BACKGROUND INFORMATION: With the voter approval of Proposition 1 B, several classifications of funding were established by the California Legislature. One of the funding programs, Public Transportation Modernization, Improvement; and Service Enhancement Account (PTMISEA), provides funds for capital improvements. Assembly Bill (AB) 1072 (effective October 11, 2009) established the PTMISEA funding process. In accordance with AB 1072, PTMISEA recipients are required to submit a Program Expenditure Plan to Caltrans Division of Mass Transportation. The Program Expenditure Plan lists the projects using PTMISEA funds for the life of the transportation bond, FY 2009/10 through FY 2016/17. The Program Expenditure Plan was approved by City Council on January 20, 2010 and submitted to Caltrans. The City of Lodi receives PTMISEA funds directly from the State (Caltrans) and, through a discretionary process, from SJCOG. The City of Lodi will receive from Caltrans a total of $164,145 from FY 2009/10 through FY 2016/17 that the City plans to spend on bus replacements. The Program Expenditure Plan includes a total of $2,810,000 programmed for Lodi through the discretionary process from SJCOG. SJCOG will receive a program total of approximately $23 million to distribute at their discretion among eligible transit providers including Lodi, Escalon, Ripon, Tracy, Manteca, the Regional Transit District, and the Regional Rail Commission. SJCOG and the Interagency Transit Committee collaboratively determined the funding distribution amongst eligible agency applicants. The grant documents (PTMISEA Program Expenditure Plan Amendment No. 1) proposes a revenue neutral funding exchange between the Automated Farebox Phase 1 and 2 projects programmed in FY 10/11 and 11/12 with the bus replacement project for 12 cutaways and four large buses programmed in FY 13/14. This amendment will provide matching funds to expedite the delivery of the bus replacement project funded through a Congestion Mitigation and Air Quality (CMAQ) grant. Caltrans requires a Program Expenditure Plan amendment to reflect the intended use of funds. The City of Lodi received $450,000 toward the automated farebox projects in June 2012. A portion of these funds ($405,000) will be used as the local match to the CMAQ funds on the bus replacement project. The balance of $45,000 will remain on the Automated Farebox Phase1 project and the Phase 2 project will be delivered as additional bond revenue is allocated. Program Expenditure Plan Amendment No. 1 is presented in Exhibit A. A Council resolution for this amendment is required as part of the submittal package and allocation request. Failure to adopt the resolution and exchange funds will result in delaying the bus replacement project and potentially losing the CMAQ funds.
