A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKEWOOD ENDORSING THE COURT REFORM
INITIATIVE
WHEREAS, the administration of criminal justice has become
incre.singly cumbersome in California under the weight of unnec-
essary delays and prohibitive costs caused by court ineffi-
ciency; and
WHEREAS, the California court system is hampered by the
search for technical imperfections in criminal cases which
permit guilty criminals to obtain reversals of convictions to
commit new crimes and create new victims; and
WHEREAS, the federal judicial system already employs a jury
selection process which streamlines the search for a fair and
impartial jury without permitting t.:e unlimited questioning of
jurors permitted by California court ; and
WHEREAS, reforms in the preliminary hearing process, grand
jury indictments and less -than -unanimous verdicts will save both
time and taxpayer costs while protecting the fairness and
equality of criminal justice; and
WHEREAS, tech-nical delays in the trial process escalate the
cost of court cases and reinforce the principle that justice
delayed is justice denied; and
WHEREAS, denial of parole or probation can be an effective
deterrent to further criminal activity if denial is made
promptly; and
WHEREAS, the criminal court initiativv :could perm -it judges
to revoke probation-, allow the Board of Prison Terms to order
paroles revoked, restore the Grand Jury in indictments, adopt
the federal jury selection process, permit less -than -unanimous
jury verdicts in most cases, make c-ontiniaances difficult to
obtain, reduce the number of technical defense motions during
preliminary hearings, and curtail time-consuming private
questioning of jurors in death penalty cases; and
WHEREAS, the initiative does not impair the civil rights of
any defendant; and

WHEREAS, the City Council Legislative Advocacy Committee,
on January 6, 1984, recommended endorsement of the "criminal
court initiative";
NOW, THEREFORE, BE IT RESOLVED 8Y THE CITY COUNCIL of the
City of Lakewood that the city endorse the goals of the Court
Reform Initiative; and
FURTHER, that the City Council urge Lakewood residents to
read the criminal court initiative and becole better informed
about its goals and positive effects; and
FURTHER, that the city clerk is directed to circulate
certified copies of this resolution to other California cities
requesting additional endorsements

The administration of justice has become increasingly cumbersome in
California. Unnecessary court delays are disheartening to victims, witrtcmxs,
law officers. prem-utors, ar,d judges. And, the justiee process has beeoose
prohibitively expensive.
The 1973 trial of Juan Corona cost some $300,000. His recent retrial cost
some $4 6 million' Costs in the Hillsidc Strangler trial have already reached
$1.2 million. And. the end is not in sight The Criminal Defartment of the
Los. Angrkn County Superior Court now costs over $4,000 per day.
Of cotuse, no expense should be spared in the determination of truth and the
fair admin..*.tration of justice. Nor should the rights (--f okft^:tdants be violared.
But Caiifomsia's criminal justice system has degenerated from a seamb
for the truth into a search for technical imperfections. Guilty crimirmh
obtain reversals of convictions. Crime victims and society pay through new
victimization.
But justice. though due to the accused, is due to the accuser
also. The concept of fairries: must not be strained till it is
narrowed to a filament. We are to keep the balan-.c true.

Recent California Suprema Court rulings have greatly increa*ed the time and
costs net essary to select a jury by allowing unlimited questtoning of prospective
jurors by attorneys. in Ventura County, for cxunpk, jury selection time in
rx.n•de.ith penalty cases Iw incr_vsrcl 138 percent since 1976. Jury w-Jection
in the Hillside Strangler case took four nx)ntfu. and in one Riverside County
murder trial, jury selection took five months.

