SUBJECT: City -County Agreement for Construction of Hutchins Street -
Harney Lane Traffic Signal
RECOMMENDED ACTION: That the City Council authorize the Mayor to execute the
attached Agreement between the City and County for the sharing of costs and
responsibilities for the construction of the traffic signal at Hutchins Street
and Harney Lane,
BACKGRWND INFORMATION: The attached Agreement was prepared by this. office
working In conjunction with the City Attorney and it has been forwarded to
the County. The County has approved the wording of the Agreement and It Is
appropriate for the Council to take action for Its execution.
The signal is approximately 90% designed and tt Is anticipated that we will
be advertising the project in late February or early March of this year,

RESOLUTION NO. 81-10
RESOLUTION APPROVING CITY -COUNTY AGREEMENT
FOR CONSTRUCTION OF HUTCHINS STREET
HARNEY LANE -TRAFFIC SIGNAL
RESOLVED, that the City Council of the City of Lodi
does hereby approve Agreement between the City of Lodi and the
County of San Joaquin for the Installation and Maintenance of
the Hutchins Street and Harney Lane Traffic Signal, a copy
of which Agreement is attached hereto and thereby made a part
hereof.
BE IT FURTHER RESOLVED, that'the City Council of the
City of Lodi does hereby authorize the Mayor and City Clerk to
execute the subject Agreement on behalf of the City.

A G R E E M E N T
THIS AGREEMENT, made and entered into this 21st day of January
1981, by and between the CITY OF LODI, a Municipal Corporation of the State of
California, hereinafter referred to as "CITY," and the COU1ITY OF SAU JOAQU911, a
Political Subdivision of the State of California, hereinafter referred to as
"COUNTY."
V I T U E S S E T H
WHEREAS, the intersection of Hutchins Street and Harney Lane is located
partiaily within the m-porate limits of City and partially within the unincor-
porated area of County and serves both County and City residents; and
VAIEREAS, the City Council of the CITY OF LOD 1 and the Board of .Supervisors
of the County, of San Joaquin deem it advisable from a traffic safety standpoint
that a traffic actuated signal system be installed at said intersection as a joint
project with the cost being paid by City and County in proportions hereinafter
set forth.
NOW THEREFORE, it is hereby agreed by and between the City and County as
follows:
1. The project to be performed pursuant to this agreement is the installatton,'
at the intersection of Hutchins Street and Harney Lane, of traffic signals with
mast arm signal lights, pedestrian lights as needed, full vehicular and pedestrian.

controller sufficient to perform tasks assigned, and shoulder paving as required
on Harney Lane.
2. City shall act as the fiscal agent for the County for the project
hereinabove described and shall perform all engineering work necessary, including

the making of all surveys, preparation of the pians and specifications, calling
forbids, awarding of the contract, supervision of construction, inspection, and
the preparation of progress payments, all auxiliary to the items above, which may
be necessary to complete sane.
3. Total cost of said project is defined herein to include construction costs,
engineering field work, right of way acquisition costs, design, drafting of plans,
cost estimates, construction supervision and overhead costs_ City shall make
available to County all documents showing all costs incurred by Clty pertaining
to said project.
4. Costs of said project shall be shared between City and.County in the
following ratio:
75% to be paid by City
25% to be paid by County
5. City shall bill County for County's portion of the cost of the joint
project. The percentage to be paid City by County shall be paid on progress
payments as well as final payment when due.
6.- City warrants that the letting of said contract or contracts and construction
shall be done pursuant to the laws of the State of California and the rules and
regulations of the Department of Public lh)rks of the State of Caiifornja and as
currently in use by the City of Lodi.
7. City warrants to County the completion of said project as set forth lin the
plans and specifications filed with and approved by the City Council of the.City
of Lodi.
8. City agrees to accept full responsiblility for the superviston of the
actual construction of said signal system and to consult and cooperate with

County and to keep them fully advised during the progress of said work.
9. City warrants to County that the contractor or contractors forthe con-
struction herein will be required to furnish a Faithful Performance Bond in the
amount of one hundred percent (100%) of the contract price and a Labor and Material
Bond in the amount of fifty percent (50%) of the contract price. Said contractor
will be required by City to carry $300,000/$500,000 public liability, property
damage, and Workmen's Compensation insurance to protect said City and County against
claims of every nature arising out of the construction of said project hereinabove
described up to the time of final completion and acceptance of said project.
10. Operation and maintenance of the traffic signal system will be carried
out and supervised by the- City of Lodi.
11, All future costs of maintenance and energy shall be shared between City
and County in the following ratio until such time that a change (n the corporate
limits of City alters the ratio of intersection legs:
75% to be paid by City
25% to be paid by County
City shall bill County for its portion of said costs annually.
12. The*County Auditor/Controller is hereby di, acted and authorized to pay
said bill for construction of said signal.
13. It is estimated that the completion of said installation will take
approximately six (6) months from award of c(..:struction contract; that the cost
of construction will be approximately seventy-one thousand ($71,000.00) DOLLARS,
and that the cost of furnishing electrical power to the signals will be ap-
proximately ONE HUNDRED ($100.00) DOLLARS per month.
In the event the low bid exceeds 10% of the estimated project cost, the
City will consult with the County prior to the award of the contract.

Execution of the foregoing Agreement has been authorized by Resolution
No. duly passed and adopted by the City Council of the City of Lodi
on the day of 1981, and by Resolution No.
duly passed and adopted by the Board of Supervisors of the County of San Joaquin,
State of California, on the day of1981.
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and
seals the day and year first hereinabove written.

RESOLUTION APPROVING THE INSTALLATION OF 4 -WAY
STOP SIGNS AT THE INTERSECTION OF FAIRMONT AVENUE
AND VINE STREET, FAIRMONT AVENUE AND TOKAY STREET
AND THE MODIFICATION OF THE "NO PARKING" LIMITS AT
BOTH INTERSECTIONS
RESOLVED, by the City Council of the City of Lodi that
Section 192 of Ordinance No. 493, as amended, is hereby
amended by adding the.follow-ng section:
T. Fairmont Avenue and Tokay Street
U. Fairmont Avenue and Vine Street
