There being no other persons wishing to speak on the matter,
the public portion of the hearing was closed.
Following a lengthy discussion with questions being
directed to staff, and to persons who had given testimony,
Council, on motion of Councilman Hughes, Pinkerton second,
determined that a Use Permit to use the single-family
parcel at 1001 York Street, Lodi, as an off-street parking
lot for the expansion of Fairmont Rehabilitation Hospital
at 950 South Fairmont Avenue be granted with the conditions
that negotiations for the purchase of the property at
1000 Windsor Drive go forward, that whatever parking spaces
are necessary for this expanded facility be provided at

Please be advised that following a Public Hearing on the
matter on February 3, 1982, the Lod_ City Council determined
that a Use Permit to use the single-family parcel at 1001 York
Street, Lodi, as an off-street parking lot for the expansion,
of Fairmont Rehabilitation Hospital at 950 South Fairmont
Avenue be granted with the conditions that negotiations for
the purchase of the property at 1000 Windsor Drive go Forward,
that whatever parking spaces are necessary for this expanded
facility be provided at Ladd Memorial Hospitals that these
parking spaces be properly signed and that adequate loading
and unloading areas and refuse storage be made available
immediately adjacent to the proposed expanded facility.

NOTICE IS HEREBY GIVEN that on Wednesday, January 20,
1982 at the hour of 8:00 p.m. or as soon thereafter as the matter
may be heard, the Lodi City Council will conduct a public hearing
in the Council Chambers, City Hall, 221 West Pine Street, Lodi,
California, to consider the appeal of George J. Williams, M.D.,
1200 West Vine Street, Lodi, of the Planning. Commis§ion's
denial of his request for a Use Permit to use the single-family
parcel at 1001 York Street, Lodi, as an off street parking lot
for the expansion of Fairmont Rehabilitation Hospital at 950

EXCERPT OF CITY OF LODI ZONING ORDINANCE SECTION 27-13,
Subsection (b), Automobile Parking Space, paragraph 15.
"15. Off-street parking lots: For the purposes above set forth,
the planning commiss.on may permit, under the provisions of
Section 27-15, and as an additional accessory and transitional
use, the use of any lot in any residence district, where such lot
is adjacent to a Commercial or Industrial District, but to a maximum
of one hundred feet therefrom, for off-street parking purposes for
the sole use of customers' or employees' automobiles during normal
business hours; provided, that no other commercial use shall be
conducted on the lot. All parking lots wherever thus provided and
permitted shall be improved as provided in paragraph 13 (ii) above
and in addition shall provide such screening by fencing or land-
scaping as may be prescribed by the planning commission, to the
end that such parking lots shall: not be detrimental to residential
lots in the vicinity. 1n the case of failure to so improve or
maintain such Improvements, the permission to use such lots for
off-street parking purposes may be revoked by the planning
commission."
NOTE:
Section 27-15: refers to Adjustments and Use Permits.
