TO CONSIDER THE MAGGIO REORGANIZATION, INrMUDING AI�TION TO THE CM OF NODI AND DETAC MMT FRAM THE WUODBRIDGE FIRE DISTRICT, BOUNDED BY -C;PJ AS PARK ON THE NORTH; SOUTH STOCKTON STREET ON THE EAST; HARNEY LANE ON THE SOUTH; AND THE SOUT'MEV PACIFIC RAILROAD RIGHT-OF-WAY ON THE WEST RECOA?�iI IDED ACTION: Coluncil adopt Resolution No. 87-24 - Resolution directing the City Clerk, D to State of California Government Code Section 57000 et seq., to set a public hearing for Wednesday, 7:30 p.m., March 4, 1987, to consider the Maggio Reorganization including annexation to the City of Dodi and detachment from the Woodbridge Fire District (Exhibit A). At the November 4, 1986 General Election, the electorate amended the Land Use Element of the General Plan by adding Maggio Industrial Park, a 37.6 acre industrial project located at the northwest corner of South Stockton Street and Harney Lane. On November 19, 1986, Council adopted Resolution No. 86-170 initiating annexation proceedings on the subject parcel. Following a public hearing regarding the matter held on January 16, 1987, the Local Agency Formation C nTnission of San Joaquin County determined and ordered the following: 1. The Environmental Impact Report adopted by the City of Lodi as lead agency has been reviewed and considered, and a statement of overriding considerations is hereby adopted. 2. The above entitled reorganization is approved subject to the terms and conditions contained herein. 3. The boundaries are hereby approved, said boundaries being set forth in Exhibit A. 4. The affected territory is uninhabited. 5. The City of Lodi is designated as the conducting authority and the City Council is authorized to initiate proceedings for uninhabited reorganization in accordance with Section 57000 et seg. of the Government Code. TWO On October 2, 1985, Council adopted Ordinance No. 1362 prezoning Maggio Industrial Park to M-2, Heavy Industrial. Because the subject parcel is located adjacent to the Southern Pacific Transportation right-of-way, it was detFxmineid by LAF`CO that it would be pore timely to authorize the City Council to initiate Proceedings for uninhabited .reorganization in accordance with Section 57000 et seq. of the Government Code which provides that within 35 days following the adoption of the cotmiission ° s resolution making determinations, the clerk of the conducting authority shall set the proposal for hearing and give notice of that hearing by mail, publication, and posting. •1 ALICE M. The Environmental Impact Report adopted by the City of Lodi as lead agency has been reviewed and considered, and a statement of overriding considerations is hereby adopted. 2. The above entitled reorganization is approved subject to the terms and conditions contained herein. 3. The boundaries are hereby approved, said boundaries being set forth in Exhibit A. 4. The affected territory is uninhabited. 5. The City of Lodi is designated as the corxb-:ting authority and the City Council is authorized to initiate proceeAngs for uninhabited reorganization in accordance with Section 57000 et seq. of the Government Code. 6. The Executive Officer is hereby authorized and directed to mail and file certified copies of this resolution as required by Section 56853 of the Government Code. AGENCY FORMATION COM2MISSION OF SAN JO'+QUIN COUNTY RESOLr1TION APPROVING THE MAGGIO REORGANIZATION ;LAFC 18-86) INCLUDING ANNEXATION TO THE CITY OF LODI, AND DETACHMENT FROM THE WOCDBRIDGE FIRE DISTRICT WHEREAS, the above entitled proposal was ;-iitiated by resolu- tion of the City of Lodi, and on December 15, 1986, the Executive Officer certified the application filed for processing in accordance with the Local Government Reorganization Act; and, WHEREAS, the Commission held a public hearing on the proposed reorganization on January 16, 1987, in the Board of Supervisors Chambers, County Courthouse, pursuant to notice of hearing which was published, posted and mailed in accordance with State Law; and, WHEREAS, at Said hearing the Commission t.eard and received evidence, both oral and documentary, submit ed in favor of and in opposition to the proposed reorganization and all persons prensent - were given an opportunity to be heard.
