T 1 /P% r% t I I I COUNCIL COMMUNICATION x PUBLIC WORKS DEPARTMENT TO: City Council FROM: City Manager MEETING DATE: February 4, 1987 AGENDA TITLE: Adopt Resolution Assessing Cost of Sidewalk Construction, Setting Interest Rate, and Authorizing the Filing of the Assessment for Installation of Sidewalk at 840 S. Stockton Street RECOMMENDED ACTION: That the City Council adopt Resolution 87-22 assessing the cost of the sidewalk construction against the real property at 840 S. Stockton Street, setting the interest rate on the lien at 6% per annum, and authorizing the filing of the unpaid assessment with the County Tax Collector to be collected on the next tax roll. BACKGROUND INFORMATION: After the Council meeting of January 21, 1987, the property owners at 748 and 840 S. Stockton Street were billed for the cost of construction of the sidewalk installation. The property owner of 748 S. Stockton Street has Paid; however, the property owner of 840 S. Stockton Street has not pa i and a notice of lien for this assessment should be filed so that i;, can be collected with the City taxes on that property. It is also necessary to set the interest rate on this assessment at 6% as provided in Section 5891 of the Streets and Highways Code. D� Jack . ReImthe City Clerk RESOLUTTIChN NO. 87-20 A RESOLUTION OF TD FE LORI CITY COiTN IL CONFIRMING THE COST OF CONS7RLXrION REPORT FOR SIDEWALK CONSTRUCTION AT 748 AM 840 SOUTH ST00,VIJN M?M, ISI, CA JMMIA WHEREAS, the State of California Streets and Highways Code Section 5616 et seq. provides that the City Council set a public hearing to hear and pass upon the Cost of Construction Report filed with the City Council for sidewalk construction, and to hear objections or protests from property owners liable to be assessed for the cost of such construction at 748 and 840 South Stockton Street, Lodi, California; and WHEREAS, on January 21, 1987, a public hearing was held to hear and pass upon the Cost of Construction Report and to hear objections or protests from property owners liable to be assessed for the cost of such construction at 748 and 840 South Stockton Street, Lodi, California; and WHEREAS, no objections or protests were raised by the property owners liable to be assessev for the work of making such repair, and any other interested persons; and WHEREAS said Streets and Highways Code provides that the property owner be given a five-day period after confirmation of the cost by the City Council in which to pay the assessment; NOW, THEREFORE, BE IT RESOLVED that the Cost of Construction Report is confirmed by the Lodi City Council. s Dated: January 21, 1987 I hereby certify that Resolution No. 87-20 was passed and adopted by the City Council of the City of Lodi in a regular meeting held January 21, 1987 by the following vote: Ayes: Council Members - Olson, Pinkerton, Hinchman, Snider, and Reid (Mayor) Noes: Council Members - None Absent: Council Members - None Alice M. Rei t. City Clerk 87-20 RESOLUTION NO. 87-22 RESOLUTION CONFIRMING ASSESSMENT FOR CONSTRUCTION OF SIDEWALK AGAINST REAL PROPERTY AT 840 S. STOCKTON STREET WHEREAS, the Superintendent of Streets of the City of Lodi has heretofore filed with this Council his repor'L on the cost of construction of sidewLIks for each parcel of real property described as follows: Address APN Amount 748 S. Stockton Street 047-162-14 $493.75 840 S. Stockton Street 047-130-25 $1,027.00 AND WHEREAS, this Council has, pursuant to notice given as required by law, duly and regularly met at the time and place specified in said notice, to hear all protests or objections to said report of the Superintendent of Streets, and confirm said report of the Superintendent of Streets; NOW THEREFORE, BE IT RESOLVED that there were no protests or objections to the report of the Superintendent of Streets dated January 8, 1987 and said report was confirmed; and BE IT FURTHER RESOLVED that the dollar amount set after the parcel of real property listed in said report as 840 S. Stockton Street was not paid to the City within five (5) days, is hereby levied as a lien on said real property, and that the amount of said lien shall bear interest at the rate of 6% per annum, commencing on the 31st day after the date of the adoption of this resolution. Stockton Street APN 047-130-25 Pursuant to the authority vested in me by the Improvement Act of 1911, I did, on the 16th day of October, 1986, cause the sidewalk to be constructed, and the City Council of the City of Lodi did, on the 4th day of February, 1987, by Resolution No. 87-22, assess the cost of such construction upon the real property hereinafter described, and the same has not been paid, nor any part thereof, and the said City of Lodi does hereby claim a lien on said real property in the sum of $1,027.00, and the same shall be a lien upon said real property until said sum, with interest at the rate of 6% per annum from the said 7th day of March, 1987, has been paid in full and discharged of record. That the real property hereinbefore mentioned and upon which a lien is claimed is that certain piece of land lying and being in the City of Lodi, County of San Joaquin, State of Califorr,'-4, and particularly described as follows, to -wit: The West one-half of Lot 24 and Lot 25 as shown upon map entitled Zilke Subdivision, filed for record March 22, 1937, in Volume 11 of Maps and Plats, Page 24, San Joaquin County Records, except the South 29.9' of the West one-half of Lot 24.
