PROPOSED REVISION 11/18/80
The following Rules and Regulations for the
Implementa:ion of Environmental Health Permit
Fees and Service Charges were established by
the hoard of Trustees by Resolutions No. 79-18,
79--35, 79-46, and 80-•1,2.
Section 100 DELINQUENCY -DATE, shall mean: in the case of newly
established business or activity at any location, any day or date
du,-ing which an operation has commenced or begun without first
having obtained an Environmental Health Permit; and in the case of
businesses or actiivLties at any one location pursuant to regulations
hereinafter resolved, which qualifies for a renewal of Environmental
Health Permit, July 31 or January 31, in accordance with the Period
of Environmental Health Permit Section
Section 101 DISTRICT HEALTH CFFIC!`:R, shall mean the Health Officer
of the San Joaquin Lowe-�eaTiTvisrrict, County of San Joaquin, or
his designates.
Section 102 BOARD OF TRUSTEES, shall meari the governing Hoard. of

Section 103 PERSON, stall me,i: an•' individual, partnership, firm,
corporation, u6inc�ss, activity or combination thereof.
Section 104 ENVIRONMENTAL 1iE,,%L H PERMIT, hereafter ter-med "Permit"

who may conduct any business, occupation, or other activity herein-
after regulated; the foruz c` which is to be established by the DISTRICT
HEALTH OFFICER and uniformly applied to all PERSONS: and such Permit
shall be subject to regulations hereinafter set forth; and such
Permit may be suspended oi. revoked in accordance with Section 307
of this regulation. Suc!A Permit shill remain the expressed property
of the San Joaquin Local Health District, and shall be prominently
displayed in public view during all hours of any business, occupation
or activity of any PERSON, at the place of such business, occupation
or activity of such PERSON, in accordance with the direction of the
DISTRICT HEALTH OFFICER.

Section 155 SANITARY FACILITIES AND FOOD PROTECTION - Every road-
side stand, mo i e and itinerant o0 (pent -on, a"nJ vending vehicle
shall obtain permission in notarized writing to use any location
and submit such attestatiert-e€ permission from the property owner,
or beneficiary of record to the District Health Officer prior to re-
ceiving any con§ideration of permit issuance. Said operations or
Persons shall locate such as to be within one hundred (100) .feet
of an approved restroom facility equipped with appurtenances as

Code., and such Persons shall obtain permission in notarized writing

Section 157 Milk dispensing units shall be assessed on a flat fee
basis, and multiple -heed dispenser units at an additional prescribed
rate for each dispensing container (head) in addition to the one in-
cluded in the base fee.

Section 200 FILING OF APPLICATION FOR ENVIRONMENTAL HEALTH PERMIT
Every person, rm, partners ip or corparat on with t e oun ar es
of the San Joaquin Local Health District: and speci,-ically regulated
thereby, shall apply .for a Permit, and for a renewal of a Permit
when one has been previously revoked or suspended, or for renewal of
an expired Permit and shall, at the time of making application on
forms provided by the San Joaquin Local Health District, remit the
appropriate fee in accordance with the fare schedule contained herein.

Section 201 EXEMPTION FROM HEALTH PERMIT FEF.
1. Any organization which conducts exclusively for charitable pur-
poses an acitivity for which a permit is required under these
Regulations and, which is exempt from the payment of income taxes
by ruling of the Director of Internal Revenue Service, shall not
be charged any fee for such permit. Such ruling of the Director
of Int=ernal Revenue Service shall be supplied to the EnvironmentaBl
Health Division by such affected applicant.
20 Political Subdivision. No fee shall be charged pursuant to these
Rules and Regulations to any political subdivision of the State of
California for inspection of any property or facility owned or op-
erated by such political subdivision, except as provided in Section
6103.11 of the Government Code (Official fees or service charges
under the Solid Waste Management and Resource Recovery Act). No
fee -exempt political subdivision shall operate facilities for which
inspection is required wiLhouk- a valid Health Permit,

