An estimate shrAving the curb and gutter, street paving arui
drainage costs fronting the Carlin and Schock properties
was presented for Council's perusal. The existing storm
drain system terminates just west of Peach Street. Since
Carlin has the responsibility of installing the catch basin
and lateral, it is felt that the City should extend the
storm drain to the center of Peach and construct the
necessary manhole. This storm drain, manhole and line will
be used in the future for drainage on the west side of
Peach.
The other item of Council concern was how could assistance
be provided to the owner of owner/occupied single family
residences where the owner desired to install new curb,
gutter and sidewalk, or upgrade their existing sidewalk.

One possible concept would be to establish a Revolving Fund
for curb, gutter, and sidewalk installation or replacement.
The property owner would put up 50% and the Revolving Fund
would loan property owner the other 50% under a no or low
interest loan to be paid back in 5 years. Based on amount
this type of work cost in the past, approximately $10,000
would be needed if the 50%-50% concept was used. The loan
time, percentages and interest are conceptual and can be
modified. If payment is not made, the City could lien the
property as part of the loan agreement. Gas tax monies
could be used to start Revolving Fund.
Diagrams of the subject area were presented for Council's
perusal.
Following discussion with questions being directed to Staff,
Counc i 1 , on motion &f Mayor Pre; Tempore Snider, Reid second,
directed Staff to proceed with the calling for curb, gutter,
and paving - Cochran Road Street Improvements, Peach Street
to W.I.D. Canal.

RECOMMENDED ACTION: That the City Council review the cost estimates related
to the Carlin and Schock parcels (2041 and 2025 Cochran Road) and take the
appropriate action.
BACKGROUND IVORMATION: At the regular Council meeting of September 7, 1983,
the Dallas Paul development at 2001/2009 Cochran Road was reviewed with the
City Council and a portion of the appealed request from the developer was acted
upon. For Council information, attached is an exhibit showing the subject area,
a copy of the Council Communication for the September 7 meeting, together with
.he minutes for the September 7 meeting.
The action that the City Council took at the September 7 meeting was: (1) de-
termined that in conjunction with the Paul development that curb and gutter on
the north side of Cochran Road between Peach Street and Paul development would
be installed; (2) sidewalk would not be required at this time for the properties
west of the Paul development; (3) the curb and gutter and drainage improvements
on Cochran Road under the agreements for Carlin (2041 Cochran) and Schock (20�,
Cochran) would be called for at this time; (4) the City would exchange curb,
gutter and street paving for right-of-way fronting the Lewis parcel (2033 Cochran)
and the Nielson property (2017 Cochran); (5) the sidewalk under the Carlin and
Schock agreement would remain in effect with the City having the option to call
for that at a later date.

Development - 2001/2009 Cochran load
MCOMMENDED ACTION: That the City Council discuss the request of the developer
of 200172009 Cochran Road regarding City improvements and take the appropriate
action.
BACKGROWD INFORMATION: Attached is a drawing showing the parcels on Cochran
Road which are re erred to under this comr-inication.
In August of 1930, the owners of 2025 Cochran Road signed an agreement with
the City of Lodi agreeing to "install curb, gutter, sidewalk, street lights,
grading and pa v l n g In conformance with standard City Policy. upon demand of
the City and in no event later than five years fro; -.i the date of execution of
this agreement." .
In September of 1982, the owners of corner parcel at 2041 Cochran Road entered
into a different, but similar agreement. This agraeuient and the reason for
deferring their inprovement was discussed at the September 15, 1982, Council
meeting. The attached Councii cormwiication dated September 8., 1932, covers
the reasons for deferring the improvements on Cochran F.3ad. The City Council
concurred in the postponere• t of improvements and the requiring of all improve-
ments or the north side of Cochran load (Peach to N.I.D. Canal) ►then the 2UU1/
2009 Cochran Road parcel develops.
Recently. Dallas and Willa Paul have been discussing with the Assistant City
Engineer the possible developownt of the 2001/2009 Cochran Road parcel which
Is shaded on the attached drawing. Attached is a letter from the Pauls dated
August i1, 1983, requesting the City to consider a phased development plan
for the improvements west of their parcel. The letter requests that the City
not call for all the iaprovem nts on Cochran load and that the property owners
be allowed to only install the curb and putter at this time. The installation
of the sidewalk and street lights would take place some tlora in the future.
The Pauls are also asking the City to be responsible for all street paving
fronting 2017, 2025, 2033 and 2041 Cochran bad. Under present policy, if the
owners of 2017 and 2033 elected to put In just their curb and gutter at this time.
the City would do any necessary paving to complete the street. However, the
City has an agreement with 2025 and 2041 Cochran which makes them responsible
for their paving. It Is felt that a for reaching precedent would be set if the
City picked up the paving cost on the 2025 and 2041 Cochran parcels.

