NO. 1373 City Manager Peterson reminded the Council that at its regular meeting of December 4, 1985, the City Council C 4b adopted Resolution No. 85-172 establishing parking restrictions in the area near the Pacific Coast Producers facility. This resolution accomplished the following: a) designated the area for permit parking; b) established certain times for "No Parking", except with a residential parking permit; c) established the enforcement period of June 1 through March 31. -The chronology of..events resulting _frcm.this action -was _. outlined for Council. Council disomsion followed with questions being directed to Staff. b. the program shall be enforced by the Finance Department.. from 8:00 am to 5:00 p.m. Monday through Saturday C. the Police Department shall be responsible for enforcement at times other than enumerated above a d. residential parking permits shall be issued effective June 1, 1986 for a period of three years or to March 31, 1989, whichever ooaars first e. the cost per permit shall be $3.00 for each three- year period or lesser period of time thereof f. residents of the area so designated shall be issued one permit for each vehicle owned by the resident, i upon producing proof of residency and vehicle ownership City Manager Peterson further advised that the Finance Department will have the appropriate "paperwork" in place and the actual permits ready for sale by mid-March which is ample lead time prior to the start of the enforcement period (June 1). NO. BACKGROUM INFORMATION: At its regular meeting of December d, 1985, the City Council adopted Resolution No. 85-172 establishing parking restrictions in the area depicted on the attached Exhibit A, specifically that area adjacent and in close proximity to the Pacific Cost Producers -facility, -A-copy- of.. -than resolution is attached (Exhibit B). Also attached (Exhibit C) is a copy of an ordinance which amends the City Code to allow the City Council to designate by resolution rather than ordinance certain residential streets as preferential parking: zones fore.ahe ienefit of theses dents in such �. - areas. The ordinance also makes other minor changcs`in the City Code _. relating to permit parking and the City Attorney will be prepared to review these:- with the City Council. The resolution adopted by the City Council at its December 4 meeting accomplished the following: a) designated the area for permit parking; b) established certain tines for "No Parking", except with a residential parking permit; c) established the enforcement period of June 1 through March 31. This resolution further provides that the City Council will implement by subsequent action the details of the provisions enumerated therein. From this point forward, the chronology of events will be: January 15, 1986 - Introduce ordinance amending City Code regarding permit parking areas February 5, 1986 - Adopt ordinance amending City Code regarding Permit Parking areas March 7, 1986 - Above ordinance effective March 15, 1986 - Adopt resolution designating permit parking area as depicted on Exhibit A June 1, 1986 - Effective date of permit parking in area depicted on Exhibit A March 31, 1987 - End of permit parking enforcement period With regard to the specifics of this initial program, the following recommendations are made: a. the program shall be administered by the Finance Department from 9:00 a.m. to 4:00 p.m. Monday through Friday b. the program shall be enforced by the Finance Department from 8:00 a.m. to 5:00 p.m. Monday through Saturday c. the Police Department shall be responsible for enforcement at times other than enumerated above d. residential parting permits shall be issued effective ,lune 1, 1986 for a period of three years or to March 31, 1989 whichever occurs first e. the cost per permit shall be $3.00 for each three-year period or lesser period of time thereof f. residents of the area so designated shall be issued one permit for each vehicle owned by the resident, upon producing proof of residency and vehicle ownership The Finance Department will have the appropriate "paperwork" in place and the actual.. -permits ready. -.for sale_ by mid-March. which is, ample, Lead time. prior to the start of the enforcen-vent period (June 1). 10017 • CITY OF L O D I RESTRICTED PARKING AREAS PUBLIC WORKS DEPARTMENT EXHIBIT A EXHIBIT B RESOLUTION NO. 85-172 RESOLUTION ESTABLISHING PARKING RE,STRICTICNS IN THE AREA OF THE PACIFIC CDAST PFS FACILITY RESOLVED, that the City Council of the City of Lodi does hereby establish the following parking restrictions in the area of the Pacific Coast Producers Facility: 1. Each resident in the area depicted on Exhibit "A" attached hereto and thereby made a part hereof wi11. be provided withz.a resident permit _._. 