At that time, work was expected to commence shortly and be completed before the first of the year. As of this date, work has not commenced on the contract through no fault of the contractors. Due to the necessary regrading being slower than expected by Claude C. OF O TO: City Council COUNCIL COMMUNICATION FROM: City Manager DATE- February 2, 1981 SUBJECT: Salas Park Sprinkler and Turfing Contract RECOMMENDED ACTION: That the City Council authorize a payment of $29,031.52 to Nor Mac Inc. for materials being held for this project, BACKGROUND INFOPH ATION: The City Council awarded the contract for the above project to B S V Landscape of Sacramento in October of 1980. At that time, work was expected to commence shortly and be completed before the first of the year. As of this date, work has not commenced on the contract through no fault of the contractor. Due to the necessary regrading being slower than expected by Claude C. Wood Co., and unanticipated compaction problems being encountered by Granite Construction, the contractors responsible for the on- site drainage, the work being contracted to B b V Landscaping is still unable to start. Their suppliers, Nor Mac Inc. has warehoused the material for them but is requesting, at this time, payment in order to hold the price tendered in October. We feel this is a reasonable request, and in order to not have to negotiate a higher price for the work, or a rebid, would appreciate the Council's approval. The payment would be directly to the supplier, and they would be holding the material in the name of the City of Lodi, The City Attorney has reviewed this matter and agrees with the proposal, We have reviewed the proposal with the contractor u.:1 he is also in agreement. �ack L.
