AVENUE REZONED with law and affidavit of publication being on

McCarty called for the public hearing to consider
the Planning Commission's recommended approval of
the request of Aladdin Real Estate on behalf of
Glen and Hazel Houston to rezone the parcel at i
820 South Cluff Avenue (i.e. APN 049-070-14) from
R-1, Single -Family Residental to M-1 Light Industrial
and certification of the filing of a Negative
Declaration on the project by the Community
Development Director. j
ORDINANCE NO. The matter was introduced by Community Development
1251 INTRODUCED Director Schroeder, who presented diagrams of the
subject area and responded to questions as were
posed by the Council.
Speaking on behalf of the proposed rezoning was
Mr. Jim Gerard, Aladdin Real Estate, 330 South
Fairmont Avenue, Lodi.
There being no other persons in the audience
wishing to speak either in favor or in opposition
to the matter, the public portion of the hearing
was closed by Mayor McCarty.

Further; Mayor Pro Tempore Murphy moved for
introduction of Ordinance No. 1251 - Ordinance
amending the Official District Map of the City of
Lodi, thereby rezoning the parcel at 820 South
Cluff Avenue (i.e. APN 049-070-14) from R-1,
Single -Family Residential to M-1, Light Industrial.
The motion was seconded by Councilman Pinkerton
and carried by unanimous vote.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODI,
CALIFORNIA DECLARING A NEED FOR AN INDUSTRIAL DEVELOP-
MENT AUTHORITY TO FUNCTION IN SAID CITY AND DECLARING
THE CITY COUNCIL OF SAID CITY TO BE SAID AUTHORITY
This Ordinance will establish an Industrial Develop-
ment Authority in the City of Lodi, California in
accordance with provisions of the California Industrial
Development Financing Act, California Government Code
Section 91500 et. seq., for the purpose of exercising
powers granted by the Act.
Read for the first time by the City Council of Lodi,
Califdrnia on February 24, 1982 by the following vote.
Ayes: Councilmen - Hughes, Katnich, Murphy,
Pinkerton, & McCarty
Noes: Councilmen - None
Absent: Councilmen - None
A copy of the full test of the Ordinance i• available
in the office of the City Clerk of the City of Lodi
and will be presented to the City Council for Adoption
at an Adjourned Regular Meeting of the Council on
March 10, 1982.

AN ORDINANCE OF THE CITY OF LODI,
CALIFORNIA, DECLARING THE NEED FOR
AN INDUSTRIAL DEVELOPMENT AUTHORITY
TO FUNCTION IN SAID CITY AND DECLARING
THE CITY COUNCIL OF SAID CITY TO BE
SAID AUTHORITY

The City Council of the City of Lodi, California
DOES ORDAIN as follows:
Section 1. In accordance with the California Industrial
Development Financing Act (Title 10, commencing with Section 91500,
of the Government Code of the State of California) (the "Act"),
this City Council hereby finds and declares that there is a need
for an industrial development authority to function in the City of
Lodi, California.
Section 2. This City Council hereby further declares that an
industrial development authority shall function in the City of
Lodi, California, in accomplishment of the purposes provided in the
Act, and to carry out and complete projects and perform and exercise
derivative obligations and powers as set forth in the Act.
Section 3. This City Council hereby further declares itself
to be the board of directors of such industrial development authority,
and all the rights, powers, privileges, duties, liabilities, dis-
abilities, and immunities vested in such a board under the Act shall
be vested in this City Council as such board.
Section 4. The authority established in the City of Lodi,
California by the Act and authorized to transact business and
exercise its powers thereunder by this Ordinance shall be known as
the "Industrial Development Authority of the City of Lodi, Calif-
ornia."
Section 5. The City Clerk shall certify to the passage of this
Ordinance, and shall cause this Ordinance to be published once,
within 15 days afters its passage, in the Lodi Life and Times, a
newspaper of general circulation in the City of Lodi. '
Section 6. This Ordinance shall becc:ae effective 30 days
afters its final passage.
