AWARD-`CLUFF City Manager Glaves presented the following bids
AVENUE which had been received for the Contract for
STORM DRAIN Cluff Avenue Storm Drain Phase I:

Council was apprised that there were two irregu-
laricies in the low bidder's bid proposal,
namely,
1. The Unit price extension for item #3 was In-
correct
2. The corporate seal was not affixed to the bid
document as required.
Council was informed that included in the bid
documents is the statement, "The owner reserves
the right to waive any informalities or to reject
any or all bids", which gives the City Council
the right'to waive the irregularities in the low
bid or to reject the low bid.
Following Council discussion, with questions being
directed to Staff and the City Attorney, Council,
on motion of Councilman Murphy, McCarty second,
adopted Resolution No. 81-1 waiving the irregu-
larities in the low bid and awarding the contract
for Cluff Avenue Storm Drain Phase I to Crutch-
field Construction in the amount of $39,696.00,

SUBJECT: Contract for Cluff Avenue Storm Drain Phase I
RECOWENDED ACTION: That the City Council review the irregularities in the low
'91d and award the Uld to the appropriate contractor.
BACKGROUND INFORMATION Plans and specifications for this project were approved
by the City Council on December 17, 1980. Bids were opened this Tuesday,
January 6, 1981, and the following seven bids were received:

Engineer's Estimate $40,000.00
A tabulation of the bids has also been attached.
*There were two irregularities in the low bidder's bid proposal:
1. Unit price extension for item 13 was incorrect;
2. The corporate seal was not affixed to the bid documents as required.
Our department talked to Mr. Harold Crutchfield after the bids were received
and he indicated that the total for item B3 ($2,000) was correct and the unit
price should have been $166.67. The unit price bid by the other contractors

for item 13 range from $$0 to $620 and it is felt that the $2,000 total is
correct based on bids of the other contractors. Hr. Crutchfield indicated
that their corporate seal had been stolen and a new one was on order and
that he had meant to call us earlier about it but failed to do so. it's
the City Attorney's position that because the corporate seal was not affixed
to the bid proposal, that Crutchfield Construction's bid should be rejected
and that the bid be awarded to the second low bidder, Teichert Construction Co.
Included In the bid documents is the statement, '"rhe owner reserves the right to
waive any informalities or to reject any or all bids," which gives the City
Council the right to waive the irregularities in the low bid or to reject the
low bid.
Both Crutchfield Construction and Teichert Construction have done previous acceptable work
for the City of Lodi.

AWARD - CLUFF AVENUE STORM DRAIN PHASE I
WHEREAS, in answer to notice duly published in accordance
with law and the order of this City Council, sealed bids were
received and publicly opened by the City Clerk of this City on
January 6, 1981 at 11:00 a.m. for the contract for Cluff Avenue
Storm Drain Phase I as described in the specifications therefor
approved by the City Council December 17, 1980; and
WHEREAS, said bids have been compared, checked, and
tabulated and a report thereof filed with the City Manager
as follows:

WHEREAS, the City Council of the City of Lodi has
exercised its right to waive informalities that were contained
in the Crutchfield Construction bid; namely the omi.-s9-iron of the
Crutchfield Construction Corporate Seal and a minor addition
error.
WHEREAS, the City Manager recommends that award be
made to the low bidder, Crutchfield Construction;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Lodi that award of contract for Cluff Avenue Storm
Drain Phase I be and the same is hereby made to Crutchfield
Construction, the low bidder, in the amount of $39,696.00.

I hereby certify that Resolution No. 81-1 was passed
and adopted by the City Council of the City of Lodi in
a regular meeting held January 7, 1981 by the following
vote:
Ayes: Councilmen - McCarty, Murphy, Katnich