California will follow the Federal pra.tice where judges
ask questions submitted by the lawyers. This still allows the
defendant to be tried by a fair and impartial jury but time — and expense —
are greaay reduced
A recent Governor's stud% in New York estimated that ar'opting the Federal
system in that state would !scan 'tnal time savings equivalent to the Work
product of 26 additional fudges
Again, the California S•.jprere Cour. has ruled that defendants are en:itird
to a prelimtnar) hearing even though the Grand Jury has issued an indir!ment

and increases the taxpayers burden. The preliminary hearing unnecessarily
duplicates the work of the Grand Jun

A verdict of 10 to 2 or 14 to 1 in criminal cases for acquittal or conviction

INITIATIVE MEASURE TO BE SUBMITTED DIRECTLY TO THE VOTERS
The Attorney General of California has prepared the following title and summary of the chief purpose and
Points of the proposed measure:
CRIMINAL COURT PROCEDURES. INITIATIVE CtNSTITUTIONAL AMENDMENTS AND STAT-
UTES.
TATUTES. Changes criminal court procedures regarding jury selection. continuances. admissible evidence,
probation and parole revocation, grand juries. and other- matters. Among other changes, provides agree-
mml of 10 jurors is sufficient for criminal verdicts except in death penalty cases; authorizes hearsay
evidence before grand jury or at preliminary examinations as basis for findings and restricts evidence
presented to that heeded to show sufficient cause to beliwn defendant committed an offense; expands
judicial control of jury examination-, requires showing of good cause for continuances; restricts motions
made prior to or at preliminary examinations. Summary of estimate by Legislative Analyst and Director of
Finance of fiscal Impact on state and local governments: The various provisions of this meazure could affect
the length and number of criminal proceedings (grand jury hearings. preliminary hearings. and trials) and
the length of Incarceration of defendants for whom probation or parole is revoked. Some of these changes
probably would result in savings to ate and local governments. especially those relating to non -unanimous
jury verdicts, and the jury selection process. Other provisions, particularly those lnvrr:ving probati.)n ant;
parole revocation. could result in additional costs to state and local governments. Given the data avaltable at
this time. It is not possible to determine the measure's fiscal impact on stat- 9nd local governments.
To the Honorable Secretary of Stair of California:
%. the undersigned, registered. qualified voters of California. residents of
County (or City and County), hereby propose amendments to the Constitutkv. of California and the
California Penal Code. relating to Criminal court returns and petition the Secretary of State to submit
the same to the voters of California for their adoption or rejection at the next succeeding
general eieetim or at any special statewide election held prior to the general election or otherwise
provided by law. The ,proposed constitutional rod statutory amendments read as follows:

RESOLtTrION NO. 84-008
A RESOLUTION OF THE CITY COUNCIL OF TETE
CI'T'Y OF LODI ENDORSING TEE COURT REFORM
INITIATIVE
WHEREAS, the administration of criminal justice has becane
increasingly cumbersome in California under the weight of unnecessary
delays and prohibitive costs caused by court inefficiency; and
WHEREAS, the California court system is hampered by the search
for technical isrperfec.-tirm-ts in criminal cases which permit guilty
criminals to obtain reversals of convictions to comit new crimes and
create rk w victims and
WHEREAS, the federal judicial system already employs a juzy
selection process which streamlines the search for a fair and
impartial jury without permitting the unlimited questioning of jurors
permitted by California courts; and
MUMEAS, reforms in the preliminary hearing process, grand jury
indictments ,and less -than -unanimous verdicts will save both time and
taxpayer costs while protecting ':he fairness and equality of criminal
justice; and
WHEREAS, technical delays in the trial process escalate the cost
of court cases and reinforce the principle that justice delayed is
justice denied; and
WHEREAS, denial of parole or probation cnn be an effective
deterrent to further criminal activity if denial is made promptly; and
WHEREAS, the criminal court initiative would permit judges to
revoke probation, allow the Board of Prison Terms to order paroles
revoked, restore the Grand Jury in indictments, adopt the federal jury
selection process, permit less -than -unanimous jury verdicts in most
cases, make continuances diffiaxlt to obtain, reduce the number of
technical defense motions during preliminary hearings, and curtail
time-consuming private questioning of jurors in death penalty cases;
and
WHMAS, the initiative does not impair the civil tights of any
defendant; and
WHEREAS, the City Council Legislative Advocacy Committee, on
January 6, 1984, recommended endorsermnt of the "criminal court
initiative";
NOW, 'II , BE IT RESOLVED BY THE CITY CDWIL of the City of
Lodi that the city endorse the goals of the C -,, ,.rt Reform Initiative;
and
F'URT'HER, that the City Council urge Lodi residents to read the
criminal court initiative and beoame better informed about its goals
and positive effects.
