AWARD OF SOFrBAU Council was apprised that on Wednesday, February 15, 1984
CONC.'ESSIM at 11;00 a.m. the following bids were received for the
CCNIRACF Softball Concession Contract:
RES. M. 84-016 1. Canteen Corporation 25% of gross sales after taxes
plus $1,000.00 of either product or merchandise to
be donated to any non-profit organization associated
with the Recreation and Parks Wapartment
2. Shirley Michaeloff and Gerald Seibel
20% of gross sales after taxes
Additionally, another bid was received from Naomi
Vandergriff - 34% of gross sales after taxes which bid was
determined to be irregular by the City Attorney.
Following discussion, with questions being directed to
Staff. Council, on motion of Council Member Pinkerton,
Murphy second, adopted Resolution No. 84-016 awarding the
Softball Concession Contract to Canteen Corporation at 25%
of gross sales after taxes, plus $1,000.00 of either product
or merchandise to be donated to any non-profit organization
associated with the Recreation and Parks Department. The
motion carried by unanimous vote.

SUBJECT: Softball Concession Bids
DATE: February 15, 1984
On Wednesday, February 15, on or before 11:00 a.m., two official
bids which met all requirements were received. Additionally, one
bid was received, which, in my opinion, is irregular and should
not be allowed.
The bidders and their bids were as follows:
1. Naomi Vandergriff
34% of gross sales after taxes
2. Canteen Corporation 25% of gross sales after taxes,
plus $1,000.00 of either product or merchandise to be
donated to any non-profit organization associated with
the Recreation and Parks Department
3. Shirley Michaeloff and Gerald Seibel
20% of gross sales after taxes
Upon receiving the bids, 1 would reconhmend Canteen Corporation be
,given the concession contract for the next five (5) years. I am
sure that with their experience, bucking., and over -ail general
abilities, they can and will perform in such a manner as to
represent the City in a quality fashion as well as create a
better profit siLuaLion Cur all concerned.
I cannot recommend Naomi and Bob Vandergriff on the basis that
they did not comply with the bid specifications and regulations.
Mrs.. Vandergriff called Mr. Glaves before the bid opening and
stated she had a car problem, asking that the bid opening be held
up. Mr. Glaves took her bid over the phone, which was 34%, and
turned it over to Mr. Pruss, who read the bid before any other
bids were opened.
Some seven minutes later Mrs. Vandergriff arrived and proceeded
to fill out her bid form, which was not ready even after arrival.
When Mr. Glaves prer:cante•d the bid to Mr. Pruss, both concessionaires
present protested thut thu regulations had not been complied with.
Both concessionaires prc Losted again upon the arrival of Mrs.
Vandergriff, claiming that her submittal did not conform to the
rules and regulations concerning the bid.

Personally, I would have to agree. It is for this reason that I
cannot recommend accepting the Vandergriff bid.
In closing I would like to say that I have appreciated the efforts
of Shirley Mic.haeloff and Gerald 5eibel over the past seven years.
They ha„e a good operation and have been a credit to the softball
program.
Unfortunately, with beer coming into play as part of the operation
this year, I feel that their bid of 20% was too low. I feel that
25% is a good bid, which will allow both parties, City and conces-
sionaire, an opportunity to operate successfully.

BID FOR SOFTBALL CONCESSIONS
Please place on the Agenda for February 15 meeting of the
City Council the awarding of bids for concessions for
softball, which would include the complexes and the
armory.
The bids wi11 be opened on February 15 at I1 a.m. which
is the day of the Council meeting, and the results would
be given to the City Manager sometime that afternoon.
The reason for pushing this situation is that if there is
a change of concessionaires, it would give the successful
bidder an opportunity to make his arrangements to buy
equipment and supplies, etc., and with softball beginning
the first part of April (or even some tournaments in Varch),
we would like to get this matter cleared up and completed
as soon as possible.

RESOLUTION NO. 84-106
AWARD - SOFTBALL CONCESSION CONTRACT
FOR TWO COMPLEXES AND THE
ARMORY FIELDS, WITH THE
ADDITION OF THE STADIUM IN
1985
WHEREAS, in answer to notice duly published in
accordance with law and the order of this City Council, sealed
bids were received and publicly opened by the City Clerk of
this City on February 15, 1984 at 11:00 a.m. for the contract
for Softball Concession for Two Complexes and the Armory
Fields, with the Addition of the Stadium in 1985 as described
in the specifications therefor approved by the City Council
February 1, 1984; and
WHEREAS, said bids have been compared, checked, and
tabulated and a report thereof filed with the City Manager as
follows:

WHEREAS", it has been determined that the bid from
Naomi Vandergriff was irregular and was not received in a
timely manner.
WHEREAS, the City Manager recommends that award be
made to the second loci bidder, Canteen Corporation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Lodi that award of contract for Softball
Concession contractus heretofore stated be and the same is
hereby made to Canteen Corporation, the second low bidder, in
the amount of 25% of gross sales after taxes, plus $1,000 of
either product or merchandise to be donated to any non-profit
organization with the Recreation and Parks Department.

I hereby certify that Resolution No. 84-106 was passed
and adopted by the City Council of the City of Lodi in
a regular meeting held February 15, 1984 by the
following vote:
