Central/408 Mission RECOMMENDED ACTION: That the City Council approve the attached agreement regarding the acouisition of land and authorize the City Manager and City Clerk to execute same for the City. BACKGROUND INFORMATION: The Buchanan% are splitting a oarcel at 1000 South Central into two ots, and in so doing, are dedicating additional right-of-way on Mission Street for possible future widening and/or a larger curb return at the intersection. The right-of-way encompasses some of the existing buildings, as shown on the attached agreement. In conformance with past action, it is recommended that the City Council approve the agreement regarding possible modification of the buildings. It is also recommended that the City Council consider a "�)lanket authorization" authorizing execution for like agreements where no other considerations are included. Such authorization would decrease paperwork and speed the approval of parcel maps and building permits by the Public Works Dep::rtment. Ja L. Buchanan, hereinafter called "Owner". W I T N E S S E T H Owner has filed for a Parcel Map of portions of Lots 4 and 5 of Wellswood Park, said Map being recorded in Book of Parcel Maps at page Instrument No. recorded In order to comply with the provisions of Section 22.18, et seg., of the Code of the City of Lodi, it is agreed as follows: 1. Owner is dedicating on said Map, the necessary land for the future widening of Mission Street. 2. City acknowledges that it is City's responsibility to modify the build- ings presently In the newly dedicated right--of-way at such time that City desires to widen Mission Street and agrees to modify the buildings at City's cost at such time as City deems it necessary to so widen Mission Street. 3. Owner aclnowledges. that in the event the buildings presently in the +newly dedicated right-of-way are intentionally demolished or damaged or partially destroyed by fire or any other calamity or act of God to the extent of more than f;fty per cent of its reasonable value at thy; i;me, no repairs or reconstruction shall ue made, unless every portion of much building is made to conform to all regulations of the district in whicl-, it is located. 4.
