of
the right -cif -way for construction and the reconstruction of
Hutchins Street between Kettleman Lane .and Rimy Avenue and
the upgrading of the traffic signal at Yettleman and Hutchins.
In order to procu•_e the right-of-way, the City hired Mr. Craig
Hubbard to provirle appraiF-ils and Mr. Charles Ferguson to act
as our right-of-way agent. The first of the three parcels has
been acquired at the appraised cost.

SUBJECT: South Hutchins Street Right of Way - Pentecostal Church
RECOMMENDED ACTION: That the City Council authorize the City Manager and
City Cierk to execute any necessary documents for right-of-way acquisition
on South Hutchins Street between Kettleman Lane ani Rimby Avenue.
BACKGROUND INFORMATION: In the 1981-83 Capital Improvement, the City Council
aut r zed the procurement of right of way for construction and the recon-
struction of Hutchins Street between Kettleman Lane and the upgrading of the
traffic signal at Kettleman and Hutchins.
In order to procure the right of way, we hired Mr. Craig Hubbard to provide
appraisals and Mr. Charles Ferguson to act as our right-of-way agant. The
first of the three parcels has been acquired at the appraised cost and as
shown on the attached agreement. We recommend the approval of this agree-
ment and recommend you authorize the City Manager and City Clerk to execute
same for the City. At the same time, we would recommend that you authorize
the City Manager and City Clerk to execute like agreements on the other two
parcels as we reach agreement with the owners.

RIGHT-OF-WAY AGREEMENT
510 W. Rimby Avenue - Pentecostal Church of God

THIS AGREEMENT entered into thisQday of �- I �[ 1983,
by and between PENTECOSTAL CHURCH OF GODERICA,NORTHERN DISTRICT OF
CALIFORNIA, INC., hereinafter called Grantor, and the CITY OF LODI,
hereinafter called City.
WITNESSETH:
1. Grantor has granted to the City and the City has accepted a grant
deed and a deed of easement for portions of that certain real
property, commonly known as 1333 South Hutchins Street, and as
shown on the attached sketch.
2. City agrees to pay Grantor the sum of $2245 for the grant deed.
3. City agrees to pay all title, escrow and recording fees.
4. Both parties agree that they have herein set forth the whole of
their Agreement. The performance of this Agreement constitutes the
entire consideration and shall relieve City of all further
obligation or claims.
5. This Agreement is binding on the heirs, executors, administrators
and assigns of the parties hereto.
6. The check is to be made payable to Pentecostal Church of God of
America, Northern District of California, Inc..
IN WITNESS WHEREOF the parties have execute this Agreement the day and
year hereinabove written.