Section 301 PRORATION OF FEES -- Every person, firth, partnership,
corporation, uszness or otter subject entity who becomes subject to
this regulation shall apply for a Permit and shall prey a fee in
accordance with those set by this or subsequently adopted regulation;
for the purpose of proration of fees for entities subject to an annual
fee but whose operation commetlses and continues to operate during a
period less than 12 months, such entities shall pay a prorated annual
fee for any portion of the following proration time schedule:

Section 302 PENALTY - All fees shall be due and payable on the first
business day o e month indicated in the foregoing Period of health
Permit, and such fees are receivable for a thirty (30) calendar day
period following the due and payable date.
Fees charged in this regulation which are not received or post marked
within the thirty (30) day period following the due and payable data
shall be increased by 50% for the following thirty (30) dray period,

constitutes a separate violation of locally applicable state law,

double annual gee, and any extra ordinary cost of collecting such

1. Companies requesting mul.ti.ple permits for which lacer
Quality Assurance lees or Liquid Waste Services Fees
are charged may he billed on a monthly basis. Any such
monthly billing which remains unpaid more than thirty (30)
days beyond the killing date shall be subject to a 101
penalty on the unpaid bal;ince.
Section 304 SEPARATE ACTIVITIES If a person engages in, conducts,
manages, , r carries on at�tewseme tirr,e more than one of the activities
for which a Permit is regitired l)v this Regulation, such person shall
be deemed to be enga,ed ai conducting, managing, or carrying on each
such activity separately ,nd apart from the other such activity and a
separate permit shall be pro4ured for each activiLy, whether located
on the same premises or noc, (except in eases specifically sited in
these Regulations),

For seasonal swimming pool operations at which multiple
service categories, also seasonal in operation, are sub-
Ject to permit, each additional service category permit
fee shall be reduced to ?CJI, of the es- ablished fee base
for such additional service category.
Board of Trustees shall uphold or reverse the denial of the applica-
tion or of the approval sought and shall make such orders in connec-
tion with the matter as may be necessary to protect and preserve
the public health in accordance with applicable laws, Codes,
Ordinances and Regulations but in no event may have the power to
countermand Federal, State or Local law, codes or ordinances;
the appeal of which will not be Beard,
Section 309 ENFORCEMENT BY DISTRICT HEALT1{ OFFICER -- The District
Health Officer s a en orce a nee u or ers, rules and regula-
tions necessary or proper to accomplish the purposes of these
Regulations, and may perform all other accts necessary or proper to
accomplish the purposes of this Division. No portion of these
Regulations shall be interpreted to exempt any person from action
initiated by the San Joaquin Local Health District as may be required
in the enforcement of State laws, regulations or local Ordinances, ,
If any provision of these Rules and 9.0.gulations or the application
thereof to any person or circumstances, is held invalid, the re-
mainder thereof and the application of such provisions to culler
persons or circumstances, stall not be affected thereby.

Notice is hereby given that a public hearing will be held on
Tuesday, February 17, 1981, at 8:00 P.M., in the hoard of Trustees
Conference Room of the San Joaquin Local Health District, 1501
East Hazelton Avenue, Stockton, California.
Said public hearing will be on the proposed revision of the Rules
and Regulations for the Implementation of Environmental. Health
Permit Fees and Service Charges, and proposed revision of fees
affecting Housing Hygiene, WaLer Quality Assurance, Recreational
Health, Liquid Waste, Vector Control, Solid Waste, Miscellaneous
Changes, Professional Consultation and flan Checking, which Rules
and Regulations and gees were established by Resolution No. 79-18,
as amended by Resolutions No. 79-35, 79-46, and 80-42, and pursuant
to provisions of San Joaquin County Ordinance No. 2065 and Board
of Sup. rvisors Resolution No. 79--931.
The proposed revision of the Riiles and Regulations and the proposed
revision of Lhe inspection and permit fee schedules will be on file
ten (10) days prior to the hearing at the Environmental Health
Division, San Joaquin Local Health District, 1601 East Hazelton
Avenue, Stockton, California. Any interested party may view said
documents and may submit comments and suggestions, in writing,
concerning the proposed service and permit fees or regulations.
Written comments for consideration may be sent to the San Joaquin
Local Health District, P.O. Box 2009, Stockton, California 95201.