2. "No Parking" restrictions will be established for one (1) hour frau 8:C0 a.m. to 9:00 a.m.; 3:00 and 3:00 a.m. to 4:00 am: except with a resident permit 'from :.une 1 through - - March ?1. AN ORDINANCE OF T11E LODI CITY COUNCIL. AMEMING LODI MUNICIPAL CODE TITLE 10, CHAPTER 10.32 RESIDENTIAL, PERMIT PARKING BE IT ORDAIL*-D BY THE LODI CITY COUNCIL. SECTION 1. This ordinance anendment is enacted pursuant to the authority contained in Title 10, Residential Permit Parking, Chapter 10.32, Section 10.32.010 of the Lodi Municipal Code and California Vehicle Code Section 22507. Section 10.32.010. Statutory authority. The ordinance codified in this chapter is enacted pursuant to the authority contained in California Vehicle Code Section 22507. Section 10.32.020 Zone Designation. A. The Council may designate by resolution fran time to time, certain residential streets or any portions thereof as a preferential Parking zone for the benefit of residents adjacent thereto in which zone vehicles displaying a permit or other authorized indicia may be exempt frau parking prohibitions or restrictions otherwise posted, - 1- marked or noticed, for such periods of time as designated in the resolution. B. No preferential parking ordinance shall apply until signs or markings giving adequate notice thereof have been placed. Section 10.32.030 Permit Required. No person shall park or leave standing on such street or portion thereof, any vehicle unless such vehicle has displayed thereon an appropriate permit issued by the Finance Director which entitles the holder thereof to preferential parking privileges on the street or portion thereof in question. Section 10.32.040 Application for Permit. Each application for a parking permit shall contain information sufficient to identify the applicant, his residence address on a street within the residential parking permit area, the license number of the motor vehicle for which application is made and such other information that may be deemed relevant by the Finance Director. Section 10.32.050 Issuance of Permit. A. Parking permits shall be issued by the Finance Director. No more than one parkins; permit shall be issued to each motor vehicle for which application is made. The Finance Director is authorized to issue such rules and regulations, not inconsistent with this chapter, governing the manner in which persons shall qualify for parking permits. B. Parking permits may be issued for motor vehicles only upon application of a legal resident of property adjacent to a street within - 2- "'li: the residential permit parking area who has a orator vehicle re-,i.stered in his name or who has a riotor vehicle for i•,Ls exclusive use and under his control. C. Proof of residency and motor vehicle ownership or vehicle use and control shall be demonstrated in a nanner determined by the Finance Director. Section 10.32.060 Term of Permit. Permits issued pursuant to this chapter shall remain effective Section 10.32.070 Display cf Permit. Pe=ws shall be displayed on the left rear bumper of the vehicle for which the permit is issued. Section 10.32.080 Fee. The Finance Director shall collect a fee for each original permit issued and for each renewal permit issued in an amount to be determined from time to time by resolution of the City Council. Fees are payable for three calendar year periods of time only and fees will not be prorated for lesser periods of time. A new section is added to read as follows: - 3- Section Term of Permit Parking. The permit parking shall be effective for periods of time as designated on the sign giving notice thereof. A new section is added to read as follows: Section Transfer of Permit Prohibited. Parking permits issued to the motor vehicle of the legal resident of- roare. issues: exclusively for,that resident'.s,motor vehicle and shall not be transferable to any other party. No vehicle for which a permit has been issued hereunder shall be parked upon any street or alley in the city in violation of any part of this municipal code or in violation of the californi.a Vehicle Code. Section 10.32.090 motions. The provisions of this chapter shall not apply to any delivery vehicle, which vehicle is under the control of an individual providing service to property located on a street in a residential permit parking area; nor to any emergency motor vehicle including, but not limited to, an ambulance, fire engine, police vehicle or other City vehicle providing City service. - 4- Section 10.32.100 Violation --Infraction. Pursuant to Government Code Section 36400, violations of this chapter are designated infractions. SECTION 3.