If the City were to call for all the improvements as they had discussed in
September 1982 (i.e. 2025 and 2041 Cochran under their agreement with City
and 2017 and 2033 Cochran under a Streets a Highway Code improvement Act),
the following actions would have to take Placa:
1. City would have to first acquire 7-1/2 feet of additional
right-of-way from parcels at 2017 and 2033 Cochran Ibad.
2. City would have to call for improvements at 2025 and 2041
Cochran Mad.
3. Once improvements under Paul's proposed development (2001/2009
Cochran) and the improvement at 2025 and 2041 Cochran were
installed, the City would then call for improveamnts at 2017
and 2033 Cochran under a Streets and Highway Code Improvement
Act.
Under this procedure, all of the Cochran Road improvements could not be con-
structed under one contract, which is the preferred method.
Tharefore, If the Council wants fuli improvements in subject area, it Is suggested
that the following procedure be considered:
1. City would call for improvement at 2025 and 2041 Cochran $bad
to be installed at the sane time as Paul's development at 2001/
2009 Cochran.
2. At 2017 and 2033 Cochran Read, the City could trade curb, gutter
and sidewalk installation for street right of dedication.
Right -of -Way costs $2,000 - $3,000
Curb, Gutter i Sidewalk costs $3.000 - $3.500
3. City would pick up paving cost only at 2017 and 2UJ3 Cochran.
4. The (5) property owners on Cochran bad would all share in the cost
of one street light ($1500 t )
The Publ is Works Department recommends that the Council work out a way to ob-
tain all the improvements at this time.

Dear Mr. Robison:
As you know, we own a lot on Cochran Road across from the Sun West
Swim Club which we intend to subdivide. After our first visit
with you, we went to the four property owners who will be affected
by our subdivision of this property to discuss their participating, in
the construction of curbs, Putters and a storm drain system from our
property to the corner of Cochran Road and Peach Street. At the time
we talked to these peonle, we were under the impression that if they
would agree to put in the curb and gutter, the city would waive the
necessity of sidewalks and that the city would pave from the street
to the curb and Rutter. All of these homeowners, with the exception
of Mrs. Nielsen who feels she really cannot afford to participate
in this proiect, were more than willing to put in the curb and gutter.
They did, however, voice an objection to the idea of nutting in a
sidewalk. They prefer the "rural" look of their street and would
like to keep it looking that way.
We would like to proceed with this project as quickly as possible.
Would it be possible that the City of Lodi would, at least for the
present time, agree to waive the need for sidewalks and agree to
pave from the road to the curb and gutter?
There has also been mentioned the need for a street light. Could
we ask that we be given a list of all of the things that the
city will require in order for us to complete this subdivision?
I think we can complete all projects much more effectively and
quickly if we have a complete list of requirements prior to the
actual work being started.
We are looking forward to working, with you and the City of Lodi
on this project.

Public Works Director Jack Ronsko gave the following report
concerning the matter to the Council and presented diagrams
of the subject area for Council's perusal.
In August of 1980, the avners of 2025 Cochran Road signed an
agreement with the City of Lodi agreeing to "install curb,
gutter, sidewalk, street lights, grading and paving in
conformance with standard City Policy, upon demand of the
City and in no event later than five years from the date of
execution of this agreement."
In Septen ber of 1982, the owners of corner parcel at 2041

to serve his development and he must also conform to the
City's Water Alaster Plon.
3. If the developer extends a water mein which will
ultinvitely serve other fronting parcels, the City enters
into a 10 -year reimbursement agreement with the developer.
4. Where the City's Master Plan calls for a major water
plain installation (10" or greater), the de%eloper shall
install thesize inc shown on the Master Plan; however, the
City will credit h°r for the difference in cost of materials
between an 8" wate mein installation and the installation
required under the A ster Plan.
5. Where possible, the A'tlster Plan lines are installed
within the public street right-of-way. However, in
industrial and large commercial areas, in order to get the
Proper grid network, it is necessary to inst!tll sone Master
Plan lines in easements. This is the situation which is
being considered under this request.
6. The developer is also required to provide adequate
on-site fire protection. In most instmices in larger parcel
devclopw.nts, this will require a water main (6" or 8") to
be installed on-site.

2041 Cochran Road to be installed at the same time as Paul's
development at 2001/2009 Cochran; further, Council

cost of the improvements, it will be forwarded to you. it is
not required that you use the same contractor as the Pauls and
